Waterman (520) 629-4610 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Government intends to enter a sole source agreement with Sofamor Danek Group Inc., 1800 Pyramid Place, Memphis, TN 38132 for Orion Anterior Cervical Plate System Implants (titanium) and Instruments; TSRH CROSS LINK System Implants (titanium) and Instruments; TSRH Spinal System Implants (stainless steel and titanium) and Instruments; External Spinal Stimulators, TIMESH Cranial Plating System Implants (titanium) and Instruments; ZPLATE-ATL Anterior Fixation System Implants (titanium) and Instruments; and ZPLATE THORACIC Anterior Fixation System Implants (titanium) and Instruments. Solicitation #678-29-97 is issued as a request for proposal (RFP). The contract is for base year and four option years. Required delivery schedule is 30 days from date of contract award. Items will be delivered to VAMC Tucson, 3601 S. 6th Avenue, Tucson, AZ 85723. Provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition and any addenda to the provision. The following factors will be used to evaluate offers: a) technical capability of the item offered to meet the Government requirement; and b) price. A completed copy of the provision 52.212-3; Offeror Representations and Certifications -- Commercial Items are to be included in your submission. Clause 52.212-4, Contract Terms and Conditions -- Commercial Items applies to thos acquisition along with any addenda to the clause. Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items, applies to this acquisition in addition to the following FAR clauses a) 52.203-10, Price or Fee Adjustment for Illegal or Improper; b) 52.225-3, Buy American Act -- Supplies; and c) 52.232-8,Discounts for Prompt Payment. The Government reserves the right to use a Purchase Card to pay for items acquired from this solicitation.
