Officer, Craig Segall (202) 927-8689. The Bureau of Alcohol, Tobacco
and Firearms (BATF) intends to negotiate with Dr. Irwin Goldstein, Dean
of the Department of Behavioral Sciences at the University of Maryland
for services necessary to provide assistance to the BATF in carrying
out its obligations pursuant to the settlement agreement entered into
by the parties in the class action lawsuit, Civil Action No.
90-2841-RCL. In an order dated November 21, 1996, the District Court
for the District of Columbia approved the agreement entered into by the
parties, thus obligating the Government to comply with the terms of the
agreement. Dr. Goldstein will assist the agency in writing a work
statement to be used in connection with procurement of a new promotion
assessment system. Dr. Goldstein will serve as a technical advisor to
the panel reviewing the proposals received by the BATF and finally,
will serve as a member of a monitoring committee to oversee
implementation of the new promotion assessment system. Because the
agreement specifies that these tasks are to be performed by Dr.
Goldstein and the agreement has been approved by the court, the agency
has no discretion in this area; that is, the only source who can
satisfy the needs of the agency and perform the tasks summarized above
and detailed in the agreement is Dr. Goldstein. Therefore, as only one
source can satisfy the needs of the agency. See Numbered Note 22.
