20535-0001 70 -- ACQUISITION OF SAS INSTITUTE, INC. STATISTICAL SOFTWARE LICENSES
POC Susan J. Smith, Contracting Officer, (304) 625-2441 (i) This is a
combined synopsis/solicitation for commercial items prepared in
accordance with the format in FAR Subpart 12.6, as supplemented with
additional information included in this notice. This announcement
constitutes the only solicitation; proposals are being requested and a
written solicitation will not be issued. (ii) This solicitation is
being issued as a Request for Proposal (RFP) to be negotiated on a
sole-source basis with SAS Institute, Inc. (iii) The solicitation
document and incorporated provisions and clauses are those in effect
through FEDERAL ACQUISITION CIRCULAR 90-46. (iv) This solicitation is
not restricted to a set-aside. Standard Industrial Classification Code
is 7372 and the small business size standard is $18 million in annual
receipts. (v) A list of CONTRACT LINE ITEM NUMBERS (CLINs) and item
descriptions are: CLIN 0001: BASE/SAS; CLIN 0002: SAS/GRAPH; CLIN 0003:
SAS/STAT; and CLIN 0004: SAS/FSP. (vi) The Federal Bureau of
Investigation (FBI) intends to negotiate on a sole-source basis with
SAS Institute, Inc. for licensing of the four software products.
Software licensing for CLINs 0001, 0002, and 0003 shall be for the
period December 19, 1996 through September 30, 1997. Software licensing
for CLIN 0004 shall be for the period from contract award through
September 30, 1997. The resultant contract will include three one-year
option periods. Description of the requirements for the software
licensing to be acquired: The statistical analysis software products
shall be Year 2000 compliant and shall have the ability to represent
IBM MVS/ESA internal measurement data in a format that is compatible
with the modeling software package "SCERT2" that is presently installed
on the Identification Automated System (IDAS) mainframe; ability to
graphically represent data using IBM's 6182 color plotter; ability to
interface with, read, and report on data produced by Candle
Corporation's Omegamon products installed on the IDAS; ability to
interface with Merrill Consultant's MXG software to produce performance
reports for the IDAS data storage hardware; ability to interface with,
read, and report on data produced by Legent Corporation's Multi-Image
Manager software installed on the IDAS; ability to interface with,
read, and report on data produced by Computer Associates' ASM2 software
installed on the IDAS system; ability to interface with, read, and
report on data produced by IBM's IXFP software installed on the IDAS;
ability to read data in any format from any type of file including
variable-length records, binary files, and free-formatted data; ability
to support an applications development interface including pull-down
menus and action bars; and ability to interface with, read, and report
on data produced by Compumetric's IMETRICS software installed on the
IDAS. The software licenses are licensed under SAS Institute Inc.'s
Institute Program Products Master License Agreement Number 1085
included as an addendum hereto and are/will be installed on an Amdahl
5995-1400A mainframe computer. (vii) Licensing of the software shall be
for the period December 19, 1996 through September 30, 1997, for CLINs
0001; 0002; and 0003 and from date of award through September 30,
1997, for CLIN 0004. The resulting contract will include three one-year
optional periods. The software licenses are installed at the FBI's
Criminal Justice Information Services Division Complex, 1000 Custer
Hollow Road, Clarksburg, West Virginia 26306. Licensing shall be F.O.B.
Destination. (viii) FAR 52.212-1, Instruction to Offerors -- Commercial
Items, is incorporated by reference and applies to this acquisition.
ADDENDUM FAR 52.212-1 Para. (b): Submit three copies of signed and
dated offer. ADDENDUM FAR 52.212-1 Para. (b)(4) Offers shall include
technical literature regarding each product as well as a detailed
description of the terms and conditions of the license support to be
provided. (ix) FAR 52.212-2, Evaluation -- Commercial Items, is
incorporated by reference and applies to this acquisition. ADDENDUM FAR
52.212-2 Para. (a) The following factors shall be used to evaluate
offers: Technical capability and price. The two evaluation factors are
equal in importance. (x) Offerors shall include a completed copy of
the provision at FAR 52.212-3, Offeror Representations and
Certifications -- Commercial Items, with its offer. (xi) FAR 52.212-4,
Contract Terms and Conditions -- Commercial Items, is incorporated by
reference and applies to this acquisition and resulting contract.
Contract Type: The resulting contract will be firm, fixed price (FFP).
ADDENDUM FAR 52.212-4, Additional Terms and Conditions Regarding
Options, the following clauses regarding options shall apply to
resultant contract: FAR 52.217-8, Option to Extend Services, and FAR
52.217-9, Option to Extend the Term of the Contract. ADDENDUM FAR
52.217-9 Para. (a) The Government may extend the term of this contract
by written notice to the Contractor within 60 days of the first day of
the fiscal year or appropriation of funds for the fiscal year,
whichever is later. ADDENDUM FAR 52.217-9 Para. (c) The total duration
of this contract, including the exercise of any options under this
clause, shall not exceed 42 months. (xii) FAR 52.212-5, Contract Terms
and Conditions Required to Implement Statutes or Executive Orders --
Commercial Items, is incorporated by reference; however, for Paragraph
(b) only the following provisions apply to this acquisition: 52.212-5
(b): 52.203-6, Restrictions on Subcontractor Sales to the Government
with Alternate I; 52.203-10, Price or Fee Adjustment for Illegal or
Improper Activity; 52.219-8, Utilization of Small, Small Disadvantaged

regulations concerning Commercial Item acquisition contained at FAR
Subpart 12 and shall ensure that all Representations and Certifications
