The Electronic Combat Development System Office (ASC/LN) issued a CBD announcement on 12 Aug 96 which anticipated releasing a Request for Proposal (RFP), No. F33657-96-R-0001 (formerly RFP F33567-94-R-0040), for the AN/ALE-47(V) Countermeasures Dispenser System (CMDS) Production Lots IV - VII contract, on 30 Aug 96 using an acquisition strategy of Full and Open Competition. However, as a result of a protest filed with the General Accounting Office (GAO) on 21 Aug 96, the RFP issuance was delayed. The protest concerned the decision of the Department of the Air Force ''to withdraw the procurement of the AN/ALE-47(V) Countermeasures Dispenser System (CMDS), Production Lots IV-VII, as a total small business set-aside.'' The protest is in the process of being dismissed by the GAO. Language was passed on 30 Sep 96 in the FY97 DoD Appropriations Act (Sec 8107) stating the following: ''Notwithstanding any other provision of law, the Air Force shall not introduce any new supplier for the remaining production units for the AN/ALE-47 Countermeasures Dispenser System without conducting a full and open competition that will include, but not be limited to, small businesses.''. As a result, the revised projected RFP release date has been set for on or about 17 Oct 96 with responses due 20 Nov 96. Refer to the 12 Aug 96 CBD announcement for additional details about the procurement. The respondents to thate 12 Aug 96 CBD announcement will be mailed the RFP. Offerors who failed to respond to the 12 Aug 96 CBD announcement, but still wish to obtain a copy of the solicitation,, may submit your requests (the request must also include a copy of DD Form 2345, Military Critical Technical Data Agreement) to ASC/LNWQ either by mail at ASC/LNWQ Bldg 28, 2145 Monahan Way, Wright-Patterson AFB OH 45433-7017, or by facsimile machine via FAX number (937) 656-4598. The request must also include a copy of DD Form 2345, Military Critical Technical Data Agreement. No telephone requests will be accepted. Requests must be received by ASC/LNWQ by 115 Oct 96, in order for solicitations to be mailed on or about 17 Oct 96. Requests received after 115 Oct 96, will be processed as quickly as possible, but the due date for proposals WILL NOT be extended. Information on the rules and procedures for potential offeror use of the AN/ALE-47(V) Technical Library will be published on the PIXS and should be reviewed prior to contacting Mr. Kerr. The AN/ALE-47(V) Technical Library will remain open from the date of RFP issuance until the date proposals are due. This acquisition involves technology that has a military or space application. Only U.S. contractors who are registered and certified with the Defense Logistics Services Center (DLSC), Federal Center, Battle Creek MI 49017-3084 (1-800-352-3572), and have a legitimate business purpose may participate in this solicitation. If you are registered and certified with DLSC, you must submit a copy of the approved DD Form 2345, Military Critical Technical Data Agreement, with your request for the solicitation. Only potential offerors that have a copy of the approved DD Form 2345, Military Critical Technical Data Agreement, on file with ASC/LNWQ will be mailed the solicitation and allowed access to the AN/ALE-47 Technical Library. The solicitation package will be mailed to the data custodian identified in Block 3 of the DD Form 2345. This solicitation is NOT OPEN TO FOREIGN PARTICIPANTS AS A PRIME. Foreign-owned U.S. companies are not considered foreign companies. Release of classified technical data to foreign-owned U.S. companies and their receipt of any classified information is dependent on the type of facility security clearance under which the company is operating. An Ombudsman has been appointed to hear concerns from offerors or potential offerors during the proposal development phase of this acquisition. The purpose of the Ombudsman is not to diminish the authority of the program director or contracting officer, but to communicate contractor concerns, issues, disagreements, and recommendations to the appropriate government personnel. When requested, the Ombudsman will maintain strict confidentiality as to the source of the concern.
