99 -- EVANS WEST FENCE SUPPLIES SOL 97-113 DUE 021497 POC Contract Clerk (541) 383-5543 or FAX 541-383-5544 SUPPLY AND DELIVERY OF FENCING MATERIAL, SOL RFQ 97-113, DUE 02/14/97. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Part 12, Subpart 12.6, as supplemented with solicitation will not be issued. This is a Request for Quotations (RFQ) number RFQ 97-113. This solicitation document will incorporate provisions and clauses that are in effect through Federal Acquisition Circular 90-42. The standard industrial classification codes are 2491 and 3446 and the small business size standard is 500 employees or less. The requirement is for delivery and supply of the following items: 1) WOVEN WIRE FIELD FENCE -- Specifications: Design No. 1047-6-12 1/2, 330' roll length, 10 horizontal wires, 47" height, 6" between vertical stays, 10 ga. top and bottom wires, 12.5 ga. middle wires, zinc coated with class III ASTM rating (0.80 oz. zinc/sq.ft). Quantity needed minimum 260 rolls, maximum 282 rolls. 2) POULTRY NETTING -- Specifications: 150' roll length, 36" roll height, 20 ga., 1" mesh. Quantity needed minimum 290 rolls, maximum 310 rolls. 3) STEEL FENCE POSTS ("T" POSTS) W/ CLIPS -- Specifications: 10' length, heavy duty (1.33 lbs./ft), painted, 10 clips included. Quantity needed minimum 1330 posts, maximum 1500 posts. 4) WOOD FENCE-BRACE POSTS -- Specifications: 5" -- 6" diameter, 12' length, pressure treated lodgepole pine. Quantity needed minimum 140 posts, maximum 270 posts. 5) WOODEN FENCE-LINE POSTS -- Specifications: 3" -- 4" diameter, 12' length, pressure treated lodgepole pine. Quantity needed minimum 355 posts, maximum 450 posts. 6) WOOD FENCE-BRACE POSTS -- Specifications: 3" -- 4" diameter, 12' length, untreated lodgepole pine. Quantity needed minimum 100 posts, maximum 212 posts. NOTE: OFFERORS MAY QUOTE ON ONE OR MORE OF THE ABOVE ITEMS. Performance period: February 28 through March 28, 1997. All above items shall be delivered F.O.B. destination to the following address: Deschutes Bend Pine Nursery, 63095 Deschutes Market Road, Bend, OR 97701. This is an INDEFINITE QUANTITIES CONTRACT and the following provisions apply: ORDERING (FAR 52.216-18) (APR 1984). (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders by the individuals or activities designated in the Schedule. Such orders may be issued from 02/28/97 through 03/28/97. (b) All delivery orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order and this contract, the contract shall control. (c) If mailed, a delivery order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally or by written telecommunications only if authorized in the Schedule. DELIVERY-ORDER LIMITATIONS (FAR 52.216-19) (APR 1984). (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than (see minimum quantities listed in each item [1-6]), the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor -- (1) Any order for a single item in excess of (see maximum quantities listed in each item [1-6]); (2) Any order for a combination of items in excess of 1950 quantity; (3) A series of orders from the same ordering office within five (5) days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitation in paragraph (b) above. (d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within two (2) days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. MINIMUM AND MAXIMUM CONTRACT AMOUNTS (AGAR 452.216-73) (FEB 1988). During the period specified in FAR clause 52.216-18, ORDERING, the Government shall place orders totaling a minimum of (see Items 1-6), but not in excess of (see Items 1-6). INDEFINITE QUANTITY (FAR 52.216-22) (APR 1984). (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Delivery-Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after March 28, 1997. The following clauses/provisions apply to this acquisition and are hereby incorporated by reference: (1) FAR 52.212-1, "Instructions to offerors-Commercial"; (2) FAR 52.212-3, "Offeror Representations and Certifications-Commercial Items", (3) FAR 52.212-4, "Contract Terms and Conditions-Commercial Items"; (4) FAR 52.212-5, "Contract Terms and Conditions" required to Implement Statutes or Executive Orders-Commercial Items; to include the following additional FAR clauses: 52.219-8, 52.222-26, 52.222-35, 52.222-36, 52.222-37 and 52.222-41.
