synopsis/solicitation for the commercial items prepared in accordance
with the format in FAR subpart 12.6 as supplemented with the additional
information included in this notice. This announcement constitutes the
only solicitation; proposals are being requested and a written
solicitation will not be issued. This solicitation, No. F02604-98-R0002
is issued as a Request For Proposal (RFP). This solicitation document
and incorporated provisions and clauses are those in effect through
Federal Acquisition Circular 97-2. This acquisition is unrestricted;
SIC: 7353; Size Std: $5 million dollars. All responsible sources may
submit a proposal which shall be considered. Item: Lease (basic year
plus two option years), with the option to purchase at end of lease
period each piece of equipment for $1.00 each. The proposal shall allow
for purchase of equipment at end of each option year or at anytime
during the lease period. Offerors shall provide in their offers monthly
breakouts of purchase options. The minimum needs of the government are
as follows: Contract Line Item (CLIN) 0001 ; three (3) New
Articulating Dump Trucks: D250 or equal, four wheel drive, limited slip
front and rear, 25 ton payload capacity, operating weight under 45,000
pounds empty, maximum overall height with dump bed down 12 feet high,
loading height over the side not to exceed 9 feet (empty), capable of
30 mph speed fully loaded on level ground, articulating steering that
offers maximum maneuverability, articulating/oscillating hitch design
that keeps all four wheels in contact with the ground on rough
terrain, self leveling hydraulically dampened suspension, 2 feet of
ground clearance with all critical drive-line components located above
the bottom of the frame, torque converter mounted retarder, rollover
protection system, frontal operating protection system sound proof cab
with tinted safety glass, filtered air for the operator and air
conditioning system using R-134A CFC free refrigerant, minimum fuel
capacity of 100 US gallons, mounting area for 2 way communication
system, electric starting receptacle (slave cable fixture) with NATO
standard connections capable of interconnection with 24 volt electrical
system, front and rear turn signals, rear brake lights, radiator guard,
26.5 radial tires (rock extra deep tread), vandalism protection, two
spare 26.5R radial tires (rock extra deep tread) and rims. CLIN 0002;
two (2) New Front End Loaders: Wheeled 950F series II or equal with
2.75 cubic yard clamshell and 4 cubic yard material buckets, air
conditioning with R-134A CFC free refrigerant, exterior mounted mirrors
and directional lights, ether starting aid, power-train and crankcase
guards, ride control system, must be capable of 25 mph speeds on level
terrain, trash resistant radiator, adjusting pallet forks, high
ambient cooling, mirrors, 23.5 -- 26 16 ply L-5 tires (rock extra deep
tread), ride control, payload measurement system, signal lights,
crankcase guard, limited slip differentials, 3rd valve hydraulics,
electric starting receptacle (slave cable fixture) with NATO standard
connections capable of interconnection with 24 volt electrical system,
baldson or equal quick coupler installed, 48" balderson or equal
forks, and two spare 23.5 -- 26 16 ply L-5 tires (rock extra deep
tread) and rim assemblies. Lease shall include a maintenance plan :
Maintenance Requirements: A long term maintenance package to include
all minor and major vehicle repairs is required at no additional cost
to the Government during the lease period. Additionally all lubricants,
inspections, tire exchanges must be on site and within 24 hours of
call. On site maintenance is required. Warranty maintenance program
shall be employeed during lease period. Towing or recovery of broken
vehicles shall be included at no additional cost. Desired delivery: 56
days after receipt of award. FOB: Gila Bend AFAF, Gila Bend AZ. The
provisions of FAR 52.212-1, INSTRUCTIONS TO OFFERORS -- COMMERCIAL
ITEMS, Reference FAR 52.212-1 para (c) is hereby tailored as follows:
(a) Period for acceptance of offers. The offeror agrees to hold the
prices in its offer firm for 90 calendar days from the date specified
for the receipt of offers. Reference FAR 52.212-1 para (b) is hereby
tailored as follows: (b) Submission of offers. A. Purpose: These
instructions are designed to ensure the submission of information to
provide for the understanding and comprehensive validation of the
proposal. Offerors are cautioned to follow the detailed instructions
fully and carefully, as the government reserves the right to make an
award based on initial offers received without discussion of such
offers. B. Proposal Contents: The proposal shall consist of two
volumes, divided, tabbed, and indexed. The title, and contents shall be
defined as follows: Volume I, Solicitation Documents, Lease
Proposal/commercial lease agreement, and Past Performance Information;
Volume 2, Price Proposal and Executed Documents. (1) Volume 1: (a) All
solicitation documents not otherwise assigned to a volume and section
of the proposal are to be placed in sequence at the beginning of Volume
1. Any solicitation documents requiring the contractor to complete
and/or certify shall be included in the proposal according to the
instructions that follow. (b) The lease proposal shall contain
sufficient information to enable the evaluator to make a complete
analysis of the proposal with respect to the evaluation criteria
specified in section FAR 52.212-2 Evaluation-Commercial Items. All
available information pertaining specifically to those criteria should
be included, as well as any other information the offeror feels would
demonstrate their ability to accomplish the project. (c) Past
Performance information is to be supplied and should contain
information as to similar lease/purchase agreements. This information
at a minimum shall include contract numbers, point of contacts,
addresses, and dollar amount of agreements. (2) Volume 2: (a) The price
proposal shall contain sufficient information for the government to
make a determination of fairness and reasonableness of price and be
accompanied by a current financial statement and evidence of available
operating capital to be used for the performance of the contract. The
information should be sufficient to allow the government to perform a
price analysis -- prices on other similar lease agreements should be
submitted with offer. (b) Executed Documents: Offerors shall include
with the submission of their offer a completed copy of the provision at
FAR 52.212-3 Offeror Representation and Certifications -- Commercial
Items to be included in this part and shall contain the signed original
contract documents. Disposition of Proposals: After contract award,
unsuccessful proposals will be disposed of as follows: one copy will be
retained with the contract file, the additional copies will be
destroyed. No destruction certificate will be provided. Formal
Communications: Formal communications such as request for clarification
and/or information concerning this solicitation should be submitted in

ITEMS (a) The Government will award a contract resulting from this
solicitation to the responsible offeror whose offer conforming to the
solicitation will be most advantageous to the Government, price and
other factors considered. The following factors shall be used to
evaluate offers: (1) Price, (2) Lease Proposal, (3) Past Performance
and Experience. (i) PRICE PROPOSAL: The price proposal will be
evaluated for fairness and reasonableness. Award will be made to the
lowest evaluated offer that meets all the mandatory criteria in the
solicitation. (ii) LEASE PROPOSAL: Proposal acceptability will be
measured against the following criteria, all criteria are of equal
importance: (A) Criteria 1. Understanding of Contract Requirements; To
ensure that the offeror fully understands the requirements of the
minimum needs of the Government outlined in CLIN 0001 and 0002, the
offeror must explain in detail how they will satisfy those
requirements. (B) Criteria 2. Provide commercial literature on
equipment proposed and a explanation of any features that do not comply
with the requirements in the solicitation. (C) Criteria 3. Explain how
the on-site maintenance and repair requirements will be satisfied, to
include response time for major and minor repairs. (iii) PAST
PERFORMANCE / EXPERIENCE Past performance information, to include
recent (defined as within the past 3 years) and relevant contracts for
the same or similar items and other references (including contract
numbers, points of contact with telephone numbers and other relevant
information). (b) Options. The Government will evaluate offers for
award purposes by adding the total price for all options to the total
price for the basic requirement. The Government may determine that an
offer is unacceptableif the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the
option(s). (c) A written notice of award or acceptance of an offer,
mailed or otherwise furnished to the successful offeror within the time
for acceptance specified in the offer, shall result in a binding
contract without further action by either party. Before the offer's
specified expiration time, the Government may accept an offer (or part
of an offer), whether or not there are negotiations after its receipt,
unless a written notice of withdrawal is received before award. The
