modifies the synopsis of 8-8-96. This is now a combined
synopsis/solicitation for commercial items prepared in accordance with
the format in FAR Subpart 12.6, as supplemented with additional
information included in this notice. This announcement constitutes the
only solicitation; bids are being requested and a written solicitation
will not be issued. The solicitation document and incorporated
provisions and clauses are those in effect through Federal Acquisition
Regulation Circular 90-41. This procurement is being advertised as a
total small business set-aside, under standard industrial
classification code 8299, with a small business size standard of $5.0
Million. Any quotes received from large business will be considered
non-responsive, and will not be considered for award. (A) Schedule: The
Contractor shall provide services as an ESL Instructor/Test
Administrator/Test Records Keeper for inmates at the Federal Prison
Camp, P.O. Box 500, Hwy 395, 6 miles north of Kramer Junction, Boron,
California 93156 for the period from the date of award (approx
10/15/96) through 9/30/97. Please provide a price per session (session
is 8 hours in length), there will be approximately 240 sessions. The
period of performance will be from 10/15/96 or Date of Award, whichever
is later, through 9/30/97. Individual providing services on behalf of
the contractor must provide verification of the following: 1)
Baccalaureate degree; 2) knowledge and experience in ESL instruction;
3) experience in Test Administration; 3) proficient typist; 4)
knowledgeable in English grammar, spelling and punctuation; working
knowledge of WordPerfect 5.1/6.0 and PLATO applications software
programs; 5) knowledgeable of policies, rules and regulations governing
Education Testing practices. (B) Statement of Work: 1) Administer the
following test to qualifying inmated students: PreGED, GED, College
Placement, College Placement, College Make-up Exams, College
Correspondence Course Exams, Real Estate Exams, Other State Exams; 2)
Contractor will interpret and enter all test results in inmate
education records and make comments for periodic review records to
record progress or lack thereof. Contractor will enter all scores on
3x5 cards. Contractor will also keep records to include bimonthly
record audits, tabulate education data and other material in accordance
with established guidelines/policies. Maintain and account for all
Education Department records, with testing data. Update same and assist
in record keeping as required. The Contractor shall operate a system of
records, in accordance with the Privacy Act, to accomplish the Bureau
of Prison's requirements for Testing and Literacy/ESL program
participation and achievement; 3) keep current on education al
requirements and transferable courses. Assist students in defining
their educational needs and focusing on goals. Consistent with college
placement test scores, assist inmate students in selecting classes at
their appropriate ability level by interpreting results and making
recommendations; 4) keep the Education Aide and Literacy Coordinator
informed as to who needs testing and the results of such testing. Also,
keep them advised of any problems and make recommendations, in concert
with teachers, for movement of students within the Literacy and ESL
Programs; 5) perform a weekly inventory of all tests, answer sheets,
and related materials. Monitor stock and inform COTR of all acquisition
requirements; 6) work with teachers to schedule retests and to ensure
students are not overlooked and are tested when ready. Schedule tests
and encourage students. In conjunction with teachers, determine
student's weak areas and assist them with their programs to strengthen
weak areas; 7) prepare and conduct follow-up for all GED testing
activity for inmates; 8) provide feedback to students of testing
results as well as maintaining a test record file for teacher
reference. Teach Literacy for students below the fourth grade level.
Assist in coordination and presentation of Computer Assisted
Instruction programs; 9) score placement test for students enrolling in
college courses; 10) ensure that work performed is in compliance with
BOP policies and program review guidelines; 11) complete student
progress reviews as required, provide Literacy Coordinator with
feedback on interpretation of testing after testing sessions are
requested, record dates of participation in the ESL/Literacy program in
SENTRY transaction book to the Literacy Coordinator. Program Record and
Literacy Periodic Review Record for all limited English proficient and
GED need inmates in the institution, and ensure that initial
assessment and achievement scores on ESL and Literacy students are
recorded per policy. The ESL/Literacy instructor shall monitor the
progress of the inmates in the ESL/Literacy program until the program
is completed. These tasks should be completed in accordance with BOP
Operations Memorandums and Program Statements; 12) prepare and
follow-up on all necessary class materials and lesson plans. Provide
feedback to students in the ESL/Literacy program as well as maintaining
a record file for teacher and education team representative reference;
13) administer the practice and official General Educational
Development (GED) test, college testing, as well as a variety of other
tests as required, to qualifying inmates students; 14) tabulate
education data and other material in accordance with established
guidelines and policies; 15) prepare and conduct follow-up for all GED
testing activity for inmates; 16) order and inventory all GED tests;
17) provide feedback to students as well as maintaining a test record
file for teacher reference; 18) apply a practical knowledge and
understanding of the program policies, and other requirements relating
to the assignment; 19) coordinate and operate the ESL program; 20)
provide individual instruction to Spanish speaking inmates whose verbal
and written command of the English language is below the 225 grade
level as measured by the CASAS; 21) grade and record all ESL work
assignments; 22) develop a curriculum that will enable each ESL student
to achieve a minimum of 225 grade level in reading, writing, and
language skills as measured by the CASAS; 23) maintain, inventory, and
take care of all issued equipment and supplies for the ESL program;
24) with the assistance of the Literacy Coordinator, identify what
books and materials need to be ordered to maintain the ESL program; 25)
maintain records on each student enrolled in the ESL on a monthly
basis. Correctional experience is desired but not mandatory. (I) Place
of Performance: The place of performance will be the Federal Prison
Camp, located at Hwy 395, 6 miles north of Kramer Junction, Boron, CA
93516. (ii) Schedule: Services to be provided every Monday, Tuesday,
Wednesday, Thursday and Friday (excluding federal holidays). Session
will be from 7:30AM to 4:00PM (which includes a 30-minute lunch break).
(iii) Supplies: All supplies that the contractor may routinely need for
services at the institution will be provided by the Education
Department. These supplies normally include testing materials, etc.
(iv) Method of Performance: The service provided, being professional in
nature will be provided in the method as considered normal in the local
community. These services, although not directly supervised, will be
reviewed by a physician on staff of the Education Department of the
Institution. The performance of these services will also be verified by
the designated Contracting Officer Technical Representative (COTR). All
education records remain the property of the Federal Bureau of Prisons.
This contract is a nonpersonal services contract; the Government may
evaluate the quality of professional and administrative services
provided, but retains no control over the professional the professional
aspects of services rendered (e.g., professional judgments, etc); the
contractor will maintain insurance (auto, worker's compensation, etc),
in an amount which is not less than the amount normally prevailing
within the local community of Boron, California, for Dental
assistants/Hygienists. This will be a contractual arrangement and not
a personnel appointment; payment is based on the provision of an end
product or the accomplishment of a specific result; results to be
obtained will be entirely within the contractor's own unsupervised
determination; and the contractor will not be subject to Government
supervision. (C) Clauses/Provisions: (I) Far Clause 52.212-1,
``Instructions to Offerors-Commercial,'' is hereby included by
reference. The following are addenda to FAR Clause 52.212-1: (1)
Paragraph (c) ``Period of Acceptance of Offers'', the amount of time
the offeror agrees to hold the prices in its offer firm is changed to
60 calendar days from date specified for receipt of offers. (2)
Paragraphs (e) ``Multiple Offers'', and (h) ``Multiple Awards'', have
been determined by the Contracting Officer to be non-applicable to this
solicitation and are hereby removed in their entirety for the purpose
of this requirement. (3) Evaluation Factors for Award: Offerors are
advised that quotes shall be evaluated without discussions. Award will
be made to the responsible offeror whose quote is responsive to the
items of the RFQ and is most advantageous to the government,
considering only price and price-related factors, if any, as specified
in the RFQ. (4) Business References: In order to assist the
Contracting Officer in making a responsibility determination about a
prospective contractor, in accordance with FAR Subpart 9.104-1, it is
required that each offeror provide information on a reasonable number
of recent and relevant contracts for the same or similar items, as well
as the offeror's primary financial institution (to include contract
numbers, points of contact, telephone numbers, and any other relevant
information). The following are addenda to FAR Clause 52.212-4: (1) The
following FAR Clauses are hereby incorporated by reference, pursuant to
FAR Clause 52.252-2, ``Clauses Incorporated by Reference'': 52.219-6,
``Notice of Total Small business Set-Aside'', 52.224-1, ``Privacy Act
Notification''; 52.224-2, ``Privacy Act`; 52.225-11, 52.225-11,
``Restrictions on Certain Foreign Purchases''; 52.232-18,
``Availability of Funds''; 52.237-2, ``Protection of Government
Buildings, Equipment, and vegetation''; 52.237-3, ``Continuity of
Services''. JAR Clause 2852.279-70, ``Contracting Officer's Technical
Representative`, is hereby incorporated in full text, (a) Mr. Mark
Davenport, of the Education Department, Federal Prison Camp, Boron,
California, is hereby designated to act as Contracting Officer's
Technical Representative (COTR) under this contract. (b) The COTR is
responsible for: receiving all deliverables; inspecting and accepting
the supplies or services provided hereunder in accordance with the
terms and conditions of this contract; providing direction to the
contractor which clarifies the contract effort, fills in details or
otherwise serves to accomplish the contractual Scope of Work;
evaluating performance; and certifying all invoices/vouchers for
acceptance of the supplies or services furnished for payment prior to
forwarding the original invoices to the payment office and a conformed
copy to the Contracting Officer. (C) The COTR does not have authority
to alter the contractor's obligations under the contract, direct
changes that fall within the purview of the General Provisions clause
entitled ``Changes''' and/or modify any of the expressed terms,
conditions, specifications, or cost of the agreement. If as a result of
technical discussions it is desirable to alter/change contractual
obligations or the Scope of Work, the Contracting Officer shall issue
such changes in writing and signed. (iv) Far Clause 52.212-5,
``Contract Terms and Conditions Required to Implement Statutes or
Executive Orders - Commercial Items'', hereby applies to this
acquisition. The following terms and conditions are hereby
incorporated: Security Requirements: In accordance with Program
Statement 3000.02, contract employees entering the institution will be
subject to the following investigative procedures, prior to
performance: NCIC Check(National Crime Information Center); DOJ-99
(Name Check); FD-99(Fingerprint Check); Law Enforcement Agency Checks;
Vouchering of Employers over past 5 years; Personal Qualifications
Statement; OPM-329-A(Authority for Release of Information); and a
Urinalysis Test (positive results will result in disallowance of an
individual to perform under this contract). Quotes shall be received at
