Administrative Contracting Officer. USDA, Rural Development requires
contractors to provide legal services for uncontested and contested
foreclosures and bankruptcy proceedings for 502 single family
properties located in the counties of Hamilton, Suwannee, Nassau,
Duval, Bradford, Clay, St. Johns, Putnam and Flagler in the State of
Florida. To be eligible, the contractor must be licensed to practice
law in Florida and a member of the Florida Bar in good standing. The
solicitation is advertised under FAR Part 15, Negotiated Procedure,
with the requirement for technical proposals to be evaluated to
establish technically acceptable offerors who will be considered for an
award. The contract award will cover a base year and two option years
each subject to the availability of funding after 9/30/96. The contract
type will be that of a firm, fixed price per line item, indefinite
quantity, indefinite delivery. Estimated quantity is 30 cases for the
base year and 20 cases for each of the two option years. The
Government's independent estimate is between $150,000 and $250,000.

mail will be acknowledge; no telefax or telephone requests accepted!
Electronic transmission of proposals will not be accepted. Evaluation
factors and subfactors are as follows: I. Past Performance and
Experience (40 points); (a) Key personnel identified and resumes
supplied; (b) experience with foreclosures including contested ones in
Circuit Courts in Florida; (c) experience with bankruptcy defences;
(d) references to establish due diligence and experience in the
handling of an assigned case from initiation of pleadings to delivery
of property to the client; (e) past experience and performance as a
contractor for Rural Development in providing legal services for
foreclosures. MINIMUM - Experience in handling a contested foreclosures
documented as to timeline for filing and concluding the case with
supporting information as to commercial or federal governmental client.
Evaluation factor is considered greater than price. II. Understanding
the Statement of Work (25 points); (a) Considerations of the social
engineering impacts on foreclosure in Florida State Courts and how the
process of foreclosures is impacted with contested proceedings
initiated; (b) Summation of the delays and potential problems that may
arise when a servicing document is missing from a file or when a
petition for bankruptcy requires immediate response from secondary
levels within the Rural Development (c) Non-legal considerations in the
eviction of a property owner foreclosed which may adversely affect the
Rural Development standing in a community. MINIMUM - Narrative brief
of causes and effects that a successful contractor would consider in
taking action to foreclose, defend in bankruptcy court, and evict once
foreclosure completed with comment on the impact upon the legal
service where the contractor does not have access to source documents
without following procedural dictates of the client. Evaluation factor
is considered to be greater than price. III. Management Scheme (25
points); (a) Discussion of mix of technical, clerical, paralegal and
legal personnel in the performance of the Statement of Work; (b)
Annotated Outline of the process for tracking a case from receipt to
conclusion including the tracking of billable reimbursable expenditures
associated with the case. (c) Process the identify the report to COR
challenges to Federal Law arising from the case filed. (d) Examination
of the process of due diligence as it is controlled by the management
of time and resources and tracking of calendar calls and due dates.
MINIMUM Demonstrate commitment of resources and adherence to management
scheme to ensure due diligence in the completion of a foreclosure
within a 6-month period assuming that the case documentation supports
the action as to completeness when assigned by the Government.
Contemplated closing date for receipt of technical proposal is 1:00
