The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. The Contractor shall furnish all labor, supervision, tools, materials, equipment, transportation, and supplies, necessary to perform the following services: Services include furnish labor and equipment to clean a storm water channel approximately 100 feet from the site. Services also include furnishing labor and equipment to remove vegetation from ore piles. The vegetation shall be cut and removed from the site. All foreign materials including rubbish shall also be removed from the site. The performance of work in the services listed above shall consist of removing all rubbish, sprouts, brush, weeds, downed timber, rotted wood, shrubs, grasses and vines which shall be cut or mowed, to a maximum height of 3 inches. Prior to disposal of rubbish or vegetation, the identity of the disposal facility proposed for use must be submitted to the OIC for approval.
