Quantity contract for legal services related to tort actions:
specifically to develop and represent the litigation position of
managers of HUD-acquired projects as defendants in actions in which the
plaintiffs are seeking damages for injuries and/or death before the
State or Federal Courts in Massachusetts. The offeror's technical
proposal shall address the following requirements. Items are listed in
order of relative importance. A. Approach (25 points) A description of
the offeror's approach to providing the specified services, including:
1. Ability of the offeror to allocate staff resources within five (5)
days after receipt of Delivery Order to commence pre-trial work on
each of the cases assigned. 2. Identity of staff members (attach
resume) the offeror anticipates assigning to each of the following
phases of each case: a. pre-trial preparation. b. conduct of trial. c.
appeal, if needed. 3. Relative allocation to the staff member managing
the case during the phase. B. Experience (100 points) Specific samples
of these factors must be provided with respect to each attorney to be
assigned this contract. 1. Specific experience in defending tort
actions, particularly wrongful death and/or injuries arising from fires
on real property. State outcome of cases. Provide citations of cases
where appropriate (30 points). 2. Specific experience with
Massachusetts and Federal Tort law relating to the ownership and
management of real property. Provide number and description of
representative cases involving State and Federal tort issues, including
outcome. Provide citations of cases where appropriate (30 points). 3.
Specific experience in the Federal Courts, including number and
description of representative cases, providing outcome as well as
citation as appropriate (20 points). 4. Length of practice. Law school
of graduation. Additional Degrees, if appropriate (10 points). 5. Date
when admitted to Massachusetts Bar and U.S. District Court,
Commonwealth of Massachusetts (10 points). Contract is for a period of
one year from date of award with option to extend the term of the
contract for two (2) 12 month periods. Total duration of the contract
not to exceed thirty-six (36) months. Delivery orders will be issued
for each specific case. The Standard Industrial Code (SIC) for this
procurement is 8111. The RFP will be available on or about 15 days from
the date of this notice and proposals will be due 30 days from date of
