This is a combined synopsis/solicitation for a commercial item prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, a written solicitation will not be issued. Refer to solicitation as RFP N00140-96-R-3621. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 90-32. The quantities below are estimated quantities. Base year 01 Oct 1996, or date of award whichever is later, through 30 Sep 1997, ITEM 0001: 576 EA of Unit Dose Cardiolite for Cardiac Imaging (TC-99) SESTAMIBI, ITEM 0002: 76 EA of Unit Dose Galium (GA-G7) MCI, ITEM 0003: 12 EA of Unit Dose Iodine - 131, ITEM 0004: 1 LOT, NOT TO EXCEED $300.00 for Delivery Charges as needed only for Saturday/Sunday/Holidays/ and Emergency Deliveries for orders placed after business hours for same day delivery. Option I for the period 01 Sep 1997 through 30 Sep 1998, Item 0005: Same as Item 0001, Item 0006: Same as Item 0002, Item 00007: Same as Item 0003, Item 0008: Same as Item 0004. Option II for the period 01 Sep 1998 through 30 Sep 1999, Item 0009: Same as Item 0001, Item 0010: Same as Item 0002, Item 0011: Same as Item 0003, Item 0012: Same as Item 0004, FAR 52.212-1 is applicable. NOTE: Offeror's attention is specifically drawn to Paragraph (b) (11) of this clause. A statement complying with this paragraph must be included in the offer. FAR 52.212-4 is applicable. Addendum to FAR 52.212-4 as follows: NOTE: All Radioactive Isotopes must meet ALL Nuclear Regulatory Commission, Department of Transportation (DoT) and Food and Drug Administration (FDA) regulations prior to distribution and use. HAZARDOUS MATERIALS (JUNE 1994)(NAVSUP) (a) Hazardous materials as used in this clause means any material defined as hazardous within the applicable modal regulations governing packaging, handling, storage and transportation (including revisions adopted during the term of this contract). Such definitions include the following: Class/Division Definition 1 Explosives 2.1 Flammable Gas 2.2 Non-Flammable Compressed Gas 2.3 Gas Poisonous by Inhalation 3 Flammable Liquid (not more than 141 F flash point) 4.1 Flammable Solid 4.2 Spontaneously Combustible Material 4.3 Dangerous When Wet Material 5.1 Oxidizer 5.2 Organic Peroxides 6.1 Poisonous Materials 6.2 Infectious Materials 7 Radioactive Material 8 Corrosive Material 9 Miscellaneous Hazardous Material/Other Regulated Material (ORM) (b) Preservation, packaging and packing of hazardous materials shipped hereunder shall be in accordance with the requirements of Department of Transportation Code of Federal Regulation, Title 49, Part 100 - 199, as applicable. In the event of any discrepancy between the contract and title 49, Title 49 shall govern, unless another modal regulation is applicable (See paragraphs (e), (f) and (g) below. (c) Marking and labeling shall be in accordance with MIL-STD-129 and Title 49, as applicable. In the event of any contradiction between the two documents, Title 49 shall govern. (d) Transportation shall be in accordance with Title 49, however, hazardous material shipped via the U.S. Postal Service shall be shipped in accordance with U.S. Postal Service Publication #52. (e) Hazardous materials intended for shipment via water transportation shall be packaged, packed, marked and labeled in accordance with the International Maritime Organization International Maritime Dangerous Goods (IMDG) Code. (f) Hazardous materials intended for shipment, via commercial air, shall be packaged, packed, marked, labeled, and certified in accordance with the International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air or the International Air Transport Association (IATA) Dangerous Goods Regulations. (g) Hazardous materials intended for shipment, via military aircraft shall be packaged, packed, marked, labeled, and certified in accordance with AFJMAN 24-204 (Formerly AFR 71-4)/ TM 38-250/NAVSUP PUB 505/MCO P4030.19/DLAM 4145.3 (Preparing Hazardous Material For Military Air Shipments). (h) If the hazardous material required to be shipped under this contract is a non-regulated limited quantity as defined by applicable modal regulations, it shall be packaged to meet the requirements of Level A packaging listed in MIL-STD-2073. (i) In addition to the above, packaging (container and containment components) designs shall pass all applicable packaging performance tests in accordance with Title 49, the ICAO/IATA and IMDG, as applicable. Compressed gasses are excluded from these tests. Each packaging of acceptable design shall bear certification markings outlined in Title 49. All certificates and test reports indicating test compliance shall be available for inspection by authorized government representatives. (j) A test report and special packaging instruction shall be submitted in accordance with DD Form 1423, Contract Data Requirements List, referencing Data item Descriptions (DIDs) DI-PACK-81059 (Performance Oriented Packaging Test Report) and DI-PACK-80121 (Special Packaging Instruction). When these DIDs are referenced, only packaging materials controlled by Military or Federal Specifications may be used, unless superseded by commercial standards which have been adopted for government use. (k) A Material Safety Data Sheet, prepared in accordance with FED-STD-313, and a copy of the Hazard Warning Labels shall be forwarded to the applicable contracting activity. DURATION OF CONTRACT PERIOD (FISC DET PHILA) (OCT 1992) (a) This contract shall become effective on 01 Oct 1996 or date of award, whichever is later, and the ordering period shall continue in effect during the period ending 30 Sep 1997 unless terminated in accordance with other provisions herein. The performance period shall continue in effect during the period ending 1 month after expiration date of contract. (b) Subject to the provisions of the ''Limitation of Costs'' clause, the Contractor shall not be required to perform any work under this contract beyond the performance period set forth above unless such period is extended in writing by mutual agreement prior to the expiration date specified in the contract, provided however, and notwithstanding the provisions of Clause entitled ''Indefinite Quantity'' and ''Ordering'', that the Contracting Officer may at his election, issue Delivery Orders beyond the ordering period and require the Contractor to continue to perform work beyond the performance period set forth above until the total estimated maximum cost of the contract shall have been expended. TIME OF DELIVERY (INDEFINITE DELIVERY CONTRACTS) (FISC DET PHILA) (OCT 1992) The articles to be furnished hereunder shall be delivered within 1 Hour to 24 Hours, as specified in each Delivery Order, after the date of each order placed, except that when the needs of the Government permit, orders may provide a longer time for delivery. ORDERING (INDEFINITE DELIVERY TIME AND MATERIAL/LABOR HOUR AND COST REIMBURSEMENT CONTRACTS) (FISC DET PHILA) (OCT 1992) (a) Ordering: Supplies or services to be furnished under this contract shall be furnished at such times as ordered by the issuance of Delivery Orders on DD Form 1155 by the NAVHOSP Newport RI, personnel. All orders issued hereunder are subject to the terms and conditions of this contract. This contract shall control in the event of conflict with any Order. When mailed, a Delivery Order shall be ''issued'' for purpose of this contract at the time the Government deposits the order in the mail, or, if transmitted by other means, when physically delivered to the contractor. (b) Ordering Procedures: (1) Delivery Orders issued shall include, but not be limited to the following information: (a) date of order (b) contract and order number appropriation and accounting data (d) description of the services to be performed (e) description of end item(s) to be delivered (f) DD Form 254 (Contract Security Classification Spec), if applicable (g) DD Form 1423 (Contract Data Requirements List), if data to be delivered under the order is not listed on the DD Form 1423 included in this contract. (h) exact place of pickup and delivery (I) the inspecting and accepting codes (as applicable) (j) period of time in which the services are to be performed (k) for each applicable labor category, estimated number of labor hours required to perform the Order. (l) the estimated cost plus fixed fee or ceiling price for the order (m) list of Government furnished material and the estimated value thereof, if applicable. Oral orders may be placed hereunder only in emergency circumstances. Information described above shall be furnished to the contractor at the time of placing an oral order and shall be confirmed by issuance of a written Delivery Order on DD Form 1155 within ten (10) working days. Modifications of Delivery Orders: Delivery Orders may be modified by the Ordering Officer. Modifications to Delivery Orders shall include the information set forth in paragraph b. above, as applicable. Delivery Orders may be modified orally by the Ordering Officers in emergency circumstances. Oral modifications shall be confirmed by issuance of a written modification within two working days from the time of the oral communication modifying the order. (d) The Cost Plus Fixed FEE or Ceiling Amount: for each Delivery Order will be the ceiling price stated therein and may not be exceeded except when authorized by a modification to the Delivery Order. PLACE OF DELIVERY: DESTINATION (FISC DET PHILA) (OCT 1992) (a) The articles to be furnished hereunder shall be delivered all transportation charges paid by the contractor to: Commanding Officer, Radiation Safety Offiicer, Bldg. 1, Nuclear Medicine Dept., RM B-401A, Newport, RI. 02841-1002 NRMP License #38-68086-IINP (b) Bids submitted on a basis other than F.O.B. destination will be rejected as nonresponsive and offers may be deemed unacceptable. WRITTEN ORDERS (INDEFINITE DELIVERY CONTRACTS)(SUP 5252.216-9403) (JAN 1992) Written order (on DD Form 1155) will contain the following information consistent with the terms of the contract: (a) Date of order. (b) Contract number and order number. (c) Item number and description, quantity ordered, unit price and contract price. (d) Delivery or performance date. (e) Place of delivery or performing (including consignee). (f) Packaging, packing, and shipping instructions, if required. (g) Accounting and appropriation data. (h) Any other pertinent information. OPTION FOR INCREASED QUANTITY - SEPARATELY PRICED LINE ITEM (FAR 52.217-7) (MAR 1989) The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract expiration. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree. OPTION TO EXTEND THE TERM OF THE CONTRACT (FAR 52.217-9) (MAR 1989) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days of contract expiration provided, that the Government shall give the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option provision. The total duration of this contract, including the exercise of any options under this clause, shall not exceed 36.(months). The contract maximum quantity is the estimated total contract amount. FAR 52.223-3 Hazardous Material Identification and Material Safety Data (NOV 1991) DFARS 252.223-7001 Hazard Warning Labels (DEC 1991) FAR 52.212-5 is applicable along with the following additional FAR clauses cited in the clause: 52.203-6, 52.203-10, 52.219-8, 52.222-26, 52.222-35, 52.222-36, 52.222-37.
