Officer, 202-324-3318 This is a combined synopsis/solicitation for
commercial items prepared in accordance with the format in Subpart
12.6, as supplemented with additional information included in this
notice. This announcement constitutes the only solicitation; proposals
are being requested and a written solicitation will not be issued. The
Request for Proposal number is 7140 and is 100% set aside for small
business concerns. The Standard Industrial Classification (SIC) code is
3651, the size standard is 500 employees, and incorporates FAR
52.219-6. The Request for Proposal (RFP) incorporates provisions and
clauses that are in effect through Federal Acquisition Circular 90-46.
The Federal Bureau of Ivestigation (FBI) intends to award an
Indefinite Delivery -- Indefinite Quantity type contract "name brand or
equal" for SME Transcribers, model number BM-77ST2, Modified 2-speed
stereo standard cassette, for award year with four one-year options. As
used in this provision, the term "brand name" includes identification
of products by make and model. If items called for by this RFP have
been identified in the synopsis/solicitation by a "brand name or equal"
description, such identification is intended to be descriptive, not
restrictive, and to indicate the quality and characteristics of
products that will be satisfactory. Proposals offering "equal" products
(including products of the brand name manufacturer other than the one
described by the brand name) will be considered if such products is
(are) clearly identified in the proposals and is (are) determined by
the FBI to meet fully the salient characteristic requirements listed in
this combined synopsis/solicitation. Unless the vendor clearly
indicates in their proposals that they are offering an "equal" product,
the proposals shall be considered as offering a brand name product
referenced in this synopsis/solicitation. If the offeror proposes to
furnish an "equal" product, the brand name, if any, of the product to
be furnished shall be provided in the proposals. If the vendor proposes
to modify a product so as to make it conform to the requirements of
this synopsis/solicitation, they shall (1) include in their proposals
a clear description of such proposed modifications and (2) clearly mark
any descriptive material to show the proposed modifications. All
proposals will be considered and the FBI reserves the right to request
samples. Salient characteristics for the requested Transcribers is as
follows: Tape format shall be: PHILLIPS type compact cassette; Track
format shall be: Quarter-track, 2 channel, stereo; Tape Speed: 1 7/8
and 15/16 ips; Fast winding time: not to exceed 2 minutes, 20 seconds
w/C90 tape; Frequency response: 200-5,000 Hz (@ 15/16 ips) and
200-10,000 Hz (@1 7/8 ips); Speaker: Approximately 5.7 cm (2 1/4")
diameter; Power Output: 350mW (@10% distortion); Earphone output:
Stereo 3.5mm jack; Line output: Stereo (2) RCA gold plated jacks; Power
requirement: Supplied AC power adaptor for use on 120VAC, 60Hz; Power
Consumption: 14W (with supplied AC power adapter); Dimensions: Maximum
of 200 x 75 x 245mm (w/h/d/)(7 7/8 x 2 7/8 x 9 3/4"); Foot Pedal
(rewind/fast forward/start/stop [listen]); Stereo headphone with
in-line volume control; Accessible Head azimuth control; Adjustable
auto backspace; speed control (variable +/- 20%); Tape counter: LCD
Digital Display (time; minute/second). The provisions at FAR Clauses
52.212-1, Instructions to Offerors-Commercial Items; ADDENDUM -- add:
The contractor shall provide on a FOB destination basis to the FBI,
Engineering Research Facility, Quantico, Virginia, or locations within
the CONUS, Alaska, Hawaii, and San Juan, Puerto Rico, specified by the
Contracting Officer's Technical Representative. Delivery
Specifications: Delivery shall be between the hours of 8:00 AM through
4:00 PM, Monday through Friday, excluding holidays. Delivery shall be
made within 30 days from receipt of delivery order. No order shall be
made for more than 400 recorders and no less than 150. FAR Clause
52.212-4, Contract Terms and Conditions-Commercial Items;and 52.212-5,
incorporating by reference Subparagraphs (1) through (11), and (13)
through (16), Contract Terms and Conditions Required to Implement
Statutes and Executive Orders-Commercial Items; and any addenda
thereto, apply to this acquisition. Offeror Representations and
Certifications -- Commercial Items apply to this acquisition. Each
offer shall include a completed copy of 52.212-3 with the proposal. FAR
Clause 52.212-2, Evaluation -- Commercial Items is incorporated by
reference and applies to this acquisition. ADDENDUM 52.212-2(a)-Award
will be based on best value to the government. The following factors
shall be used to evaluate offers: Technical, Past Performance and
Price. Technical and Past Performance (listed in descending order of
precedence) is more important than price. The resulting contract will
be an Indefinite Delivery -- Indefinite Quantity (IDIQ) Firm-Fixed
price (FFP) type contract. The guaranteed minimum quantity is 350 each
Transcribers, with an estimated quantity of 1,500 over the life of the
contract (award year with four one-year options). The Government may
require continued performance of any services within the limits and at
the rates specified in the contract. The option provision may be
exercised more than once, but the total extension of performance
hereunder shall not exceed 6 months. The Government may extend the term
of this contract by written notice to the Contractor within 30 days;
provided that the Government give the Contractor a preliminary written
notice of its intent to extend at least 60 days before the contract
expires. The Contracting Officer may exercise the option by written
notice to the Contractor within the period specified in the
Synopsis/solicitation. In accordance with 52.216-18 Ordering, hereof,
delivery orders may be issued from the date of contract award
throughout a five-year time period contingent upon the needs of the
Government and the availability of funds. If any future price
adjustments (upward or downward) are necessary, they shall not exceed
the Producers Price Index (PPI) as published by the U.S. Bureau of
Labor Statistics, for the previous 12-month average. However, in no
case shall an upward adjustment exceed 8% regardless of the amount of
change in the PPI. Price adjustments may only be requested at the time
the Government notifies the contractor of its intent to exercise the
renewal option throughout the contract life. Additional requirements:
Warranty: The contractor shall extend to the FBI full coverage of any
standard commercial warranty normally offered in a similar commercial
sale, provided such warranties are available at no additional cost to
the FBI. Acceptance of the standard commercial warranty does not waive
the FBI's rights under the "Inspection" clause nor does it limit the
FBI's rights with regard to the other terms and conditions of this
contract. In the event of a conflict, the terms and conditions of the
contract shall take precedence over the standard commercial warranty.
The standard commercial warranty period shallbegin upon final
acceptance of the applicable product listed in the
synopsis/solicitation. An original and two copies of the technical
proposal and one copy of the cost proposal are due by 11:00 AM, EST,
12/4/97 to the attention of Ms. Theresa M. Powell, Contract Specialist,

TO ANY FBI LOCATION WILL NOT BE ACCEPTED. Offerors shall provide names,
addresses and telephone numbers of customers (please limit to a maximum
of 25 references), either Government or commercial, that have received
the product during the past three years (this information is needed
for the evaluation of past performance). Offerors must acquaint
themselves with the new regulations concerning Commercial Item
acquisition contained at FAR Subpart 12 and must ensure that all
Representations and Certifications (located on the Internet) are
executed and returned as required in this synopsis/solicitation.
