appeared in the Commerce Business Daily on Wednesday, March 11, 1998 is
hereby issued a fifth amendment. The purpose of the fifth amendment is
to respond to technical and contracting questions submitted to the FBI
from various vendors. Please note that the specifications listed in the
synopsis/solicitation are only minimum requirements and the FBI is in
need of a commercial item turn-key system. No further questions will be
accepted. The due date has been extended to April 10, 1998 at 12 noon
EST. SOFTWARE ISSUES 1. Microsoft Windows95 /WindowsNT --
Clarification: Where "WindowsNT" is cited in this RFQ, the FBI defines
it as the client version, known commonly as WindowsNT Workstation. --
Clarification: A minimum of 900 users would need to be supported by
either Microsoft Windows95 or WindowsNT Workstation, dependent on how
the FBI orders the proposed systems. The requirement is for the offeror
to propose a system(s) certified with either Microsoft Windows95 or
WindowsNT Workstation. The FBI will determine the actual configuration
after award and at time of order. An example of how to price this
would be to propose the standard system configured with Microsoft
Windows95 and then price a separate Contract Line Item Number (CLIN)
for upgrading to WindowsNT Workstation at time of order. 2. Additional
Software -- Clarification: In addition to Microsoft Windows95 or
WindowsNT Workstation, the FBI requires that, following award, all
driver software be delivered with each system ordered after award, in
a CD-ROM media format. The only software the awardee will be
responsible to load is the selected operating system, as selected at
time of order, in order to deliver a fully operational turnkey system.
3. Software Used In The Test Bed Process -- Clarification: The FBI
will provide all application software for use in the test bed process.
However, the proposed system is expected to be delivered with
Microsoft Windows95 loaded for the purposes of the test bed evaluation.
4. Software/Regulatory Certifications -- Clarification: The FBI
recognizes that the certification process by various software
manufacturers and regulatory agencies can be a lengthy and involved
procedure. Therefore, the FBI will accept a proposed commercial item
system(s) that is Microsoft Windows95, Microsoft WindowsNT Workstation,
and Novell Netware 4.1 certified prior to the installation of the
Racore Fiber Optic Token Ring Network Interface Card Model M8158. The
FBI will also accept a proposed commercial item system(s) that is FCC
Class B, Year 2000 (Y2K), EnergyStar, and IEEE 802.5J compliant prior
to the installation of the Racore Fiber Optic Token Ring Network
Interface Card Model M8158. The FBI will not accept a proposed
commercial item system(s) if it does not meet these requirements prior
to the installation of the Racore Fiber Optic Token Ring Network
Interface Card Model M8158. Further, it is expected that the awardee
will seek to acquire all necessary software certification and
regulatory compliance (with the exception of EnergyStar) of their
proposed commercial item system(s) after award in a configuration
inclusive of the Racore Fiber Optic Token Ring Network Interface Card
Model M8158. This must be completed within 120 days after award, unless
other terms need to be negotiated between the Awardee, the software
manufacturer or regulatory agency, and the FBI. CONTRACTUAL ISSUES:
DELIVERY ISSUES 1. Method of Delivery -All turn-key systems shall be
delivered via the normal commercial method. 2. Partial Shipments
-Partial shipments will not be allowed. 3. Shipping Locations -- For
the purposes of pricing shipping charges, the initial quantity should
be distributed as equally as possible to the capital city in each of
the fifty states and Puerto Rico. 4. Shipping Time Frame -All turn key
systems, both of the initial order and additional orders, shall be
delivered within thirty days from the date of the order. INVOICING 1.
Payment Method -The FBI shall issue payment via electronic funds
transfer or check, whichever is the preferred commercial method. 2.
Software License Numbers -- For the purposes of invoicing it is
required that any software license numbers be included on each invoice
in order to provide FBI customers with requisite information necessary
if customer support is required from the OEM. BUSINESS SIZE
CLASSIFICATION 1. Small Business Size Classification -All company size
classifications, for the purposes of Government contracting, may be
obtained directly from the Small Business Administration (SBA). This
RFQ is open for bid to both SBA classified small and large businesses.
Companies need not be registered in Washington DC. TYPE OF CONTRACT TO
BE AWARDED 1. Award Type -The FBI intends to issue a Blanket Purchase
Agreement for this acquisition in the amount of five million dollars.
The initial purchase will be in the amount of nine hundred turn key
systems. Additional orders will be placed on a per system basis
as-needed. 2. Contract Method -Vendors are free to provide price quotes
on an open market, GSA Schedule, GWAC, or by any other commercial
means. 3. Standard Industrial Classification (SIC) Code -The SIC for
this RFQ, 3571 Electronic Computers, does not exclude "Tier 1" PC
Manufacturers from participating in this bid. CONTRACT AWARD 1. Planned
Award Date -The approximate award date for this RFQ is April 28, 1998.
2. FAR Clauses -- All parts of the FAR clauses listed in the RFQ are
applicable. -- FAR Part 34 does not apply to this acquisition. -- FAR
Part 12 takes precedence over other FAR Parts in this solicitation. 3.
Basis for Award -- Award shall be based on the lowest priced (based on
per system cost), technically acceptable offer {FAR 13.106-2(b)}. 4.
Past Performance Evaluation -- The proposal will be evaluated on the
degree of customer satisfaction with the previous performance of the
Contractor, the degree of effectiveness of the Contractor in managing
and directing resources and in demonstrating reasonable and cooperative
behavior in dealing with customers, the degree of quality of previously
offered services, the degree of quality of the Contractor's previous
cost control activities and the degree of timeliness of previous
service and product delivery. -- If the offeror does not have a past
performance history, the history of its parent organization or
subcontractors may be considered. The adequacy and extent of
information provided will be considered. In the absence of any past
performance history, the offeror will be given a neutral rating. The
Government is not restricted in its evaluation of past performance to
the information submitted by the offeror. Any additional information
independently gathered by the Government may be used in its evaluation
