8-08-96: This is a combined synopsis/solicitation for commercial items
prepared in accordance with the format in FAR 12.6, as supplemented
with additional information included in this notice. This announcement
constitutes the only solicitation; bids are being requested and a
written solicitation will not be issued. This solicitation is hereby
issued as Request for Proposal 122-0090. The solicitation document and
incorporated provisions and clauses are those in effect through
Federal Acquisition Regular Circular 90-40. This procurement is being
advertised as full and open competition, under standard industrial
classification code 8999, size standard $3.5 million. Schedule: The
Contractor shall provide the Federal Correctional Institution, Boron,
CA with services of a Education/Library Aide from date of award -
9/30/97. (LINE ITEM ONE) Education/Library Aide. Please provide pricing
for the item listed above by session cost/annual cost. Period of
performance is from date of contract award - 9/30/97. Statement of
Work: Provide the services of a Education/Library Aide. The offeror
shall administer the Adult Basic Learning Examination (ABLE) for
placement of new arrivals and enrolled students in the literacy
program. He/she will score the examinations and record scores in the
Education Department records and assist with EDI and EDC data input.
Tabulate education data/other material in accordance with BOP
guidelines and policies, including maintaining and accounting for all
Education Department records, with test data, updating and assisting in
record keeping as required. Prepare and follow-up for all Education
ABLE testing activity for inmates. Inventory all ABLE tests/activity.
Submit request for testing material to the Supervisor of Education.
Provide feedback to students/maintain test record for teacher
reference. Provide effective program assisting inmates with post
secondary education, career assistance, and library pursuits. With
planning and guidance, inmates can enhance their time while in prison
and post-release success through completion of academic endeavors,
appropriate work experiences, realization of individual strengths and
interests, and re-enforcement of the work ethic. Administer
Instructional Television (ITV) midterms and final examinations.
Coordinate the Post Secondary Education/Career
Assistance/Library/Testing program. Provide assistance to inmates in
recommending appropriate academic courses, coordinate purchase/return
of books/materials with College Service provider and, under the
auspices of the Supervisory of Education, maintain an active open line
of communication between College Service Provider and the institution.
Coordinate the institution Law Library and Leisure Library programs;
responsible for the care/maintenance of all supplies, books and
typewriters in Law and Leisure Libraries, perform inventories, conduct
the semi annual/annual Library Survey. Coordinate external WASC
Program Review. Maintain perpetual files. Update, revise and devise
Literacy/ESL flow charts. Coordinate correspondence course needs and
materials in the inmate population. Additional duties include:
Coordinate data into electronic Education Data System; administer ABLE
program; compliance with policy guidelines for Adult Continuing
Education; process drops/enrollments for all classes; coordinate annual
revision of the inmate Handbook; coordinate publication of the Staff
Bulletin/Inmate Bulletin; coordinate the Post Secondary Education
program. Perform SENTRY: Call-outs for the ABLE, ITV mid-term and final
exams; Record scores for ABLE in electronic Education files; Post
Secondary Education EDI/EDC data input; Record grades for PSE in
electronic Education files; Generate rosters for Literacy, ESL and PSE.
Place of Performance: The services shall take place in the office of
the Education Department of the Federal Prison Camp, Hwy. 395, 6 miles
north of Kramer Junction, Boron, CA 93516. Work Schedule: One session
shall consist of 8-hours, 7:30 a.m. to 4:00 p.m., Monday through
Friday (excluding Federal Holidays). There shall be a total of 250
sessions required for the performance of this contract. Contractor's
Qualifications: A minimum of a High School Diploma. Contractor should
possess professional knowledge and experience in educational program;
and familiarity with library operations/services. He/she should also be
a proficient typist, be knowledgeable in English grammar, spelling and
pronunciation. The incumbent should be proficient at PageMaker,
WordPerfect 5.1 and dBASE IV applications. Possess the ability to
acquire and apply a practical knowledge/understanding of the program
policies, requirements relating to the assignment. Testing Procedures:
The Contractor will administer, score/record the scores of the ABLE
administered test to the inmates in accordance with the procedures
established in Policy Statement 5310.10, ``Minimum Standards for
Administration, Interpretation and use of Education Tests.'' Record
keeping duties will be provided in accordance with the regulations and
policies of the BOP, and Policy Statement 5300.15, ``Education,
Training and Leisure-time Program Standards.'' Test/PSE Management:
Contractor will account for all government furnished materials and
supplies. He/she is required to maintain a supply of/account for ABLE
batteries, and testing materials. Inmate Management: Any
absences/infractions of the institutional rules/regulations on the part
of inmate students will be reported to the COTR/BOP staff member.
Method of Performance: The services provided being professional in
nature will be provided in the method as considered normal in the local
community. These services, although not directly supervised, will be
reviewed by the Supervisor of Education, FCP Boron. The performance of
these services will be verified Contracting Officer Technical
Representative (COTR). All inmates record remain the property of the
Federal Bureau of Prisons. This contract is a Non-Personal Educational
Service contract; the Government reserves the right to evaluate the
quality of professional/administrative services provided, but retains
no control over the professional aspects of services rendered. This
will be a contractual arrangement not a personnel appointment; payment
is based on the provision of an end product or the accomplishment of
a specific result; results to be obtained will be entirely within the
contractor's own unsupervised determination; and the contractor will
not be subject to Government supervision. Clauses/Provisions: FAR
52.212-1, Instructions to Offerors - Commercial,'' is hereby included
by reference. The following are addenda to FAR clause 52.212-1: (1)
paragraph (c), ``Period for Acceptance of Offers,'' the amount of time
the offeror agrees to hold the prices in its offer firm is changed to
60 calendar day from date specified for receipt of offers. (2)
paragraph (e) ``Multiple Offers'', has been determined by the
Contracting Officer to be non-applicable to this solicitation and is
hereby removed in its entirety for the purpose of this requirement. 3.)
Paragraph (I) ``Availability of requirements documents cited in the
clause is deleted in its entirety as it has been determined to be not
applicable to this solicitation. Submission of Proposals: Each proposal
should address 1). Professional Qualifications, 2). Experience: In
order assist the Contracting Officer in making responsibility
determination about a prospective contract, in accordance with FAR
Subpart 9.104-1, it is required that each bidder provide information on
a reasonable number of recent and relevant contracts for same or
similar items, as well as the bidder's primary financial institution
(to include contract numbers, points of contact, telephone numbers, and
any other relevant information. 3). Technical Capabilities. The
Government intends to make a single award to an offeror whose proposal
meets the following criteria: 1). Meets the professional
qualifications of the statement of work; 2). Has experience in the area
of expertise required; 3). Is technical acceptable and 4). Price.
Offerors are advised that bids shall be evaluated and award made to the
responsible bidder whose bid is responsive to the items of the RFP and
is most advantageous to the Government. Evaluation Criteria and their
relative importance: Professional Qualification: 20%; Experience; 20%,
Technical Capabilities: $20% and Price: 40% 52.2212-3 ``Offeror

be completed and submitted with the bid. The following provisions are
hereby incorporated into this solicitation and resulting contract as an
addendum to FAR 52.212-1: 52.237-1 Site Visit. FAR Provision 52.212-3

shall be completed and submitted with the bid. Far Provision 52.233-2,
``Service of Protest'', is hereby incorporated in full text, (a)
Protests, as defined in Section 33.101 of the Federal Acquisition
Regulation, that are filed directly with an agency and copies of any
protests that are filed with the General Accounting Office (GAO) or the
General Services Administration Board of Contract Appeals (GSBCA),
shall be served on the Contracting Officer (address as follows) by
obtaining written and dated acknowledgement of receipt from: Chief,
Procurement and Property Branch, Federal Bureau of Prisons, 320 First
Street N.W., Washington D.C. 20534, (b) The copy of any protest shall
be received in the office designated above on the same day a protest is
filed with the GSBCA or within one day of filling a protest with the
GAO. In this procurement, you may not protest to the GSBCA because of
the nature of the supplies or services being procured. (Contracting
Officer shall strike the word ``not'' where the GSBCA is a correct
forum). FAR clause 52.212-4 Contract Terms and Conditions-Commercial

``Contracting Officer's Technical Representative'', is hereby
incorporated in full text, (a) Mr. Mark Davenport of the Education
Department, Federal Prison Camp, Boron is hereby designate to act as
Contracting Officer's Technical Representative (COTR) under this
contract. (b) The COTR is responsible for: receiving all deliverables;
inspecting and accepting the supplies or services provided hereunder
in accordance with the terms and conditions of this contract; providing
direction to the contractor which clarifies the contract effort, fills
in details or otherwise services to accomplish the contractual Scope
of Work; evaluating performance; and certifying all invoices/vouchers
for acceptance of the supplies or services furnished for payment prior
to forwarding the original invoices to the payment office and a
conformed copy to the Contracting Officer. (c) The COTR does not have
authority to alter the contractor's obligations under the contract,
direct changes that fall within the purview of the General Provisions
clause entitled ``Changes'', and/or modify any of the expressed terms,
conditions, specifications, or cost of the agreement. If as a result
of technical discussions it is desirable to alter/change contractual
obligations or the Scope of Work the Contracting Office shall issue
such changes in writing and signed. FAR Clause 52.212-5, ``Contract
Terms and Conditions Required to Implement Statutes or Executive
Order-Commercial Items'', hereby applies to this acquisition. In
accordance with FAR 52.212-5, the following clauses are hereby

Program - The Contractor shall be reimbursed at the prorated contract

FD-99 (Fingerprint Check); Law Enforcement Agency Checks; Vouchering
of Employers over past 5 years; Personal Qualifications Statement;
OPM-329-A (Authority of Release of Information); and a Urinalysis Test
(positive results will result in disallowance of an individual to
