The Bureau of Alcohol, Tobacco and Firearms intends to issue a Request for Proposal (BATF 96-20) on a sole source basis to Novell, Inc. This action is being done under the statutory authority of the Federal Acquisition Regulation (FAR), 41 USC 253(c)(1)-Only One Responsible Source. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 90-39. This acquisition will be for the purchase of a Novell Master Licensing Agreement for 3.x-4.x netware (Qty 2,366), 3.x, 4.x,4.1 maintenance (Qty 3,366), LWP for Windows Maintenance (Qty 315), SSA Maintenance (Qty 320) and FLEX IP Maintenance (Qty 31). Offerors are advised to include a completed copy of the provisions at 52.212-3, Offeror Representation and Certification - Commercial Items, with their offer. The following provisions shall be included in this solicitation: 52.212-1, Instructions to Offerors - Commercial Items. The contract will be firm fixed price. Responses are to reference BATF 96-20 and be addressed to Charles Logan at the above address. The response shall be sufficient to permit agency analysis to establish capability to meet these requirements at a price lower that which we can obtain from Novell. If no affirmative responses are received, the government will proceed with negotiations with Novell, Inc. Numbered Note 22 applies to this synopsis.
