synopsis/solicitation for commercial items prepared in accordance with
the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as
supplemented with additional information included in this notice. This
announcement constitutes the only solicitation; offers are being
requested and a written solicitation will not be issued. (II) This
solicitation document is issued as Request for Quotation (RFQ)
230-0023. (III) This solicitation document and incorporated provisions
and clauses are those in effect through Federal Acquisition Circular
97-04. (IV) This solicitation is 100% SBSA. The SIC is 3541 with a size
standard of 500 employees and the NAICS United States is 333512. (V)
The items called for by this RFQ have been identified by a brand name.
Offers for an equal product (including a product of the brand name
manufacturer other than the one described) will be considered for award
per Justice Acquisition Regulations (JAR) Clause 2852.211-70. Contract
Line Item Number (CLIN) 0001: 1 each, Zimmerman Metals, Inc., Z-Panel
Adjustable Roll Former (commercial roof panel machine). The machine
provided must meet the following minimum salient characteristics: forms
panels in any width from 12" through 24"; forms profiles from 1" snap
lock to 2" mechanically seamed; processes materials up to 22 ga.;
processes 55 to 65 feet per minute; hydraulic guillotine shear; hand
held remote controls; 13 to 15 horsepower diesel powered engine;
portable on tandem axle trailer with electric brakes; minimum 90 day
warranty; CLIN 0002: 1 each, 50 foot variable height run-out stands;
CLIN 0003: 1 each, vinyl machine cover; CLIN 0004: 1 each, expandable
spool upgrade; CLIN 0005: 1 session, on-site training of FCI Sheridan
staff in usage of the machine sufficient to ensure the safe operation
of the machine by said staff members; CLIN 0006: 1 year, maintenance
agreement for repairs on equipment to be effective upon expiration of
warranty and to include a 24 hour service response time; CLIN 0007: 1
each, technical reference materials for all applicable line items. (VI)
The successful offeror shall provide delivery of all items with 30 days
of date of award. (VII) Delivery hours are 8:00 a.m. to 10:30 a.m. and
11:00 a.m. to 3:00 p.m., local time, Monday through Friday, excluding
Government holidays. (VIII) FAR provision 52.212-1, "Instructions to
Offerors -- Commercial Items," is hereby incorporated by reference. The
following are addenda to FAR Clause 52.212-1: (1) Paragraph (c) "Period
of Acceptance of Offers," the amount of time the offeror agrees to hold
the prices in its offer firm is changed to 60 calendar days from date
specified for receipt of offers. (2) Evaluation Factors for Award:
Offerors are advised that the Government intents to evaluate offers and
award a contract without discussions with offerors. Award will be made
to the responsible offeror whose quote is responsive to the items of
the RFQ and is the best value to the Government in terms of trade-off
between price and technical merit. Therefore, the offeror's initial
offer should contain the offeror's best terms from a price and
technical standpoint. However, the Government reserves the right to
conduct discussions if later determined by the Contracting Officer to
be necessary. The Government may reject any or all offers if such
action is in the public interest; accept other than the lowest offer;
and waive informalities and minor irregularities in offers received.
The following provision is hereby incorporated into this solicitation
and resulting contract as an addendum to FAR Clause 52.212-1, pursuant
to FAR Provision 52.252-1, "Solicitation Provisions Incorporated by
Reference": 52.215-18, "Facsimile Proposals" (503)843-7623. (IX) FAR
provision 52.212-3, "Offerors Representations and Certifications --
Commercial Items," shall be completed and submitted with the offer. (X)
FAR clause 52.212-4, "Contract Terms and Conditions -- Commercial
Items," is hereby incorporated by reference. The following FAR Clauses
are hereby incorporated by reference, pursuant to FAR Clause 52.252-
2, "Clauses Incorporated by Reference": 52.219-6, Notice of Small
Business Set-Aside and 52.232-18, Availability of Funds. The following
JAR Clause is hereby incorporated by addenda: 2852.211-70 Brand-Name
or Equal (a) The terms "bid" and "bidders", as used in this clause,
include the terms "proposal" and "offerors". The terms "invitation for
bids" and "invitational", as used in their clause include the terms
"request for proposal" and "request". (b) If items called for by this
invitation for bids have been identified in the schedule by a "brand
name or equal" description, such identification is intended to be
descriptive but not restrictive, and is to indicate the quality and
characteristics of products that will be satisfactory. Bids offering
"equal" products (including products of a brand name manufacturer other
than the one described by brand name) will be considered for award if
such products are clearly identified in the bids and are determined by
the Government to meetfully the salient characteristics and
requirements listed in the invitation. (c) Unless the bidder clearly
indicates in his/her bid that he/she is offering an "equal" product,
his/her bid shall be considered as offering the brand name product
referenced in the invitation for bids. (d)(1) If the bidder proposes to
furnish an "equal" product, the brand name, if any, of the product to
be furnished shall be inserted in the space provided in the invitation
for bids, or such product shall be otherwise clearly identified in the
bid. The evaluation of bids and the determinations to equality of the
product offered shall be the responsibility of the Government and will
be based on information furnished by the bidder or identified in
his/her bid as well as other information reasonably available to the
purchasing activity. To ensure the sufficient information is available,
the bidder must furnish as a part of his/her bid all description
material (such as cuts, illustrations, drawings, or other information)
necessary forthe purchasing activity to: (i) determine whether the
product offered meets the salient characteristics requirements of the
invitation for bids, and (ii) established exactly what the bidder
proposed to furnish and what the Government would be binding itself to
purchase by making an award. The information furnished may include
specific references to information previously furnished or information
otherwise available to the purchasing activity. (2) If the bidder
proposes to modify a product so as to make it conform to the
requirements of the invitation for bids, he/she shall: (i) include in
his/her bid a clear description of such proposed modification, and (ii)
clearly mark any description material to show the proposed
modifications. (3) Modifications proposed after the bid opening to make
a product conform to a brand name product referenced in the invitation
for bids will not be considered. (XI) FAR clause 52.212-5, Contract
Terms and Conditions Required to Implement Statutes or Executive Orders
-- Commercial Items is hereby incorporated by reference. In accordance
with FAR clause 52.212- 5, the following clauses are hereby
incorporated by reference in paragraph (b): 52.222-26 Equal Opportunity
