Department of Justice (DOJ) currently has in place Contract No.
5C-N-JMD-0078 with West Publishing Corporation for access to WESTLAW,
West's commercially available, computerized legal research system. The
contract was awarded effective July 1, 1995 as a result of a
competitive solicitation and will extend to September 30, 1999 if all
options for renewal are exercised. This notice is to publicize DOJ's
intent to negotiate a contract modification with West that will provide
for the creation of, and access to, a nationwide Circuit Court brief
bank. Initially, a prototype brief bank will be developed for the 9th
circuit and, if it is successful, the brief bank will be expanded
nationwide. The brief bank will be a private file provided as part of
DOJ's WESTLAW service and will be utilized exclusively by DOJ
attorneys. The goal of the brief bank will be to facilitate legal work
processes by having court filed briefs accessible to DOJ attorneys in
a manner identical to general WESTLAW research and providing all the
features of traditional WESTLAW research, e.g., the ability to retrieve
the brief through various means, including terms searches, author, and
topic, instant shephardization and insta-citing of cases within the
brief, and the immediate access to any case or statute cited within the
brief. These features will enable DOJ attorneys to customize and update
easily any brief which is on-line. By enabling access to these briefs,
which commonly serve as a starting point in research, DOJ attorneys
will be spared time by eliminating the possible duplication of efforts.
The creation of a brief bank private file fits within the nature of
services provided under the existing contract for usage of WESTLAW by
DOJ attorneys. In addition to the modification discussed herein, DOJ
may decide to negotiate future contract modifications with West to
provide additional private brief banks for DOJ organizations as needs
arise. The negotiation of any future modifications for private brief
banks will not be preceded by a synopsis. The 9th circuit prototype
brief bank is to be fully operational during the month of September
1997. No soliciation is available since DOJ intends to negotiate a
contract modification with West. Any sources who want to be considered
for this requirement must identify their interests and capabilities to
fulfill the requirement to the Contracting Officer listed above within
21 calendar days after the publication date of this synopsis.
