51 -- TOOLS, TOOL SETS, TOOL KITS, INDUSTRIAL QUALITY; HAND PRECISION MEASURING SOL 6FEPB-CO-BB-95NADPB-N-1 DUE 061097 POC Jay Willingham/816-823-1285; Julieann Vermeire/816-926-7345; Claire Allman/816-926-7687; Sandra Grant/816-926-7678 This is a special open season to facilitate the conversion from Standardization and Control of Industrial Quality Tools (scit) contracts, to Multiple Award Schedule (mas) contracts, and to incorporate relevant provisions of the Federal Acquisition Streamlining Act of 1994 (FASA). Any contracts resulting from this solicitation will be non-mandatory, indefinite delivery, indefinite quantity (IDIQ) contracts. The current SCIT contracts of vendors who do not wish to convert to MAS will have bilateral modifications issued to convert them to Basic Ordering Agreements. Significant changes: The Open Season Period for this solicitation was originally scheduled to begin September 1, 1997. This Solicitation will now issue on May 7, 1997 and will close on or about June 10, 1997. The Contract period will be December 17, 1997 (or date of award whichever is later) through February 28, 2001. The Tools and Appliances Commodity Center intends to incorporate an option to extend the term of the contract, clauseI-FSS-164(b), for contracts issued under this solicitation. The option to extend will allow contracts issued under the above solicitation to be extended for one five year option period, with annual open seasons. The contracting officer may exercise the option by providing a written notice to the contractor ten (10) months before the expiration of the contract, which is 02-28-2001. Incorporation of this option would allow for one five year optional period which would extend contracts under this solicitation through 02-28-2006. Clause 552.238-77, Industrial Funding Fee (04-95) will apply. This clause requires vendors to submit an amount equal to 1% of total sales reported on GSA form 72a. This will be paid to FSS, GSA, at the end of each contract quarter. Clause I-FSS-125, Orders Exceeding the Maximum Order (MO) (August 1995) will apply. This clause provides instructions for placing orders over the maximum order as defined in the Delivery Order Limitation clause (52.216-19). To assist the customer agencies to determine when they should seek a price decrease. A level called the maximum order will be established under each contract. When an agency order exceeds the established MO amount, it is recommended that the agency contact the vendor for a reduced price. The vendor will not be obligated to accept these orders in accordance with FAR 52.216-19. Pursuant to clause I-FSS-599, Electronic Commerce -- FACNET (09-95), contractors will now be required to submit electronic contract data in a prescribed format. This information will be loaded into the GSA Advantage database thereby enabling agencies to review schedule information and place orders electronically. New Technology Special Item Number: the solicitation is further amended to incorporate the "New Technologies Special Item Number (SIN) 612-171. This special item number will be an open continuous (evergreen) SIN. Offers may be submitted at any time. This requirement will be synopsized annually. The definition of the New Technologies SIN is a newproduct or an upgraded product (as to be virtually a new product) made available to the commercial government marketplace. This product must meet the special provisions as outlined below. Offers for New Technology items will be considered only under the following conditions: (a) The offeror must demonstrate that the product meets at least one of the following three conditions which provide a product that is not otherwise available to the government. (1) Performs a new task or procedure not currently available under any gsa contract; (2) Performs an old task or procedure in a new way which technically exceeds current products; and (3) Improves an existing product so significantly that government customers will be negatively impacted if the item is not added to the schedule. (b) The product must be classifiable in a federal supply class identified in the federal supply schedule. (c) As determined by the government, there are no similar items currently available under an existing sin or pending competitive acquisition. (d) The product could be included in an existing sin or has the potential for inclusion within the schedule with a new sin. Offerors must understand that there is no implied guarantee that the product offered will be recognized and accepted as new technology. All items will be reviewed for acceptance by the government's technical experts. The New Technologies SIN is intended for the temporary placement of products on the schedule until the item can be formally placed under an existing or newly created sin on the schedule. After a new special item number (SIN) is established for a contractor's product, that contractor must submit a contract modification request to transfer the item(s) to the newly established SIN (or an existing SIN) within one (1) year from the date of initial award or within thirty (30) days of being requested to do so by the contracting officer. If the offeror/contractor fails to request the transfer within the required timeframe the product(s) will be deleted from the contract. It is the responsibility of the contractor to be aware of the open season/basic solicitation issuance. New sins established for new technology items must meet established sales criteria or the sin will be canceled.
