Earl, (909)413-2221, FAX (909)413-2432; Contracting Officer Isabella Dunham, (909)413-2411 The requirement is for administrative effort required to authorize broadcast rights for the Armed Forces Radio and Television (AFRTS) to reproduce and distribute television programming; and provide AFRTS live transmission (feeds) or videotape copies, authorized programs and provide continuing service/lease terminal equipment and interconnection to provide AFRTS with the network affiliate information wire service in accordance with the specification contained in this notice. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be used. REPEAT - A WRITTEN SOLICITATION WILL NOT BE ISSUED. The solicitation number is MDA113-96-R-0061 is issued as a Request for Proposal (RFP). The combined synopsis/solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 90-38. The Standard Industry Code (SIC) is 7822 and the Small Business Size Standard is 21.5M. The contract is to be solicited on a sole source basis with ABC Distribution who holds the International Distribution Rights to the programs to be acquired. Number Note 22 applies. Other than full and open competition is based on only one responsible source and no other services provided by another source will satisfy agency requirements. Contract Line Item (CLIN) 0001 - BASIC YEAR: 1 October 1996 through 30 September 1997, 0002 - FIRST OPTION YEAR: 1 October 1997 through 30 September 1998, 0003 - SECOND OPTION YEAR: 1 October 1998 through 30 September 1999. Proposals shall include pricing for CLIN(S) 0001, 0002, and 0003 based upon the SCOPE OF WORK. Period of Performance is for one (1) Basic year with two (2) one year options. SCOPE OF WORK: Upon request from the Armed Forces Radio and Television Service-Broadcast Center (AFRTS-BC), the Contractor will provide, to the maximum extent possible, rights to use ABC Distribution Company television programming free of charge. The contractor shall also provide continuing service/lease of terminal equipment and interconnection to provide AFRTS with the ABC-TV network affiliate information data service. AFRTS will pay to ABC Distribution Company administrative costs associated with providing broadcast rights and live feeds/videotape copies of the television programming. TELEVISION PROGRAM UTILIZATION AND DISTRIBUTION. AFRTS may record, process and broadcast television programming distributed by the ABC Distribution Company which has been authorized by ABC Distribution Company for AFRTS use. Television programming made available to AFRTS by ABC Distribution Company will be cleared for transmission by AFRTS through standard broadcast, satellite or closed-circuit distribution systems. To ensure the security of program material distributed by satellite transmission, AFRTS utilizes the B-MAC Signal Encoding/Encryption System and plans to use MPEG-2 compression in the future. All recordings will remain in the custody and control AFRTS and will be restricted to non-commercial use on AFRTS stations and outlets authorized by the Department of Defense, which includes US Navy and Coast Guard ships equipped with closed-circuit television facilities. The use of programming materials, in whole or part, for any other purpose is prohibited. Programming provided to AFRTS stations overseas via satellite through the AFRTS-BC may be recorded for delayed telecast only as authorized by AFRTS-BC. The same security measures will apply to duplicate copies as to original videotape recordings. All copies will be erased as soon as local station operational requirements are met. The Government assures it will protect the integrity of all news, news analysis, commentary programs and special reports. No change will be made in the editorial content of programming materials used. AFRTS retains the right to delete a program in its entirety when a segment or the entire program contains material that may be offensive to a host nation. Each program will be broadcast by the Government exactly as originally telecast. Neither the audio nor video portions of any program shall be deleted or in any way edited except for the removal of commercial advertisements, or in accordance with the aforementioned. Occasional words or phrases may be deleted if required by host-nation agreements. Program credits, including copyright notices and network logos will not be deleted. AFRTS outlets may use short excerpts (up to two minutes in length) from programs in promotional announcements (promos) informing viewers of upcoming programs. The use of these excerpts will meet specific criteria provided by AFRTS- BC. At the request of ABC Distribution Company, AFRTS will promptly discontinue the use of any specified program or series of programs. Upon notice from ABC Distribution Company, AFRTS will delete any program ABC Distribution Company deems inappropriate, for whatever reason, to televise in any geographic region. SCOPE OF BROADCAST RIGHTS AND REQUIRED ACTIONS: The permission granted by the ABC Distribution Company herein with respect to each program or portions of programs is limited to such rights as ABC Distribution Company may actually have upon the date a request for permission to record and/or distribute such program is granted. The Government shall obtain all authorizations and clearances necessary to enable it to broadcast each program. Specifically, the Government will obtain all necessary union and guild clearances for its use of each program from the owners of music, literary rights and other properties included in the program. ABC Distribution Company shall make reasonable efforts to advise the Government of the persons, firms or corporations from whom the Government must obtain clearances pursuant hereto but ABC Distribution Company's failure to do so shall not relieve the Government of its obligation under the provisions of this paragraph. Programs which ABC Distribution Company is marketing in foreign countries will not be used by AFRTS in a manner which will interfere with ABC Distribution Company's commercial effort. SCOPE OF CONTRACT AND METHOD OF CHANGE AND/OR TERMINATION: This contract contains the entire understanding of the parties and cannot be changed or terminated orally. The provision at FAR 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. 52-212-2, Evaluation-Commercial Items, also applies. The evaluation criteria for this solicitation will consist of technical capability of the item offered to meet the agency need, price, and past performance. Offerors shall include a completed copy of the provision at FAR 52.212-3. Offeror Representations and Certifications-Commercial Items with the offer. Clauses at 52.212-4, Contract Terms and Conditions-Commercial Items and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition.
