synopsis/solicitation for commercial items prepared in accordance with
the format in FAR Subpart 12.6, as supplemented with additional
information included in this notice. This announcement constitutes the
only solicitation; proposals are being requested and a written
solicitation will not be issued. This solicitation is being issued as
a Request for Quotation No. 656-16-97. The solicitation document and
incorporated provisions and clauses are those in effect through Federal
Acquisition Circular (FAC) 90-46. This solicitation is under the
Simplified Acquisition Procedures for Small Business-Small Purchase
Set-Aside. The Standard Industrial Classification Code is 5074, and the
Business Size Standard is 100 employees. Item No. 1: 2 Each of
Steam-Fired heaters that will be factory assembled and packaged. Rated
to heat 273 GPM of water from 40 to 120 degrees Fahrenheit (4.44
Celsius to 48.88 Celsius) and control the outlet within 5 degrees (2.77
Celsius) of the selected temperature when supplied with 30 PSIG
saturated steam before the control valve. The packaged water heater
shall be constructed with a 316 Liter Stainless Steel Tank, with
stainless steel threaded openings, 1/2 Inch (1.27 Centimeters) tubes,
copper lined tube sheet and fabricated steel steam chamber. Heater
shall be mounted on a steel support skid and shall have lifting lugs.
Heater shall be foam insulated and protected by an enameled metal
jacket, 20 gauge minimum thickness. Height not to exceed 84 inches
(213.36 Centimeters). Heater shall be factor assembled and piped
including incoming steam strainer, pneumatic control valve, main and
auxiliary float thermostatic steam traps. Coil shall be baffled and
shall have an integral bronze valved circulator with shut-off valves to
circulate the water across the coil. Heater shall be furnished with
American Society Mechanical Engineers (ASME) pressure-temperature
relief valve of sufficient size to relieve total BTU input of the coil,
water thermometer, water pressure gauge and steam pressure gauge.
Delivery of items to be at Building No. 14, Warehouse, VA Medical
Center, 4801 8th Street North, St. Cloud, Minnesota within 60 days
after receipt of order. Each offeror shall include a completed copy of
the FAR provisions at 52.212-1 Instructions to Offerors -- Commercial
Items (Oct 1995); clause FAR 52.212-2 Evaluation-Commercial Items (Oct
1995); Clause 52.212-3 Offeror Representation and Certifications --
Commercial Items (Jan 1997); 52.212-4 Contract Terms and Conditions --
Commercial Items (May 1997) addenda to delete paragraph (p) and
replace with (p) Limitation of liability: Seller expressly warrants
that all goods, material and workmanship will conform with applicable
drawings, specifications, samples, or other descriptions given, will be
fit for the purpose intended, and will be free from defects. All goods
delivered and services performed will be subject to test and
inspection by Buyer at the place of manufacture or at designation or at
both. Any of the goods found at any time to be damaged (including goods
damaged due to unsatisfactory packaging by Seller) or defective in
material or workmanship or not in conformity with this purchase order
may be corrected by Buyer at Seller's expense or rejected and returned
at Seller's expense. If Buyer elects to return such goods to Seller at
any time, Buyer shall be entitled to credit or replacement goods or
services at the price charged. However, Buyer's inspection or failure
to inspect shall in no way relieve Seller of responsibility hereunder,
and Seller will in all cases indemnify and hold buyer harmless against
any and all claims, liabilities, costs, damages or expenses (including
attorneys' feeds) of any kind caused by Seller's breach of the
foregoing warranty, including but not limited to all costs and expenses
related to product recall. The foregoing shall not be in limitation of
any rights that Buyer may have at law or in equity by reason of any
breach of warranty, express or implied. Seller shall maintain product
liability insurance in such amounts as is customary for its type of
business, and upon request by Buyer, Seller will provide Buyer with a
