synopsis/solicitation for commercial items prepared I/a/w the format
prescribed in Subpart 12.6 of the FAR, as supplemented with add'l info
included in this notice. This announcement constitutes the
solicitation for the required items. Proposals are hereby requested
under RFP N00140-97-R-2012; a subsequent solicitation document will not
be issued. FISC Det Phila intends to purchase, on a full and open
competitive basis, LODGING AND MESS SERVICES FOR 32 STUDENTS IN
NEWPORT, RI. Award of a firm fixed price contract is contemplated. The
Govt's obligation is contingent upon Congress enacting FY98
appropriations. The standard industrial classification code is 7011.
0001: RENTAL OF 32 HOTEL ROOMS for 29 days -- for period 3 Oct 97 thru
31 Oct 97 (check out on 1 Nov 97); 0002: MAIN CONFERENCE ROOM for 26
days -- for period 6 Oct 97 thru 31 Oct 97; 0003: 3 BREAKOUT ROOMS for
26 days -- for period 6 Oct 97 thru 31 Oct 97; 0004: 3 MEALS A DAY FOR
32 PEOPLE -- for period 6 Oct 97 thru 31 Oct 97; 0004AA -- 32
Breakfasts each day* (704 meals); 0004AB -- 32 Lunches each day* (704
meals); 0004AC -- 32 Dinners each day* (640 meals); [*see D. MEALS,
subpara. 5 below]; 0005: THREE 12-PASSENGER VANS AND THREE DRIVERS for
6 days. A. LODGING 1) All the rooms shall be at the same hotel. The
hotel shall be within three and one-half miles of the Naval Education
and Training Command (Newport, RI) and within walking distance of
downtown Newport, Rhode Island. 2) All accommodations shall be of
first-class quality and generally within the same square footage size
for each room. Rooms must all be located adjacent to each other or in
close proximity (preferably on the same corridor or in the same wing on
successive floors). Naval Justice School staff will inspect the rooms
and facilities prior to acceptance on 3 October 1997. 3) Check-out time
for CLIN 0001 shall not be later than 1200 Noon, on Saturday, 1
November 1997. 4) The Government reserves the unilateral right to
terminate this contract in whole or in part at NO COST to the
Government provided that the Government gives the contractor notice not
later than 11:59 P.M. on Tuesday, 30 September 1997. 5) The contractor
shall keep an exact record of all telephone calls placed in the 32
hotel rooms. The contractor shall provide local telephone service. A
LIMIT OF FIVE (5) LOCAL CALLS PER DAY PER ROOM SHALL BE CHARGED TO THIS
CONTRACT. For local calls in excess of five (5) per room, the
contractor shall invoice the occupants directly for such services. 6)
The contractor shall not provide long distance telephone service, room
service or laundry/dry cleaning services under this contract. However,
the contractor may provide such services at the occupants request,
provided that the contractor invoice the occupant directly for such
services. 7) Gratuity charges for the hotel rooms shall be included in
the unit price of the hotel rooms. 8) Pursuant to FAR 29.101 and FAR
29.302, the Procurement Contracting Officer has determined that the
inclusion of state,local or "Hotel" taxes are not justified, nor are
they applicable with regards to this contract. Therefore, any and all
prices/costs listed are not to include these taxes. (See also FAR
clause 52.229-3.) B. MAIN CONFERENCE ROOM 1) This room shall serve as
the main classroom. It shall be of sufficient size to accommodate
thirty-eight (38) persons seated, comfortably. Chairs and conference
tables to seat thirty-eight (38) persons shall be provided. 2) The room
shall be equipped with a white board, markers, and a projection screen.
The room shall, also, be equipped with at least one telephone. The same
procedures shall apply as mentioned above with regards to local call
services provided by the contractor. 3) The room shall be available
from 7:30 A.M., Monday, 6 October 1997 through 5:00 P. M., Friday, 31
October 1997. This room shall be within five minutes walking distance
of the lodging and messing (meals) facilities, preferably in the same
building. C. BREAKOUT ROOMS 1) Each of these three rooms shall be of
sufficient size to accommodate twelve (12) persons. Chairs and
conference tables to seat twelve (12) persons shall be provided in each
room. 2) Each room shall, also, be equipped with at least one
telephone. The same procedures shall apply as mentioned above with
regards to local call services provided by the contractor. 3) The rooms
shall be available from 7:30 A.M., Monday, 6 October 1997 through 5:00
P. M., Friday, 31 October 1997. The rooms shall be within five minutes
walking distance of the lodging and messing (meals) facilities,
preferably in the same building. D. MEALS (MESSING SERVICES) 1) The
contractor shall provide three meals a day for each of the 32
delegates. These meals must accommodate a wide variety of tastes and
religious restrictions. The mess facility must be within five (5)
minutes walking distance of the lodging and classrooms. 2) The cost of
the meals will NOT include alcoholic beverages; delegates shall be
charged directly for alcoholic beverages. 3) Gratuity charges for meals
shall be included in the unit cost of the meals. 4) Upon award of the
contract, the proposed menu choices for religious restricted meals
shall be forwarded to the Technical Point of Contact, CDR Lueker, of
the Naval Justice School -- International Training Detachment for
approval/recommendations. Actual meal times will be coordinated in
advance with the Naval Justice School. 5) The NJS intends to conduct
off-site training/activities which will conflict with some meals. The
estimated number of meals to be affected is 6 dinners, 4 lunches, and
4 breakfasts. NJS-ITD will provide 30-days notice of the exact dates,
number, and types of meals which will not be required. E. VAN SERVICE
1) Three 12-passenger vans plus drivers shall be provided, with one
day's notice. The projected need for these van services is for two (2)
full days and four (4) evenings. The following FAR provisions and
clauses apply to this solicitation and are incorporated by reference:
FAR 52.212-1 Instructions to Offerors-Commercial Items; 52.212-2
Eval-Commercial Items: The Govt intends to make an award to the
responsible offeror whose offer conforming to the solicitation will be
most advantageous to the Government, price and other factors
considered. The following factors shall be used to evaluate offers:
price and past performance; FAR 52.212-3 Offeror Representations and
Certifications-Commercial Items; FAR 52.212-4 Contract Terms and
Conditions-Commercial Items; and FAR 52.212-5 Contract Terms and
Conditions Required To Implement Statutes Or Executive Orders:
Paragraph (a) and the following numbered subparagraphs under paragraph
(b) of this clause apply: (1), (2), (3), (6), (7), (8), (9); FAR
52.229-3 Federal, State, and Local Taxes; FAR 52.232-18 Availability of
Funds. The incorporated provisions and clauses are those in effect
through FAC 90-46. The following Defense FAR Supplement (DFAR)
provisions and clauses apply to this solicitation are incorporated by
reference: DFAR 252.212-7000 Offeror Representations and
Certifications-Commercial Items; and DFAR 252.212-7001 Contract Terms
and Conditions Required To Implement Statutes or Executive Orders
Applicable to Defense Acquisitions of Commercial Items: Paragraph (a)
and the following clauses referenced under paragraph (b) of this clause
apply: DFAR 252.225-7012 Preference for Certain Domestic Commodities,
DFAR 252.225-7028 Exclusionary Policies and Practices of Foreign
Governments, and DFAR 52.233-7000 Certification of Claims and Requests
for Adjustment or Relief; DFAR 252.219-7006 ALTERNATE I Notice of
Evaluation Preference for Small Disadvantaged Business Concerns. Past
Performance Proposal -- is to include all data and information required
for evaluation, and exclude any reference to the pricing aspects of the
offer. Each page of each copy should be affixed with the following
legend: Source Selection Information -- See FAR 3.104. In the event any
portion of the past performance proposal is written by anyone who is
not a bona fide employee of the firm submitting the proposal, a
certificate to this effect shall be furnished which shall be signed by
a responsible officer of the offeror and shall also identify the
person's name, employment capacity, the name of the person's firm, the
relationship of that firm to the offeror, and the portion of the
technical proposal the person wrote. Any offeror who will be submitting
CLASSIFIED data in their past performance proposal shall first notify
the Center by contacting the point of contact for this solicitation.
CLASSIFIED data that is forwarded as part of an offeror's proposal must
be housed in its own binder, separate from the unclassified portion.
The offeror shall describe its past performance on similar contracts it
has held within the last five (5) years which are of similar scope,
magnitude and complexity to that which is detailed in the RFP or
affirmatively state that it possesses no relevant directly related or
similar past performance. Offerors who present similar contracts should
provide a detailed explanation demonstrating the relevance of the
contracts to the requirements of the RFP. The offeror should provide
the following information regarding its past performance: A. Contract
number(s), B. Name and phone number of a point of contact at the
federal, state, local government or commercial entity for which the
contract was performed, C. Dollar value of the contract, D. Detailed
description of the work performed, E. Names of subcontractor(s) used,
if any, and a description of the extent of work performed by the
subcontractor(s), and F. The number, type and severity of any quality,
delivery or cost problems in performing the contract, the corrective
action taken and the effectiveness of the corrective action. Award will
be made to the eligible, responsible offeror whose total offer,
conforming to the solicitation, is determined most advantageous to the
Govt, price and past performance considered. The eval will consider
past performance equal in importance to price. The Govt reserves the
right to award the contract to other than the lowest priced offeror.
The Government reserves the right to obtain information for use in
theevaluation of past performance from any and all sources including
sources outside of the Government. Offerors lacking relevant past
performance history will receive a neutral rating for past performance.
However, the proposal of an offeror with no relevant past performance
history, while rated neutral for past performance, may not represent
the most advantageous proposal to the Government and thus, may be an
unsuccessful proposal when compared to the proposals of other offerors.
The offeror must provide the information requested above for the past
performance evaluation or affirmatively state that it possesses no
relevant directly related or similar past performance. The Government
will consider the quality of offerors' past performance. This
consideration is separate and distinct from the Contracting Officer's
responsibility determination. The assessment of the offeror's past
performance will be used as a means of evaluating the relative
capability of the offeror and other competitors to successfully meet
the requirements of the RFP. In determining the rating for the past
performance evaluation factor, the Government will give greater
consideration to the contracts which the Government feels are most
relevant to the RFP. As a minimum, vendors should provide this office:
a price proposal on letterhead or a SF1449 for the requested items
with unit price, extended price, past performance info, prompt payment
terms, remittance address, and include a completed copy of the
provisions at FAR 52.212-3 and DFARS 252.212.7000 with their offer .
