Warfare Center, Weapons Division, China Lake, CA intends to procure
from Claris Corp., P.O. Box 526, Santa Clara, CA 95052 on an other than
full and open competition basis the Claris-unique License Maintenance
Site Management Program (SMP) for FileMaker Pro. The SMP is a "Claris
Direct" program only and the software is proprietary to Claris. This is
a combined synopsis/solicitation for commercial items prepared in
accordance with the format in Subpart 12.6, as supplemented with
additional information included in this notice. This announcement
constitutes the only solicitation and no other solicitation will be
issued. The solicitation number is N68936-97-R-0275 and is a Request
for Proposals (RFP). This solicitation document and incorporated
provisions and clauses are those in effect through Federal Acquisition
Circular 90-45. This acquisition is being procured under other than
full and open competition under SIC code 7379 with a small business
size standard of $18M. Specifications for theSMP are as follows: Item
0001: Two Years of License Maintenance in accordance with Site
Management Program Agreement for Claris FileMaker Pro for 5545 MAC and
PC platforms, including: (1) upgrade of FileMaker Pro v 2.1 to v 3.0
and automatic upgrades and updates thereafter on an event driven basis,
(2) right to use/copy the latest Claris software versions. Period of
Performance to be 01 Sep 1997 through 30 Aug 1999 or for a two year
period starting from date of award, whichever is later. Required
delivery is to NAWS China Lake, CA, FOB Destination. Federal
Acquisition Regulation (FAR) 52.212-1, Instructions to Offerors --
Commercial Items (Oct 1995), applies to this acquisition and there are
no addenda to this provision. FAR 52.212-3, Offeror Representation and
Certification-Commercial Items (Oct 1995). Offeror must include a
completed copy of provision 52.212-3, Offeror Representations and
Certifications -- Commercial Items, with their offer unless a copy has
been submitted to this agency within the last 12 months. FAR 52.212-4,
Commercial Terms and Conditions -- Commercial Items (Aug 1996), applies
to this acquisition and there are no addenda to this clause. FAR
52.212-5, Contract Terms and Conditions Required to Implement Statutes
or Executive Orders -- Commercial Items (Aug 1996). The clauses under
52.212-5 that are incorporated are: FAR 52.203-6 ALT I Restrictions on
Subcontractor Sales to the Government Alternate I, FAR 52.203-10 Price
or Fee Adjustment for Illegal or Improper Activity, FAR 52.219-8
Utilization of Small Business Concerns and Small Disadvantaged Business

Vietnam Era Veterans, FAR 52.222-36 Affirmative Action for Handicapped
Workers, FAR 52.222-37 Employment Reports on Special Disabled Veterans
and Veterans of the Vietnam Era, and FAR 52.239-1 Privacy or Security
Safeguards. In addition, the following FAR and DFARs clauses will
apply. FAR 52.204-6 Contractor Identification Number -- Data Universal
Numbering System (DUNS) Number. Defense Federal Acquisition Regulation
(DFARs) 252.212-7001 Contract Terms and Conditions Required to
Implement Statutes or Executive Orders Applicable to Defense
Acquisitions of Commercial Items (Nov 1995). The clauses under

Technical Data -- Commercial Items. FAR 52.233-2 Service of Protest
(Aug 1996). Firms believing they can provide this maintenance program
shall submit a written response to be received at the Contracting
Office no later than 5 days after the date of the publication of this
notice, clearly showing their ability to provide the required
maintenance program. Respondent (Claris) shall submit their proposal
including any proposed license agreement on or before 18 Aug 1997,
15:00 P.M. Pacific time, to Kay Eiband at the address above. Oral
Communications are not acceptable. Award to be made under FAR Part 12
