COMMERCE BUSINESS DAILY ISSUE OF MAY 14,1997 PSA#1845CZECH REPUBLIC: DRAFT GOVERNMENTAL ORDER LAYING DOWN THE TECHNICAL
REQUIREMENTS FOR THE SPECIFIED PRODUCTS The following notification is
being circulated in accordance with Article 10.6. G/TBT/Notif.97.186.
1. Member to Agreement notifying: CZECH REPUBLIC. If applicable, name
of local government involved (Articles 3.2 and 7.2). 2. Agency
responsible: Czech Office for Standards, Metrology and Testing (COSMT).
Agency or authority designated to handle comments regarding the
notification can be indicated if different from above. 3. Notified
under Article 5.6.2. 4. Products covered (HS or CCCN where applicable,
otherwise national tariff heading. ICS numbers may be provided in
addition, where applicable): Various products from the whole range of
HS Chapters. 5. Title, number of pages and language(s) of the notified
document: Draft Governmental Order Laying Down the Technical
Requirements for the Specified Products (10 pages, in Czech). 6.
Description of content: The Order is drafted in accordance with Article
22 of Act 22/1997 Coll. on technical requirements for products (which
was notified to the WTO/TBT Member States in Notification
G/TBT/Notif.96.24). The set up obligations concern requirements for
manufacturer's declaration of conformity (Sections 1 and 2), type
examination (Section 4), and conformity assessment (Sections 5 and 6).
Annex I lists 69 groups of products about which the
manufacturer/importers submit the conformity declaration based on their
own conformity assessment. Annex II lists 28 groups of products about
which the manufacturers/importers submit the conformity declaration
based on the certificate issued by the authorized entity. These 97
groups of products fall within the category of products which: may
potentially represent higher risk of being harmful when used or applied
(such products are designated as "the specified products" according to
Article 12 of the Act 22/1997 Coll.); and are NOT covered by any of
nine other prepared Governmental Orders implementing EEC New Approach
Directives, namely those on (1) machinery safety, (2) toys safety, (3)
EMC, (4) personal protective equipment, (5) simple pressure vessels,
(6) low voltage equipment, (7) gas appliances, (8) equipment and
protective systems in the potentially explosive atmospheres, and (9)
construction products. As this draft Order is in the state of comments
from relevant authorities and interested Czech parties, the list is
being ever changed, and will be changed (shortened) in future whenever
a new Governmental Order is adopted which will implement any other New
Approach EEC product Directive. 7. Objective and rationale: . Consumer
