This is a combined synopsis/solicitation for commercial items prepared
in accordance with the format in Federal Acquisition Regulation (FAR)
12.6, as supplemented with additional information included in this
notice. The announcement constitutes the only solicitation;
proposals/bids are being requested and a written solicitation will not
be issued. This solicitation is being used as a Request for Quotation
(RFQ)80138, the provisions and clauses incorporated. This solicitation
is under the Simiplified Acquisition Procedures (SAP) FAR Subpart 13,
including the Test Program. The Standard Industrial Classification
(SIC) Code 3663. This will be a Firm-Fixed Price, "Brand Name or Equal"
solicitation for 160 Digital Audio Broadcast Network Transceiver with
Audio Processing Technology, Inc., 6255 Sunset Blvd., Suite 1025, Los
Angeles, CA 90028. The equipment must meet or exceed the following
salient characteristics: uses APTX-100 compression technology, a R232
port which can be enable for the connection of auxiliary data rates of
up to 9600 baud, audio input and output level adjusts, approximately
a 12 dBm audio dynamic adjust range, a DIP switch selectable 600 ohm
input and output impedance adjust, network audio backup feature and 2
year parts and labor warranty. The above listed characteristics are
intended to be descriptive, but not restrictive. Unless clearly marked
that the vendor is quoting on an "equal" the offered item shall be
considered as the brand name product referenced in this announcement.
If the vendor proposes to furnish an "equal" product, the brand name,
if any, of the product to be furnished shall be inserted on the
proposal. The evaluation of quotations and the determination as to
equality of the product shall be the responsibility of the government
and will be based on information furnished by the vendor. The
purchasing activity is not responsible for locating or securing any
information which is not identified in the quotation and reasonably
available to the purchasing activity. To insure that sufficient
information is available, the vendor must furnish, as a part the
quotation, all descriptive material (such as cuts, illustrations,
drawings, or other information) necessary for the purchasing activity
to determine whether the product meets the salient characteristics of
the requirement. If the vendor proposes to modify a product so as to
make it conform to the requirements of the announcement it shall
include a clear description of such proposed modifications and clearly
mark any descriptive material to show the proposed modifications. The
provisions at FAR 52.212-1, Instruction to Offerors-Commercial Items
(Oct 1995) shall apply. The following addendum to FAR 52.212-1 shall
apply: Paragraph (h) Multiple Awards-Delete entire paragraph. The
Government plans to award a single contract resulting from this
solicitation. The provisions at FAR 52.212-2 Evaluation-Commercial
Items (Oct 1995) shall apply. Addendum 52.212-2 Paragraph (a) the
Government will award a contract resulting from this solicitation which
will be most advantageous to the Government, price and other factors
considered shall apply. The following factors shall be used to evaluate
offers: Technical Capabilities and Price in descending order of
importance. The provisions at FAR 52-212-3 Offeror Representations and
Certifications -- Commercial Items ( June 1996) shall apply.
Representations and Certifications must accompany each offer and can be
obtained via the Internet at http://www.far.npr.gov. FAR Clauses
52-212-4 Contract Terms and Conditions-Commercial Items (Oct 1995), the
warranty shall be one year from acceptance of equipment. The following
FAR Clauses in paragraph (b) of FAR 52.212-5 Contract Terms and
conditions required to Implement Statutes or Executive Order --
Commercial Items (August 1996) will apply to the resultant contract:
52.203-6, 52.203-10, 52.219-6, 52.219-8, 52.219-14, 52.222-26,
52.222-35, 52.222-36, 52.222-37, 52.225-3, 52.225-8, 52.225-9. All bids
