synopsis/solicitation for commercial items prepared in accordance with
the format in FAR Subpart 12.6, as supplemented with additional
information included in this notice. This announcement constitutes the
only solicitation; proposals are being requested and a written
solicitation will not be issued. The Solicitation number is
N65236-98-R-0401 and is issued as a Request for Proposal (RFP).
SPAWARSYSCEN intends to negotiate and award a sole source contract to
Hewlett-Packard Corporation, Order Processing Department, PO Box 1487,
Rockville, MD 20849 because Hewlett-Packard Corporation is the only
known supplier with capability of providing the industrial quality
Cesium Beam Tubes as provided by Director, Strategic Systems Programs.
The solicitation document and incorporated provisions and clauses are
those in effect through Federal Acquisition Circular 90-46. The
Standard Industrial Code (SIC) is 3812, with a small business size
standard of 750 employees. The Contract Line Item Number (CLIN),
description (including required part number), and quantity for the
subject procurement is as follows: CLIN 0001 -- Hewlett-Packard
Corporation Cesuim Beam Tubes, HP Part Number 05061-6077, to repair
Cesuim Beam Frequency Standards, Part Number 3029592-4, NSN
8P6605-LW-S91-9195, which are components of the AN/BSQ-4 Frequency
Standard, Part Number 6102633-302, NSN 8P6605-LW-S91-9166. The TYPE OF
CONTRACT anticipated is a Fixed Price, Indefinite Delivery/Indefinite
Quantity type contract. Contract length will be one (1) base year with
four (4) one year option periods, to be exercised at the discretion of
the Government. Estimated quantity for the base year is twenty
each-units, first option year is twenty-six each-units, second option
year is ten each-units, third option year is ten each-units and fourth
option year is ten each-units. DELIVERY shall be F.O.B. Destination
to: Receiving Officer, Space and Warfare Systems Center-Charleston,
1639 Avenue 'B' North, North Charleston, SC 29405-1639. INSPECTION AND
ACCEPTANCE shall be accomplished at destination by the receiving
activity. WARRANTY: in accordance with FAR 12.404(b), offerors are
required to offer the Government at least the same warranty terms,
including offers of extended warranties, offered to the general public
in customary commercial practice. The provision of FAR 52.212-1,
Instructions to Offerors-Commercial Items, applies to this acquisition.
Offerors are required to include a completed copy of the provisions at
FAR 52.212-3, Offeror Representations and Certifications-Commercial
Items, DFARS 252.225-7006, Buy American Act-Trade Agreements-Balance of
Payments Program Certificate, DFARS 252.225-7007, Trade Agreements, and
DFARS 252.212-7000, Offeror Representations and
Certifications-Commercial Items, with their offer. Additional FAR
clauses which apply to the subject acquisition include 52.204-6,
Contractor Identification Number-Data Universal Numbering System (DUNS)
Number; 52.212-4, Contract Terms and Conditions-Commercial Items; and
52.212-5, Contract Terms and Conditions Required to Implement Statutes
or Executive Orders-Commercial items, incorporating the additional FAR
clauses cited as follows: 52.203-6, Restrictions on Subcontractor Sales
to the Government, with Alternate 1; 52.203-10, Price or Fee Adjustment
for Illegal or Improper Activity; 52.219-8, Utilization of Small
Business Concerns and Small Disadvantaged Business Concerns; 52.222-26,
Equal Opportunity; 52.222-35, Affirmative Action for Special Disabled
and Vietnam Era Veterans; 52.222-36, Affirmative Action for Handicapped
Workers; 52.222-37, Employment Reports on Special Disabled Veterans and
Veterans of the Vietnam Era. Additional DFARS clauses which apply to
the subject acquisition include 252.212-7001, Contract Terms and
Conditions Required to Implement Statutes Applicable to Defense
Acquisitions of Commercial Items, which incorporates additional DFARS
clauses cited as follows: 252.225-7001, Buy American Act and Balance of
Payments Program; 252.225.7012, Preference for Certain Domestic
Commodities; 252.227-7015, Technical Data-Commercial Items; and
252.227-7037, Validation of Restrictive Markings on Technical Data. The
Defense Priorities and Allocations System (DPAS) rating for this order
is DO-C9. Award of the contract resulting from this solicitation will
be made to the responsible offeror whose offer conforms with all
requirements of the solicitation and whose proposal reflects the lowest
cost or price. The Government reserves the right to eliminate from
further consideration those proposals which are considered
non-responsive. A single award will be made on the proposed contract.
