synopsis/solicitation for commercial items prepared in accordance with
the format in FAR Subpart 12.6, the test program in FAR Subpart 13.6,
and FAR Part 15, as supplemented by the additional information stated
below. This announcement constitutes the RFP and is the only
solicitation that will be issued. Proposals are requested pursuant to
this announcement. All responses shall reference Solicitation No.
52-PAPT-8-00003. This solicitation incorporates all of the applicable
provisions and clauses in effect through FAC 97-01, as if stated in
full text, as well as the terms and conditions of FAR 52.212-1. A fixed
price contract will be awarded as a result of this solicitation.
Objective: The PTO Office of Human Resources (OHR) plans to implement
a Human Resources Information System (HRIS) that shall include, at a
minimum, recruitment, time and attendance, performance appraisal
management, training, employee benefits, and payroll functions. The
HRIS must provide desktop access to detailed records and support PTO's
human resources management decision making processes. The HRIS shall
support Internet connectivity as well as an advanced resume scanning
technology. The HRIS shall provide complete control over all aspects of
generating payroll. The intent is that any product proposed will fully
integrate with current federal automated information systems and also
maintain current customer service interfaces. The PTO's status as a
federal agency is currently under review and pending Congressional
direction, which may result in converting to a wholly-owned
corporation, therefore, requiring flexibility in the acquired software
to allow migration to a commercial environment. Technical/Functional
Requirements: The PTO desires to acquire software that best meets the
following requirements. (A) Technical Requirements: The proposed COTS
software shall be compatible with the PTO Technical Reference Model and
the PTO software development environment, including, but not limited
to: Year 2000 compliance; Client/Server architecture; HP/UX application
server; Windows NT 4.0 desktop OS; Open System Environment with PTO
Technical Reference Model compliance; PTO Network environment
compliance; TCP/IP, IPX, and Ethertalk protocols compliance; Oracle v7;
Crystal Reports; Tuxedo middleware; Netscape Suitespot web server;
Netscape browser; Eastman Open Workflow; Eastman Open Image; Rochade
repository; PRISM; Business Objects; Sterling Composer CASE
environment; Hahtsite web development tool; Visual Basic; PCMS
configuration management tool; RTM requirement traceability tool;
Netware NOS migrating to Windows NT in 1999; and ODMA -- compliance
document management system (Documentum or Texcel document management
system). The proposed COTS software shall demonstrate an open
architecture system, the scalability, ease of installation, ease of
use, ease of maintenance, ease of training, ease of deployment, and
product delivery capability. PTO is most interested in leveraging its
investment in the standards andproducts selected to date. If an
Offeror's product is not compatible with the above-described PTO
software development environment and Technical Reference Model,
Offerors must indicate the incompatibility and will be evaluated
accordingly. PTO will consider, in addition to the items listed above,
life cycle cost and operational effectiveness of the Offeror's product
in its evaluation. (Note: The PTO Technical Reference Model can be

Requirements: The proposed COTS software shall meet the minimum
functional requirements conforming to the PTO Office of Human Resources
functions, including: Web-enabled communication; electronic
notification and transaction; external recruitment and staffing;
employee self service; employee relations; labor relations; retirement;
training; performance management; and time and attendance; work load
management tool for data and case management and reportgeneration of
the above mentioned functions; merit system environment; compliance
with Title 5, 5CFR, and other pertinent regulations; interface with
Federal Finance System; initial interface with the National Finance
Center (NFC) System, with payroll functions package that will allow for
future independence from NFC; Human Resources Data System, Merit
Assignment Program System, ER/LR Database, Registrar, Position
Description Library, Performance Appraisals System Software, and Job
Application Rating System. Evaluation: The Government will award a
contract resulting from this solicitation to the responsible Offeror
whose offer conforming to the solicitation will be the most
advantageous and represents the best value to the Government, price and
other factors considered. The following factors will be used to
evaluate offers: (A) Technical and Functional Capability; (B) Past
Performance/Experience; and (C) Price. Factor A is more important than
Factor B, and together Factors A and B are more significant than
Factor C. Provided is the list of evaluation criteria: (A) Technical
and Functional Capability: The proposed COTS software shall demonstrate
the technical capabilities and functional requirements stated above.
(B) Past Performance/Experience: The COTS software proposed by Offeror
should have high acceptance, use, and successful rate in the Human
Resource information or management market. The company should have a
strong history of human resource experience or services. It must be
highly ranked in published market surveys (Delphi, Gartner Group,
etc.). (C) Price: The total fixed price shall include all modules,
required tools, technical maintenance, the system life cycle cost of
the product, the commercial licensing agreement, and licensing fees for
a five year period. The number of estimated users for Year 1 is 300
users, Year 2 is 2500 users, Year 3 is 5500 users, Year 4 is 5500
users, and Year 5 is 5500 users. Initially as part of the evaluation,
Offeror's proposal will be subject to a technical review / validation
of Offeror's capability to meet technical/functional requirements, as
detailed above. Offerors deemed to possess the best opportunity for
award will be scheduled for a limited product test validating the
Offerors proposed features with the technical/functional requirements.
If scheduled, the Offeror shall be required to install and certify as
operational the software prior to testing. As part of the test phase,
the PTO may, at its discretion, request oral presentations to discuss
past performance and technical issues. As part of the evaluation, Past
Performance shall be based on information obtained from the
contacts/references with similar agency architecture provided by the
Offeror, as well as any other information the Government may have or
obtain from other sources. Instructions/Notice to Offerors: Offerors
are requested to submit one (1) signed and dated original and four (4)
copies of the proposal. As part of the Offeror's price proposal
Offerors are instructed to submit the HRIS life cycle costspreadsheet
which can be found at
http://www.uspto.gov/web/offices/cio/cio-docs.htm. The proposal shall
be brief and concise and utilize product marketing and technical
brochures where applicable, but shall demonstrate the technical and
functional capability of the product proposed. If scheduled for a
limited product test, the Offeror shall provide, at no cost to the
Government, an evaluation copy of the proposed software. This
evaluation copy shall be returned, within 90 days to the Offeror upon
the completion of evaluation. The Offerors shall identify at a minimum
three contracts where the Offerors product is currently operational.
These examples should provide a cross section of the product within
federal, state, local, or commercial environments. The Offerors shall
provide a point of contact, current telephone number and fax number for
each reference. These reference must be submitted with the Offeror's
proposal on the due date stated herein. Proposals shall also include a
completed copy of the provisionat 52.212-3 "Offeror Representation and
Certifications Commercial Items." A copy of these representations and
certifications may be obtained by contacting the person specified
below. The contract award will include the clauses cited at FAR
52.212-4 "Contract Terms and Conditions -- Commercial Items" and
52.212-5 "Contract Terms and Conditions Required to Implement Statutes
or Executive Orders -- Commercial Items." Deliveries from a resulting
contract shall be F.O.B. Destination, within 30 days of award date, to
the PTO's, Arlington, VA campus. Proposals shall be delivered to the
Patent and Trademark Office, Office of Procurement, 2011 Crystal Drive,
Suite 810, Arlington, VA 22202, Attention: Mr. Christopher E. Zeleznik,
Contracting Officer, no later than 2:00 PM (EST) on November 21, 1997.
