The Food and Drug Administration intends to award up to 10 sole source contracts to state agencies, subject to availability of funds, for investigations of tobacco retailers to determine compliance with the Food, Drug & Cosmetic Act, 21 CFR Part 801, "Regulations Restricting the Sale and Distribution of Cigarettes and Smokeless Tobacco to Protect Children and Adolescents", and 21 CFR Part 897, "Cigarettes and Smokeless Tobacco". State agencies must have the authority and capability necessary to gain access to private commercial establishments in order to conduct regulatory investigations. See Note 22. (0024)
