INTERNAL AFFAIRS LAYING DOWN THE CONDITIONS AND PROCEDURE FOR THE
APPROVAL OF VOTING MACHINES (APPROVAL REGULATION FOR VOTING MACHINES)
The following notification is being circulated in accordance with
Article 10.6. G/TBT/Notif.97.172. 1. Member to Agreement notifying:
NETHERLANDS. If applicable, name of local government involved (Articles
3.2 and 7.2). 2. Agency responsible: Ministry for Internal Affairs.
Agency or authority designated to handle comments regarding the
notification can be indicated if different from above: National Enquiry
Point. 3. Notified under Article 2.9.2. 4. Products covered (HS or CCCN
where applicable, otherwise national tariff heading. ICS numbers may be
provided in addition, where applicable): Voting machines for use in the
election of general representative bodies. 5. Title, number of pages
and language(s) of the notified document: Annex to the Draft Regulation
of the State Secretary for Internal Affairs Laying Down the Conditions
and Procedure for the Approval of Voting Machines (Approval Regulation
for Voting Machines). 6. Description of content: In the Netherlands,
only those voting machines can be used for voting at elections which
have been approved by the Minister for Internal Affairs. For the
purpose of this approval, conditions for voting machines should be laid
down. The Annex to the draft Regulation of the State Secretary for
Internal Affairs laying down the conditions and procedure includes
functional conditions for voting machines in this respect. The draft
Regulation makes provisions in a procedure for the approval of voting
machines. The functional conditions contain i.e. conditions on
user-friendliness, reliability, safety and confidentiality. No
provisions are made governing the way in which these conditions must be
complied with from a technical point of view. This is therefore left up
to the manufacturer. 7. Objective and rationale: Previously published
conditions are not currently applied in the Netherlands for the
approval of voting machines. The draft Regulation extends to changing
this. 8. Relevant documents: The draft Regulation is based on Article
J 33, para. 1, of the Elections Act (Annex 2) and Article J 14 of the
Elections Order. 9. Proposed date of adoption: 15 June 1997; Proposed
date of entry into force: 15 June 1997. 10. Final date for comments: 12
