Beverly J. Hardy, Contracting Officer. Notice of intent to negotiate
with Mendev Associates, Ltd. Vista, California for a period of one (1)
year with an option for two (2) additional years, for the following:
Primary Task: Provide Engineering and water rights advisory and
assistance services in support of Camp Pendleton for the Case of United
States vs. Fallbrook Public Utility District, et al., Case No.l247 in
the Federal District Court for the Southern District of California.
Secondary Task: Provide engineering and water rights advisory and
assistance services in support of the protection and development of
Marine Corps Base, Camp Pendleton's water rights. Consultant must have
the following qualifications: (a) A Baccalaureate Degree in
hydrologic, geologic or related natural resources field from a
nationally and state accredited college or university. An additional
degree and/or experience in the legal field is desired but not
required. (b) Extensive litigation experience as an expert witness or
otherwise in the fields of hydrologic, geologic, or related natural
resources engineering. (c) A detailed familiarity with the historical
development and current status of the water rights litigation in the
Santa Margarita River Watershed. Consultant shall be capable, in-house
or otherwise, of providing the coordinated technical and legal review
and analysis of complex water rights issues under state and federal
law. Consultant's staff shall have knowledge and practical experience
with respect to the following: (a) The hydrology and hydrogeology of
the Santa Margarita River Watershed. (b) The substansive rights
assigned to each party in the Santa Margarita River Watershed under
applicable court orders and judgments. (c) The water resources, supply,
and consumption at Camp Pendleton. (d) Procedures, facilities,
operational requirements, and mission of the Marine Corps at Camp
Pendleton. (e) The technical and legal factors involved in the
acquisition and distribution of imported water. (f) The technical,
legal, and environmental factors involved in devising a physical
solution that the water rights issues on the Santa Margarita River
Watershed, including, but not limited to, the wheeling of native and
imported water and the live stream discharge of treated wastewater from
the Murrieta and Temecula Creek sub-basins. (g) The duties and
authority of the Watermaster of the Santa Margarita River Watershed,
including the factors and considerations upon which such duties and
authority were formulated. (h) The effect of the federal reserved
rights and Indian trust doctrines on Camp Pendleton's position in the
Santa Margarita River watershed litigation. (i) The legal and practical
considerations involved in dealing with the various public agencies
that have immediate or potential impact on Camp Pendleton's water
resources. Soloicitation will be for one year with options. If no
affirmative written responses are received within 45 days after
publication of this notice, a sole source award will be made to Mindev
Associates, Ltd. No soloicitation document exists. No contract award
will be made on the basis of offers received in response to this
notice. Interested firms shall furnish detained data concering their
capabilities to furnish same services, original pricing data and point
of contact. The Government will be the sole determiner regarding
