Part one of two is listed separately within this section of the CBD. SECTION E. QUANTITY AND PRICING REQUIREMENTS: The minimum for each contract year is $25,000. The maximum for all five years of the contract is $6,000,000. The period of performance is one year plus four separate optional years. 1. Client and Server EMR Software - Single machine perpetual license (to include dial-up, client/server and stand-alone options). Vendor shall propose prices for each of the five contract years based on the following ranges: 1-10 units, 11-20 units, 21-30 units, 31-40 units, 41-50 units, 51-60 units, 61-70 units, 71-80 units, 81-90 units, 91-100 units, 101+ units. The DoS reserves the right to order any number of units within each price range. 2. RDBMS - If licensed separately, a. run-time version, b. operational version. Vendor shall propose prices based on the quantity ranges identified under E.1. 3. Report Writer - If licensed separately, vendor shall propose prices based on the quantity ranges identified under E.1. 4. Appointment Scheduling Module - If licensed separately, vendor shall propose prices based on the quantity ranges identified under E.1. 5. Desirable software requirements - If licensed separately, vendor shall propose prices based on the quantity ranges identified under E.1 for each proposed desirable software requirement listed under Section B of this notice. 6. Installation and Testing - If priced separately; provide price to install and test software on one server and two clients in Washington, DC. 7. Documentation - If priced separately, provide prices for a. configuration/installation manual, b. system administrator manual, c. end-user manual, d. ER data model, e. data attribute listing for each of the five contract years. The vendor shall propose prices for the end-user manual based on the quantity ranges identified under E.1. 8. Training - If separately priced, provide prices for each of the five contract years a. to train up to three system administrators separately, b. to train end-users (price based per class/not more than 15 students per class). 9. Maintenance - If separately priced, vendor shall propose a monthly maintenance price for each of the five contract years. 10. Technical and Development Support - Under the anticipated IDIQ contract, the DoS may order technical support services up to the following total hours per labor category: computer programmer - 5,000 hours, systems analyst - 400 hours, systems instructor - 200 hours, technical writer - 400 hours. The vendor will be paid only for actual hours expended under the contract. A general description of the labor categories can be found on the DoS Internet home page. The vendor shall propose a fully burdened fixed hourly rate for each of the four labor categories for each of the five contract years. SECTION F. SOLICITATION PROVISIONS: The following provisions are applicable to this solicitation: FAR 52.212-1, Instructions to Offerors-- Commercial Items (The first three sentences of paragraph (g) are deleted and replaced with ''The Government intends to evaluate proposals and award a contract after conducting written or oral discussions with all responsible offerors whose proposals have been determined to be within the competitive range. However, each initial offer should contain the offeror's best terms from a cost or price and technical standpoint.''); FAR 52.212-2, Evaluation-Commercial Items (The following is inserted under paragraph (a), ''The source selection will be based on the proposal that delivers the Best Value to the Government based on the following listed in descending order of importance: a. technical capability of the offered product to meet the stated requirements; b. price; and c. past performance. The Government reserves the right to award to other than the lowest priced offer if justified by technical merit. Technical and past performance, when combined, are more important than price.''); FAR 52.212-3, Offeror Representations and Certifications-Commercial Items; FAR 52.215-41, Requirements For Cost Or Pricing Data Or Information Other Than Cost Or Pricing Data (The following is inserted under paragraph (a)(ii)(C), ''$5,000''); FAR 52.227-15, Representation of Limited Rights Data and Restricted Computer Software; DoSAR 652.203-71, Certification Regarding Federal Employment; DoSAR 652.219-70, Department of State Subcontracting Goals. In addition, offerors must certify: a. that they do not comply with the Arab League Boycott of the State of Israel, b. that they do not discriminate in the award of subcontracts on the basis of religion, and c. their status as a minority business enterprise. CONTRACT CLAUSES: The following clauses shall be applicable to the resultant contract: FAR 52.212-4, Contract Terms and Conditions--Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (The following FAR clauses in paragraph (b) will apply to the resultant contract - 52.203-6, 52.203-10, 52.219- 8, 52.219-9, 52.222-26, 52.222-36, 52.222-37, 52.225-9, 52.239-1 and 52.247-64); FAR 52.215-42, Requirements for Cost or Pricing Data or Information Other Than Cost or Pricing Data-Modifications (The following is inserted under paragraph (a)(ii)(C), ''$5,000''); FAR 52.216-18, Ordering (The following is inserted under paragraph (a), ''date of award through contract expiration.''; FAR 52.216-19, Order Limitations (The following is inserted under paragraph (a), ''$25,000'', under paragraph (b)(1), ''$1,000,000'', under paragraph (b)(2), ''$1,000,000'', under paragraph (b)(3), ''five calendar days'', under paragraph (d), ''five calendar days''; FAR 52.216-22, Indefinite Quantity (The following is inserted under paragraph (d), ''ninety days from contract expiration.''; FAR 52.217-9, Option to Extend the Term of the Contract (The following is inserted under paragraph (a), ''Each option period - 15 days from contract expiration'', under paragraph (c), ''five years from contract award.''; FAR 52.222-35 (Deviation); FAR 52.227-14; FAR 52.227-16; FAR 52.227-19; FAR 52.252 -2; FAR 52.252-6; DoSAR 652.203-70, Prohibition Against the Use of Federal Employees; DoSAR 652.216-70, Ordering-Indefinite Delivery Contract. The following DoS clauses are also applicable: Arab League Boycott of Israel; Section 8(a) of the Export Administration Act of 1979, As Amended; Ordering Procedures; Additional Ordering Procedures for Other Government Agencies; Year 2000 Warranty - Commercial Supply Items; Most Favorable Price - The prices contained in this contract shall be superseded by the vendor's market prices if at any time during the life of the contract, the vendor's market prices for any of the items listed in the Price Schedule are priced lower than the corresponding prices in the contract. The vendor shall notify the DoS contracting officer of any such price changes within 30 days. (text for DoS clauses are available on the Internet). SECTION H. PROPOSAL REQUIREMENTS AND EVALUATION FACTORS: 1. Technical Proposal Requirements - The technical proposal shall be structured as follows: a. TAB A - description of vendor's ability to meet all ten Mandatory Software Requirements; b. TAB B - description of vendor's ability to meet the Desirable Software Requirements; c. TAB C - description of vendor's ability to meet all the Fixed Price Technical Support Requirements; d. TAB D - description of the vendor's ability to meet all the Delivery Schedule Requirements; e. TAB E - the names and current telephone numbers of three references from organizations that are using the vendor's product in a production environment; f. one HARD copy of the user manual, training manual and ER data model for each product offered. 2. Price Proposal Requirements - The price proposal shall include: a. TAB A - firm fixed prices for each item listed under section E. Quantity & Pricing Requirements. Identify any items that are not separately priced by marking ''NSP''. Vendors shall follow the price information requirements in FAR Provision 52.215-41 (text available on Internet); b. TAB B - a completed copy of Section F - Solicitation Provisions (text available on Internet). SIC code is 7372, size standard is $18.0M; c. TAB C - a subcontracting plan (follow instructions in DoSAR 652.219-70 and FAR 52.219-9), unless vendor is a small business; d. TAB D - a statement specifying the extent of agreement with all solicitation terms, conditions, and provisions; e. TAB E - vendor's terms and conditions; f. TAB F - acknowledge acceptance of any solicitation amendments. 3. Technical Evaluation - a. The Mandatory Software and Maintenance Requirements will be evaluated on a pass/fail basis. Any offeror who does not meet all eleven of these requirements will be eliminated from the competition and will receive no further consideration; b. Offerors who do meet all the Mandatory Software and Maintenance Requirements will then be evaluated on their ability to meet the Desirable Software Requirements, results of the client reference check and product testing. Offerors shall be required to conduct an 1-day comprehensive technical product demonstration at a vendor-supplied site in the Washington metropolitan area, using vendor-supplied equipment and DoS supplied test data, at no cost to the government. Although the Desirable Software Requirements are not mandatory, offerors will be evaluated on their ability to meet these requirements. The Desirable Software Requirements are listed in descending order of importance with requirements 1 through 3 being equal, requirements 4 through 5 being equal, requirements 6 through 9 being equal, requirements 10 through 11 being equal, and requirements 12 through 16 being equal in importance. 4. Non-government Evaluators -Industry expert consultants may participate in evaluating the technical proposal and the product demonstration; however, they will not participate as voting members in the source selection determination. 5. Price Evaluation - A price analysis will be conducted on the vendor's price proposal. For evaluation purposes only, the DoS will apply the vendor's proposed costs to a pricing scenario based on an estimate of usage over the 5 year contract life. DoS will add the total price for all optional items to the total price of the basic requirements. 6. Proposal Delivery and Receipt - Proposals may be mailed to the address listed in the title of this CBD notice. Handcarried or express mailed proposals shall be delivered to DoS, Information Systems Acquisition Branch, Room 528, 1700 N. Lynn St., Arlington, VA 22209. Ten copies of the technical proposal, one set of documentation, and two copies of the price proposal for each product offered shall be received in Room 528 by 3:00 p.m. Eastern Time on 10/21/96.
