Q -- PHARMACIST SERVICES AT FEDERAL CORRECTIONAL INSTITUTION, SHERIDAN, OREGON SOL RFQ 230-0024-8 DUE 051498 POC Christina Brown, Contract Specialist, 503.843.4442 ext. 263 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. This solicitation document is issued as Request for Quotation (RFQ) 230-0024. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-04. This solicitation is 100% SBSA. The SIC is 8099 with size standard 5.0 million; NAICS U.S. is 621999. (A) Schedule: The contractor will provide pharmacist services for FCI Sheridan. These services may be provided by one or two contract pharmacists, depending upon Government need. Please provide a price per session, as defined in the Schedule, for each the Base Period and one 1-year option period. The primary contract pharmacist will perform approximately 20 sessions per month during the base and option periods. The secondary contract pharmacist will perform approximately one session per fiscal quarter during the base and option periods. Period of performance: Base Period: 06/01/98 or date of award, whichever is later, through 09/30/98; Option Period One: 10/01/98-09/30/99. The Government will award a firm fixed price requirements contract from this solicitation; there is no guaranteed minimum number of sessions. Pursuant to: (i) FAR 17.203(d), offerors may offer varying prices for options; (ii) FAR clause 52.217-8, Option to Extend Services, the Contracting Officer may exercise the option by written notice to the Contractor within 15 days prior to contract expiration; (iii) FAR clause 52.217-9, Option to Extend the Term of the Contract, the Government may exercise the option to extend the term of the contract within one day of the ensuing option period; (iv) FAR 17.203(b), evaluation for award will be inclusive of options offered. (B) Scope of Work (SOW): This contract will include providing the following services: daily preparation/verification of prescriptions; ordering medications from required sources and maintaining/ordering pharmacy supplies; dispensing supplies to other areas of the Health Services Unit (HSU); dispensing/administering prescribed medications; keeping pharmacy and store room clean and notifying HSU administrative personnel of any structural/utility problems; counting/maintaining correct counts of narcotics, needles and syringes (excluding narcotics in the main safe); maintaining pharmacy logs and check sheets; and providing educational information/materials to the patients per BOP and Institutional policies/procedures. Pharmacists must become proficient in all BOP and Institutional policies and procedures relating to the provision of pharmacy services. All medical records remain the property of the BOP. Pharmacists must be able to fill at least 15 prescriptions per hour. Evidence of ability to meet the requirements of this SOW is required as part of the offeror's technical proposal. (i) Place of performance is the Federal Correctional Institution at 27072 Ballston Road, Sheridan, Oregon 97378. (ii) The schedule will normally consist of five (5) sessions per week. A session is defined as EIGHT (8) hours of service time performed by an individual pharmacist. Sessions lasting more than 8 hours or less than 8 hours will be pro-rated accordingly in increments of one hour. Sessions normally take place Monday through Friday, excluding Government holidays, from 7:30 a.m. to 4:00 p.m., which includes a 30 minute unpaid lunch break. Services will be scheduled by the HSA or his designee. All hours worked must be documented on a "Log of Consultants Visit" form within the HSU with each entry being completed and signed by the contractor. (iii) All equipment, supplies, and materials that the contractor may routinely need to perform the services covered under this contract will be provided by the Government. (iv) Each pharmacist providing services under the contract must be a graduate of a college of Pharmacy accredited by the American Council of Pharmaceutical Education and must be a registered pharmacist in the state of Oregon. Documentation of these requirements must be submitted with offeror's proposal. (v) The services provided, being professional in nature, will be provided in the method as considered normal in the local community. These services, although not directly supervised, will be reviewed by a pharmacist on staff of the FCI HSU and the performance of these services will be verified by the designated COTR. Award of the contract will result in a nonpersonal health care services contract; the Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical, professional aspects of services rendered; the contractor will indemnify the Government for any liability producing act or omission by the contractor, its employees and agents occurring during contract performance; the contractor willmaintain medical liability insurance, in an amount which is not less than the amount normally prevailing within the local community of Sheridan, Oregon, for Pharmacist Services; the contractor is required to ensure that its subcontracts for provisions of health care services, contain the requirements of the clause at 52.237-7, including the maintenance of medical liability insurance. Award of the contract will result in a contractual arrangement only and shall not be construed as a personnel appointment with the BOP. Payment shall be based on the accomplishment of an end product or specified result, and the results to be obtained shall be entirely within the Contractor's own unsupervised determination. Award of the contract will not create an employer/employee relationship; accordingly, entitlement and benefits applicable to such a relationship will not apply. Payments under any forthcoming contract will not have provisions for state, municipal, or federal withholding taxes, nor will payments be subject to the Federal Insurance Contributions Act. It will be the contractor's responsibility to report all earnings to the appropriate revenue service for tax purposes. (Note: Federal agencies are required to report all payments to a contractor to the Internal Revenue Service.) The selected contractor is not entitled to unemployment compensation benefits under the Social Security Act, as amended, by virtue of performance under any forthcoming contract. The selected contractor agrees to comply with the Privacy Act of 1974 and the rules and regulations issued pursuant to the Act in the performance of the services required by any forthcoming contract. The selected contractor shall, without additional expense to the Government, be responsible for obtaining all necessary licenses and permits and for complying with any applicable federal, state, and municipal laws, codes and regulations in connection with the performance of the work. Proper safety and health precautions shall be taken to protect the work, staff and inmates, the public, and the property of others. Performance of services will require frequent and unsupervised contact with inmates. Interaction with inmates will be limited to pharmacist services and instructions only. Contractor will adhere to all regulations prescribed by the institution for safety, custody, and conduct of inmates. The contractor must attend a contractor training course provided by the Government on a Saturday. (C) Clauses/Provisions: (I) FAR provision 52.212-1, Instructions to Offerors -- Commercial Items, is hereby incorporated by reference. The following are addenda to FAR Clause 52.212-1: (1) Paragraph (c) "Period of Acceptance of Offers," the amount of time the offeror agrees to hold the prices in its offer firm is changed to 60 calendar days from date specified for receipt of offers. (2) Paragraph (e) "Multiple Offers," has been determined by the Contracting Officer to be non-applicable to this solicitation and is hereby removed in its entirety. (3) Evaluation Factors for Award: Offerors are advised that the Government intends to evaluate offers and award a contract without discussions with offerors. Award will be made to the responsible offeror whose quote is responsive to the items of the RFQ and is the best value to the Government in terms of trade-off between price and technical merit. The Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. (II) The following provisions are hereby incorporated as an addendum to FAR Clause 52.212-1, pursuant to FAR Provision 52.252-1, Solicitation Provisions Incorporated by Reference: 52.204-6 Contractor Identification Number-Data Universal Numbering System (DUNS) Number; 52.215-18, Facsimile Proposals, Fax 503.843.7623; 52.217-5 Evaluation of Options. (III) FAR provision 52.212-3, Offerors Representations and Certifications-Commercial Items, shall be completed and submitted with the offer. (IV) FAR clause 52.212-4, Contract Terms and Conditions-Commercial Items, is hereby incorporated by reference. The following FAR Clauses are hereby incorporated by reference, pursuant to FAR Clause 52.252- 2, Clauses Incorporated by Reference: 52.216-21, Requirements; 52.217-8, Option to Extend Services; 52.217-9, Option to Extend the Term of the Contract (written notice must be provided to the Contractor within one day of the ensuing option period; total duration of this contract, including exercise of any options under this clause, shall not exceed 1-1/2 years); 52.219-6, Notice of Small Business Set-Aside; 52.232-19 Availability of Funds for the Next Fiscal Year (September 30, 1998); 52.237-3, Continuity of Services; and 52.237-7, Indemnification and Medical Liability Insurance. The following JAR Clause is hereby incorporated by addenda: 2852.270-70, Contracting Officer's Technical Representative, (a) Captain Jim Manning, HSA, HSU, FCI Sheridan, 27072 Ballston Road, Sheridan, Oregon 97378, (503) 843-4442 ext. 265, is hereby designated to act as Contracting Officer's Technical Representative (COTR) under this contract. (b) The COTR is responsible, as applicable, for: receiving all deliverables, inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual Scope of Work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment prior to forwarding the original invoice to the payment office and a conformed copy to the Contracting Officer. (c) The COTR does not have the authority to alter the contractor's obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If as a result of technical discussions it is desirable to alter/change contractual obligations or the Scope of Work, the Contracting Officer shall issue such changes in writing and signed. (V) FAR clause 52.212-5,Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items is hereby incorporated by reference. In accordance with FAR clause 52.212- 5, the following clauses are hereby incorporated by reference in paragraph (b): 52.222-26 Equal Opportunity (E.O. 11246), 52.222- 35, Affirmative Action for Special Disabled and Vietnam Era Veterans (38 U.S.C. 4212), 52.222-36, Affirmative Action for Handicapped Workers (29 U.S.C. 793), 52.222-37, Employment Reports on Special Disabled Veterans and Veterans of the Vietnam Era (38 U.S.C. 4212). The following terms and conditions are hereby incorporated: Contract Security/Investigative Requirements-Human Resource Management Manual (BOP P.S. 3000.02): All personnel performing under this contract will be subject to the following security requirements: National Crime Information Center (NCIC) Check; Name Check; FD-258 Fingerprint Check; Law Enforcement Agency Checks; Vouchering of employers over the past five years; Completed OF-306, Declaration for Federal Employment, and Appropriate Resume or Optional Application; Completed Contractor Pre-employment Form; Release of Information; Urinalysis test for detection of Marijuana and other drug usage; positive test disqualifies applicant. By submitting an offer and by signing the contract document, the contractor hereby agrees to ensure that all individuals providing services under the contract will complete the required documents and undergo the listed procedures. Any employee of a contractor who does not pass the security clearances will be unable to provide services under the contract. If contract award is to an individual, as opposed to a medical services management type of enterprise, security clearances must be obtained before contract award can be made. If award is made to a medical services management type of enterprise, the individual provided by the company must receive security clearances before he/she can perform under the contract. The final determination and completion of the security investigation procedures will be made at the sole discretion of the BOP.
