study, which evaluates the operational functions performed by the Write
Your Own (WYO) companies selling and servicing flood insurance and
their associated costs, and determine if there is a more cost effective
way to compensate them. The successful contractor will be required to
identify, collect and analyze data on the operational functions
involved in selling and servicing flood insurance, including the five
lines of insurance that are the basis for the WYO expense allowance,
and the National Flood Insurance Program bureau services provided to
WYO companies and their associated costs. The selected firm will also
be required to identify and evaluate alternative approaches for
compensating the WYO companies. Furthermore, the Contractor shall
evaluate alternatives and suggest an approach, which is compatible with
the requirements of the federal antitrust laws and the exemptions
provided by the McCarran-Ferguson Act, for the Federal Insurance
Administration (FIA) to work with the companies on an alternative
compensation method. In addition, the Contractor will also support FIA
as it works with representative WYO companies and others to agree on
a compensation method. The study will be conducted in two phases. Phase
I will include the data gathering, analysis, and evaluation of
alternative compensation methods, while Phase II will include the
supporting of FIA as it works with the WYO companies and others to
agree on a compensation method and submission of a final report. All
