synopsis/solicitation for commercial items prepared in accordance with
the format in Subpart 12.6, as supplemented with additional
information included in this notice. This announcement constitutes the
only solicitation; NIST requests quotes but will not issue a request
for quotes. Federal Acquisition Circular 97-03 applies to this
acquisition. The National Institute of Standards and Technology (NIST)
intends to acquire one diode-pumped solid state laser, CLIN 0001. The
laser shall have the following capabilities: greater than 12W of CW
(TEM00, M2 of less than 1.2) output power at 1064 nm, less than 0.2%
rms optical noise, less than five GHz line width, operates on 110/220V
ac (20A), no external cooling water required, complete system includes
power supply, closed loop chiller, and remote control, one year
warranty on the full system for all parts and labor. CLIN 0002: one
standard operating manual included with laser documentation. The
contractor shall deliver this equipment within forty-five (45) days
from the date of award of the purchase order. During the warranty
period, the instrument shall be warranted against failure of all
components, except consumable items that the contractor shall list in
the documentation. Spare parts for the system shall be made available
to the NIST for a period of not less than five (5) years from the
system's last production date. Anticipated award date is April 21,
1998. SIC code is 3826. The small business size standard for this SIC

The provision at FAR 52.212-1, Instructions to Offerors -- Commercial,
applies to this acquisition. FAR 52.212-2 Evaluation-Commercial Items,
applies to this acquisition. The NIST will issue a purchase order to
that responsible quoter whose quote conforming to the solicitation will
be most advantageous to the NIST, price and other factors considered.
The NIST will use the following factors, listed in descending order of
importance, to evaluate quotes: A. PAST PERFORMANCE: The quoter shall
identify at least three separate parties who have used the laser over
the past year. The NIST will randomly select references from the list
provided in the quote and ask questions which will result in the
collection of information regarding the following areas: 1. Technical
capabilities, 2. reliability of hardware and software, 3. Ease of
software use, and 4. Technical support for problem solving. B.
TECHNICAL EXCELLENCE: Capability of the item(s) offered to meet the
NIST's need. The NIST will assign additional points to the degree which
the quote exceeds the minimum requirements. Past performance and
technical excellence, when combined, are significantly more important
when compared to price. However, price may increase in importance as
quotes approach technical equality. Quoters shall include a completed
copy of the provision at 52.212-3, Offeror Representations and
Certifications-Commercial Items,with its offer. The clause at 52.212-4,
Contract Terms and Conditions Commercial applies to this acquisition.
The clause at 52.212-5, Contract Terms and Conditions Required to
Implement Statutes or Executive Orders -- Commercial Items, applies to
this acquisition and includes the following FAR clauses: FAR
