(DOE) is seeking a contractor to manage and operate Brookhaven National
Laboratory (BNL) in Upton, NY. BNL is a multiprogram DOE Laboratory
responsible for (i) conducting basic research, (ii) constructing,
operating, maintaining, and developing basic research facilities, (iii)
developing and testing advanced instruments, accelerators and equipment
for research applications, (iv) conducting applied research, (v)
conducting energy and environmental technology research, (vi)
establishing and maintaining community relations and public involvement
programs and (vii) environmental management activities in areas of
remediation and facility deactivation, decommissioning, and
decontamination; waste management involving storage and treatment of
waste streams; waste minimization and pollution prevention initiatives;
and environmental technology development. BNL is listed as a superfund
site and a Federal Facility Agreement has been executed between DOE,
the Environmental Protection Agency, and the New York State Department
of Environmental Conservation governing the remediation of the site.
Consistent with Secretary Pe a's announcement of the termination of the
existing BNL contract with Associated Universities, Inc. (AUI), DOE
anticipates that award of a new contract will be made in early November
1997. DOE is limiting this competition to nonprofit organizations
(including educational institutions, consortia of educational
institutions, and not-for-profit organizations) as the proposed prime
contractor. Offerors are expected to demonstrate a corporate record of
success in conducting both world class research and facility
operations including (i) managing and operating large research
facilities, including nuclear reactors, (ii) integrating diverse
scientific expertise in addressing difficult research problems, (iii)
managing and implementing comprehensive environmental, safety and
health (ES&H) programs, (iv) developing and implementingcommunity
involvement programs for both the local community and regulators
(federal, state, local) which focus on a scientific mission, as well as
ES&H, and environmental management activities, (v) managing and/or
conducting (a) remediation activities at an operating site or facility
in response to the requirements of the Comprehensive Environmental
Response, Compensation, and Liability Act; (b) decontamination and
decommissioning activities at radioactivity and chemically contaminated
facilities, and; (c) comprehensive site-wide waste management
operations in accordance with the Resource Conservation and Recovery
Act, and (vi) establishing and/or maintaining human resource systems
that support diversity and achieve high productivity from employees in
scientific research and laboratory operations. Due to the breadth of
these requirements, DOE is encouraging offerors to consider the
benefits of adding other organizations to their proposed team through
appropriate contractual arrangements, e.g., establishing a non-profit
joint venture, partnering, designated subcontractors, etc. The offeror
will also be required to propose key personnel with national standing
that will allow them to identify and promote cutting edge science and
who possess diversified, extensive management experience in assuring
safe and reliable operations of research and user facilities, including
nuclear reactors. The offeror will be required to address ES&H as an
inherent critical aspect of accomplishing the work and shall
effectively address and integrate ES&H issues and resources for all
aspects of the proposed work throughout the Laboratory, including the
science mission, facility operations, remediation activities,
decontamination and decommissioning activities (both radioactive and
chemical), and waste management activities, etc. Additionally, the
offeror must possess the vision and capacity for utilizing and
enhancing the special features of Brookhaven as a multipurpose
Laboratory to establish innovative, creative multidisciplinary research
teams to address problems not readily solved in a university setting.
Particular emphasis will be placed on the management systems utilized
to ensure the successful execution of these programs. Evaluation
criteria will emphasize the foregoing, as well as the experience of the
offeror's management personnel, e.g. offerors will be expected to
propose the Laboratory Director and other senior staff responsible for
managing significant laboratory functions. The Request for Proposals
(RFP) is expected to include several Qualification Criteria relating to
the existing Laboratory workforce. Qualification Criteria are "go/no
go" criteria which depict the minimum qualifications or commitments
that an offeror must meet. The purpose of qualification criteria is to
discourage organizations from incurring the time and expense
associated with the submission of offers when they clearly are
unqualified for selection or when they are unable to make fundamental
commitments that the Government requires. Each offeror's response to
any qualification criteria must be such as to permit the Source
Evaluation Board (SEB) to make an objective finding that the offeror
either has met or has failed to meet the criteria. For this
solicitation, DOE anticipates requiring offerors, including designated
subcontractors, to agree to several Qualification Criteria, e.g.,
requirements to: offer employment (except for key Laboratory management
personnel), consistent with Fiscal Year 1998 appropriations, either
through its own organization or designated subcontractor(s) to
virtually all other Laboratory personnel currently employed at
comparable pay and benefits; credit employees' length of service with
the current contractor; recognize the currently certified collective
bargaining agents and their existing bargaining agreements; and accept
the transfer and assume responsibility and accountability for existing
commercial and regulatory obligations. The resultant contract is
expected to be a performance-based management contract with a five-year
term and one five-year option consistent with the DOE's Contract Reform
Initiative. The initial contract term will contain an "off-ramp" after
three years whereby DOE may replace the Contractor, without DOE
incurring any termination liability, if the Contractor is not
performing in an excellent manner. The contract is expected to be
effective in early November 1997, and it is anticipated that there will
be an appropriate transition period with AUI prior to the selected
Contractor assuming full control of BNL. A Strategic Solicitation Plan
is anticipated to be issued for public comment, available on the DOE
Chicago Operations Office (CH) INTERNET Home Page at
http://www.ch.doe.gov/bnlseb, and by computer disk, by mid-June. DOE
intends to hold Strategic Solicitation Plan Workshops to solicit
comments on this document near BNL in late June. An RFP is intended to
be issued in early July with a preproposal conference near BNL in
mid-to-late July. Written proposals will be due in late August.
Offerors will be expected to provide an oral presentation in late
September with contractor selection and contract award expected in
early November, 1997. Copies of the RFP will be available on the CH
INTERNET Home Page and will also be available on computer disk and
public reading rooms at libraries near the BNL site. Copies of the
existing BNL contract with AUI will be available in early June on the
CH INTERNET Home Page and the BNL Institutional Plan is available by
