pharmaceuticals and disposal of non-returnable pharmaceuticals. The
contractor shall rely upon its own understanding of the return policies
of the various pharmaceutical manyfacturers. The contractor is
responsible for the disposal of all expired pharmaceuticals, which are
not returnable to the pharmaceutical manufacturer. The contractor
shall sort, index, box, and ship at the contractor's expense all
non-returnable expired pharmaceuticals for appropriate
environmentaldisposal. The disposal of all non-returnable
pharmaceuticals shall be accomplishedin complete accordance with all
local, state, and federal laws and regulations, including, but not
limited to those promulgated by the Environmental Protection Agency
(EPA) and the Drug Enforcement Administration (DEA). Title to the
expired pharmaceuticals shall pass to the contractor prior to shipment.
Accordingly, the Government shall be relieved of all liability
resulting from the unlawful or inappropriate disposal of the expired
pharmaceuticals. These services shall be done at no additional cost to
the Government. All responsible sources may submit an offer which will
