Tobacco and Firearms intends to issue a Request for Proposal (BATF
97-19) on a sole source basis to Novell, Inc. This action is being done
under the statutory authority of the Federal Acquisition Regulation
(FAR), 41 USC 253(c)(1)-Only One Responsible Source. This is a combined
synopsis/solicitation for commercial items prepared in accordance with
the format in Subpart 12.6 and supplemented with additional
information included in this notice. This announcement constitutes the
only solicitation; proposals are being requested and a written
solicitation will not be issued. This solicitation document and
incorporated provisions and clauses are those in effect through Federal
Acquisition Circular (FAC) 90-46. There is no set-aside for this
acquisition. The standard industrial classification code is 7372 with
a small business size standard of $14.5 million average annual
receipts. This acquisition will be for the purchase of a Novell Master
Licensing Agreement for 3.X-4.X Netware (Qty 2,366), 3.X,4.X.1
Maintenance (QTY 6,466), LWP for Windows License (QTY 3,785), LWP for
Windows Maintenance (QTY 4,100), SAA Maintenance (QTY 320) and FLEX IP
Maintenance (QTY 31). Offerors are advised to include a completed copy
of the provisions at 52.212-3, Offeror Representation and
Certification-Commercial Items, with their offer. The following
provisions shall be included in this solicitation: 52.212-1,
Instructions to Offerors-Commercial Items; 52.212-4, Contract Terms and
Conditions-Commercial Items (relative order of importance of the
evaluation factors in decending order of importance are: (1) technical
capability of the item offered to meet the Government's requirement;
(2) past performance; (3) price. The contract will be firm fixed price.
Responses are due within fifteen calendar days after the date of
publication of this notice in order to be considered by the Government
and are to reference BATF 97-19 and be addressed to Charles Logan at
the above address. The response shall be sufficient to permit agency
analysis to establish capability to meet these requirements at a price
lower than that which we can obtain from Novell, Inc. Numbered note 22
