name mandatory combined synopsis/solicitation for specific commercial
items prepared in accordance with the format in the Federal
Acquisition Regulation (FAR), Subpart 12.6, as supplemented with
additional information included in this notice. This announcement
constitutes the only solicitation. Proposals are being requested. A
written solicitation will not be issued. Solicitation number
N00421-96-Q-1122 is issued as a Request for Quote (RFQ). The
incorporated document, provisions and clauses are those in effect
through Federal Acquisition Circular 90-37 and Defense Acquisition
Circular 91-10. The applicable Standard Industrial Classification code
is 3577. This combined synopsis/ solicitation also serves as a notice
of intent to negotiate on an other than full and open competitive
basis. All eligible qualified distributors of this brand name product
may respond to this quote for the procurement of CLIN 0001: (1 each)
VxWorks 5 User Development System License with 2 Target Licenses (VSDL
5.3 Nitro-40); CLIN 0002 (1 each) VxWorks Target System License
(VXTGNW 5.3); CLIN 0003 (1 each) Annual Maintenance Fee for VXDL 5.3
(AMF-1); CLIN 0004 (1 each) Single User WindView License; CLIN 0005 (1
each) Annual Maintenance Fee for Single User WindView; CLIN 0006 (3
each) RS232 Serial Cable (314A001-XX); CLIN 0007 (3 each) SCSI/Ethernet
Cable (360A015-XX); CLIN 0008 (3 each) Nitro 40 CPU Board
(Nitro-40-33.2-8MB-FL) The contractor shall deliver entire quantity:
(1) with original equipment operators/maintenance manuals; (2) F.O.B.
destination; (3) within 30 days of award; (4) to Receiving Office,
NAWCAD Patuxent River, Villa Rd, Bldg #115, St. Inigoes, MD 20684-0010,
M/F: Mark Cianflone. Inspection and acceptance shall be made at
destination. FAR 52.212-1 INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS
(OCT 1995) is incorporated by reference and applies to this
acquisition. The provision at 52.212-2 Evaluation--Commercial Items
(Oct 1995) does not apply to this acquisition. Instead, the following
information will be used for evaluation of offerors: an award shall be
made to that responsible offeror submitting an offer for a 5-user
Tornado VxWorks RTOS brand name mandatory items and offering the lowest
evaluated price. The offeror shall provide backup information verifying
the price offered; e.g. a copy of current catalog, three invoices for
the same equipment, etc. A written notice of award or acceptance of an
offer, mailed or otherwise furnished to the successful offeror within
the time for acceptance specified in the offer, shall result in a
binding contract without further action by either party. Before the
offeror's specified expiration time, the Government may accept an offer
(or part of an offer), whether or not there are negotiations after its
receipt, unless a written notice of withdrawal is received before
award. As prescribed in 12.301(b)(4), CONTRACT TERMS AND CONDITIONS
REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS

Applicable to Defense Acquisitions of Commercial Items. As prescribed
in 212.301(f)(iv), use the following clause: CONTRACT TERMS AND
CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS
APPLICABLE TO DEFENSE ACQUISITIONS OF COMMERCIAL ITEMS (NOV 1995) The
Contractor agrees to comply with the Defense Federal Acquisition
Regulation Supplement (DFARS) clause 252.247-7023, Transportation of
Supplies by Sea, which is included in this contract by reference to
implement 10 U.S.C. 2631. 2.212-1 12.301(b)(4); Supplement (DFARS)
provision 252.212-7000, Offeror Representations and
Certifications-Commercial Items (NOV 1995), is incorporated by
reference. Any contract awarded as a result of this solicitation will
be a DO rated order. Warranty -- The contractor shall extend to the
Government full coverage of any standard commercial warranty normally
offered in a similar commercial sale. Acceptance of the warranty does
not waive the Government's rights under the Inspection Clause, nor does
it limit the Government's rights with regard to the other terms and
conditions of the contract. In the event of a conflict, the terms and
conditions of the contract shall take precedence over the warranty. The
warranty period shall begin upon final acceptance of the items listed
