17(i) This is a combined synopsis/solicitation for commercial services
prepared IAW the format at FAR Subpart 12.6, as supplemented with
additional information included in FAR Subparts 13, 14 and 16, with the
intent of issuing an indefinite delivery contract (IDC) for the
disposal/recycling of nonhazardous waste generated through the use of
sweepable and polypropylene absorbents at Fort Hood, Texas. This
announcement constitutes the only solicitation; proposals are being
requested and a written solicitation will not be issued. 17(ii)
DAKF4898B0003 is issued as an Invitation for Bid (IFB), incorporating
those provisions at FAR Subpart 16 that relate to indefinite delivery
contracts. 17(iii) This IFB and incorporated provisions and clauses are
those in effect through Federal Acquisition Circular 97-1. 71(iv) This
acquisition is 100% set aside for small business under standard
industrial classification code 8999 -- Services Not Elsewhere
Classified ($5 Million). 17(v) There are two contract line items:0001
-- Nonhazardous Sweepable Absorbents -- approx. 600 55-gallon drums;
and 0002 -- Nonhazardous Polypropylene Absorbents -- approx. 540
55-gallon drums. 17(vi) Description of Work to be Performed: The
Contractor shall: (1) provide for a haul-away disposal service (to
include all supplies, labor (except for loading of drums onto the
Contractor's conveyance) transportation and equipment), for the
Directorate of Public Works at Fort Hood, Texas; (2) ensure all
absorbent materials are disposed of using approved methods of the Texas
National Resource Conservation Commission (TNRCC); (3) accept all drums
stored for transport, transport all drums to an authorized disposal
facility within the State of Texas, and return all Government owned
drums to the pickup location upon the next regularly scheduled pickup
date, after disposition of the absorbent material. Minimally, this
service will be provided on a bi-weekly basis (or as otherwise
required); (4) be responsible for providing the Government with all
appropriate Certificates of Destruction and/or Recycle (or equivalent
documents); (5) meet all pertinent Texas licensing requirements
relating to the proper transportation and disposal of
hazardous/nonhazardous waste/materials, as well as possession of a
valid TSD permit within the State of Texas (or appropriate
documentation that waste will be transported directly to a recycle
facility and not a storage facility. No materials will be transported
outside the State of Texas; (6) be held responsible for any cost
associated with spills or ground pollution that results from the
Contractor's transport, storage, reclamation or disposal. The
Contractor shall be similarly responsible for damages to persons or
property that occur as a result of negligence, and exercise proper
caution to preserve the health and safety of all individuals associated
with the performance of services under this contract. Any
subcontracting opportunities relating to the performance of this
contract will carry the same requirements set forth for the prime
contractor, and evidence of like qualifications will be provided to the
Government prior to any transportation of materials; (7) be responsible
for providing a legible copy of the Hazardous/Nonhazardous Waste
Manifest to the Environmental Management Office within 30 days after
the collection and transportation of waste. This manifest shall reflect
the total poundage collected and transported, and all other information
required for the completion of the Texas Annual Waste Summary and the
EPA Hazardous Waste Minimization Report. The government will furnish
all necessary TNRCC waste codes, and will properly notify the TNRCC of
these codes. Government personnel will be responsible for loading all
drums on the rear of the Contractor's conveyance. 17(vii) This
contract will become effective December 1, 1997 for a 12-month period
with pickups scheduled approximately bi-weekly for the duration of the
performance period. The FOB Point and acceptance is at the DPW
Classification Unit, Fort Hood, Texas.17(viii) FAR provision 52.212-1,
Instructions to Offerors -- Commercial, applies to this acquisition
with the following addenda: (a) There is no SF 1449 issued in this
matter -- potential offerors will need to respond by company
letterhead, or other identifying document. (e) Delete; (i) Delete.
17(ix) FAR provision 52.212-2 is not applicable to this acquisition.
The solicitation is issued with the intent of awarding a firm fixed
price contract without discussion, with evaluation being based on price
and price related factors. 17(x) Potential offerors must submit a
completed copy of the provision of FAR 52.212-3, Offeror
Representations and Certifications -- Commercial Items, with its offer.
Failure to do so will render the offer nonresponsive. 17(xi) FAR Clause
52.212-4, Contract Terms and Conditions -- Commercial Items, applies to
this acquisition, with the following addenda: (a)
Inspection/Acceptance: Delete the text as written, and insert: The
Contractor shall only tender for acceptance those services that conform
to the requirements of this contract. End of paragraph. (j) Risk of
Loss: Delete. (n) Title: Delete. (o) Warranty: Delete. (p) Limitation
of Liability: Delete. Liabilities of the Contractor are specifically
addressed in 17(vi) above. 17(xii) FAR Clause 52.212-5, Contract Terms
and Conditions Required to Implement Statutes or Executive Orders --
Commercial Items, applies to this acquisition, specifically: (b)(6)

contract will be via delivery order, and issued monthly; however,
individual pickup dates will be arranged randomly and as required by
the Government during the month. The Contractor will accept any and all
calls for pickup; however, the Contractor will not be required to
perform any services after 30 days from the issuance of the last
delivery order of the contract performance period. Generally, the
Government will not require more than one vehicle during any scheduled
