The Naval Surface Warfare Center, Dahlgren Division, Coastal Systems Station, Panama City, Florida, intends to award a sole source contract to Dukane Corporation, Seacom Division, for purchase of 150 Dukane DK 187/3 Underwater Acoustic Beacons with multiple delay settings. The DK 187/3 is a commercial off-the-shelf item within the definition of FAR Part 12. This is a one-time purchase to support a fleet exercise scheduled for August, 1997 using the Versatile Exercise Mine (VEMS). This acquisition is not suitable for full and open competition for the following reasons: Dukane is the only known manufacturer of underwater acoustic beacons which 1) uses a single lithium cell battery meeting the requirements of NAVSEA S9310-AQ-SAF-010 (Batteries, Navy Lithium Safety Program Responsibilities and Procedures, dated 20 Jul 1988) commercially available at this time; 2) meets the requirements of Federal Aviation Agency (FAA) TSO C121, and; 3) incorporates a commercially and currently available delay circuit design. Therefore, Dukane is the only supplier that can provide the required beacons within the time frame required to support the scheduled exercise. Note 22 applies. (0085)
