Rozier, 202-283-1296 The Internal Revenue Service (IRS) intends to negotiate with the Unisys Corporation on a sole source basis under the authority of FAR Subpart 6.302-01, to acquire software products including licenses and support/maintenance. The required software products, licenses and support/maintenance are not commercially available and the Unisys Corporation is the only available source. Refer to Note 22. This a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. This solicitation is issued as a Request for Proposals (RFP) and the solicitation number is TIRNO-97-00061. This acquisition's standard industrial classification code is 7372 and the related small business size standard is $18.0 millions. The Contractor shall provide monthly software licenses and support/maintenance for each product. All products shall be consistent/compatible with Unisys System Base (SB) level 4R8. The software shall be delivered to and installed on a Government furnished Unisys 2200/622ES mainframe complex at the IRS Tennessee Computing Center, 5333 Getwell Road, Memphis, TN, 38118. On-site support, as needed, shall also be performed at this location. Support/maintenance shall consist of the correction of errors and provision of all releases, versions, changes, modifications, improvements and updates to the software and its documentation introduced during the life of the contract, including all option periods, regardless of whether or not they are produced by the Contractor, its subcontractor or supplier, or the software author. The contract term shall consist of one twelve-month base period, beginning upon contract award, and three (3) one-month option periods. All software products and materials shall be dlivered by August 22, 1997. The Government will accept the software if the software performs the IRS workload for thirty (30) consecutive calendar days without sustaining Contractor- provided software failure(s) which render the system unavailable for a total of more than 10 hours. The Unisys Corporation (Unisys) shall submit a technical and price proposal in response to this notice. Unisys shall prepare its proposal in accordance with FAR provision no. 52.212-01, Instruction to Offerors-Commercial and shall include the following information: (1) list and prices of the software products to be provided; (2) acknowledgement of each requirement listed above, or a summary of exceptions taken to specific requirements with alternative proposals for each exception for IRS approval; (3) three "past performance" references; and, (4) a completed copy of the provision 52.212-03, Offeror Representations and Certifications- Commercial. Unisys's proposal will be evaluated in accordance with FAR clause no. 52.212-02, Evaluation-Commercial Items in light of the following evaluation factors, (1) ability to provide the required software products and related requirements, and (2) past performance evaluation, and (3) fairness and reasonableness of proposed price. Unisys will be required to comply with FAR clause no. 52.212-04, Contract Terms and Conditions-Commercial Items in its entirety. Under FAR clause no. 52.212-05, Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Items, the contractor shall comply under paragraph (b) with the following FAR clauses: (1) no.52.203-06, (2) no. 52.203-10, (3) no. 52.219-08, (4) no. 52.219-14, (5)52.222-26, (6) no. 52.222-35, (7) no. 52.222-36, (8) no. 52.222-37, and (9) no.52.225-09. In addition, the proposed contract will include IRS rights in data as set forth in FAR clause no. 52.227-14, Rights in Data-General, with its alternates II, III and IV and FAR clause no. 52.227-19, Commercial Computer Software- Restricted Rights.
