Protection Agency (EPA) and the Thea Foss/Wheeler Osgood Waterways
Participants Group have initiated an alternate dispute resolution
process. The process will help resolve Potentially Responsible Parties'
(PRPs) liability under the federal and state "Superfund" laws for costs
associated with cleaning up contaminated sediments in the Thea
Foss/Wheeler Osgood Waterways, located within the Commencement Bay
Nearshore/Tideflats Superfund site near Tacoma, Washington. The Foss
Participants Group is seeking proposals from consultants or consultant
teams to serve as a cost allocator for the project. The cost allocator
is a neutral third party whose role it is to recommend a percentage
share of responsibility for the response costs for approximately 70 to
100 parties. The report produced by the cost allocation process will
serve as the basis for negotiating a settlement agreement with EPA. The
period of performance will be March through December 1998. Qualified
consultants and consultant teams shall have legal and technical
experience in conducting, multi-party liability assessments under the
Comprehensive Environmental Response, Compensation and Liability Act
(CERCLA). Preferably, the candidate will have experience with CERCLA
allocations in contaminated sediments media or in media that exhibit a
mixed harm and multi source character. Evaluation criteria will
include: (1) Capability to assess legal issues, particularly CERCLA
statutory liability and current case law interpretation of that
liability; (2) Capability to assess complex technical material
involving chemistry, hydrology, hydrogeology and geochemistry; (3)
Capability to assess historical activities that may have contributed to
response costs; (4) Experience with multi-party cost/liability
allocation processes; (5) Experience with cleanup issues, preferably
multiple source sediment cleanup; (6) No conflict of interest with Thea
Foss Waterway parties; willingness to disclose relationships; (7)
Ability to start March 1st and provide full-time support from key
persons through end of 1998. Proposals shall be limited to 25 pages on
81/2 by 11" paper. Resumes for proposed personnel should be included
and are outside the page limitation. The following items shall be
included in the proposal: (1) Firm/team profile and summary of key
personnel experience; (2) Project approach and schedule; (3) References
with phone numbers; (4) Billing rates and proposed total cost A copy of
