This procurement is being conducted under the Simplified Acquisition Procedures (SAP). NASA/HQ intends to purchase the items from Microsoft Corporation. Only one responsible source 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). Microsoft Corporation is the only technology which has the software maintenance support as provided in the Premier Support Agreement available only from the Microsoft Corporation. Also, Microsoft Corporation has not authorized any third parties to provide Premier Software Support Services for its proprietary software. ] The Government intends to acquire a commercial item using FAR Part 12.See Note 22.
