synopsis/solicitation for commercial items prepared in accordance with
the format in FAR 12.6, as supplemented with additional information
included in this notice and specifications listed on the Patent and
Trademark Office (PTO) website at www.uspto.gov (under Acquisitions,
Office of Procurement, Active CBD Notices) or

announcement constitutes the only solicitation; proposals are being
requested and a written solicitation will not be issued. Solicitation
No. 52-PAPT-8-00001 should be referenced on all responses and is issued
as a Request for Proposal (RFP). This is a competitive procurement
which has been designated as a small business set-aside utilizing SIC
Code 5065. A Firm-Fixed-Price (FFP) Requirements contract will be
awarded as a result of this solicitation. This requirement is for the
acquisition of 3480 and 3490E IBM compatible magnetic cartridge tapes
that will be used for backing up critical data files (e.g., Automated
Patent Systems (APS), Patent Application Location Monitoring (PALM),
Trademark, and X-Search) on Patent and Trademark Office (PTO) mainframe
computers located in Arlington, VA, and for dissemination processing at
the PTO Boyers, PA, facility. The items to be procured are as follows:

DELIVERY AND PACKAGING REQUIREMENTS: Delivery schedule: 30 days after
issuance of delivery orders. All CLINs shall be FOB Destination as
follows: CLINs 0001, 0003, 0005, 0007, 0009, 0011, 0013, 0015, 0017,
and 0019 to be delivered to: U.S. Patent and Trademark Office, c/o
National Underground Storage, Boyers, PA 16020 (INSIDE DELIVERY); CLINs
0002, 0004, 0006, 0008, 0010, 0012, 0014, 0016, 0018 and 0020 to be
delivered to: U.S. Patent and Trademark Office, Administrator for
Computer and Telecommunications Operations, 2121 Crystal Drive,
Arlington, VA 22202 (INSIDE DELIVERY). ORDERING PROCEDURES: (1)
Computer magnetic cartridge tapes will be ordered by issuance of
Delivery Orders by the Contracting Officer. Such orders may be issued
from the effective date of the contract. Orders may not be issued
orally. If mailed, a delivery order is considered "issued" when the
Government deposits the order in the mail. (2) All Delivery Orders will
contain the following information: date of order, contract number,
delivery order number, quantity ordered, special instructions when
necessary. (3) Delivery Orders will be issued only to the address
specified by the Contractor, irrespective of whether or not the
Contractor proposes to make deliveries from more than one plant
location. The Government will award a contract resulting from this
synopsis/solicitation to the responsible Offeror whose offer conforming
to this solicitation will be the most advantageous and represents the
best value to the Government, price and other factors considered. A
contract award will include FAR 52.212-4 Contract Terms and Conditions
-- -Commercial Items and 52.212-5 Contract Terms and Conditions
Required to Implement Statutes or Executive Orders Commercial Items.
The following factors will be used to evaluate offers: (A) Technical
capability of the item(s) offered to meet the Government requirement,
(B) Price,and (C) Past Performance. Technical and Price, Factors (A)
and (B), are equal in importance, and when combined, are more important
than Factor (C) Past Performance/Experience. Technical Capability will
be evaluated on the technical capability of the item(s) offered to
meet the Government's requirements based upon the Offeror's submission
of (1) product literature, (2) technical features, (3) maintenance
support, (4) warranty provisions, (5) documentation, (6) brochures, and
(7) any other pertinent information which describes how the proposed
product will meet the above referenced specifications. Offerors shall
provide a written narrative for any information not provided in
paragraphs (1) through (7) above. Past Performance/Experience shall
include a minimum of three (3) references for contracts for similar
items which are no more than three (3) years old. All references shall
include current information which will allow for verification of the
data provided (contract number, agency or company name, point of
contact, current telephone number and fax number). Evaluation of Past
Performance will be based on information obtained from the references
provided by the Offeror, as well as any other information the
Government may have obtained from other sources. Proposals shall
include pricing for all CLINs shown above, including all option CLINs.
The Government will evaluate offers for award purposes by adding the
total price for all options to the total price for the basic
requirement. The Government may determine that an offer is unacceptable
if the option prices are significantly unbalanced. Evaluation of
options will not obligate the Government to exercise the option(s). A
written notice of award or acceptance of an offer, mailed or otherwise
furnished to the successful Offeror within the time for acceptance
specified in the offer, shall result in a binding contract without
further action by either party. Before the offer's specified expiration
time, the Government may accept an offer (or part of an offer), whether
or not there are negotiations after its receipt, unless a written
notice of withdrawal is received before award. All offers (one (1)
original plus one (1) copy) are due Friday, November 14, 1997, no later
than 2:00 PM Eastern Standard Time (EST) at the following address: U.S.
