LAKE MITCHELL SPILLWAY REPAIRS ADVERTISEMENT FOR BIDS Notice is hereby given that the City of Mitchell, South Dakota will receive sealed competitive bids for construction of repairs to the Lake Mitchell Spillway. The Bids must be prepared on bid forms supplied in the Bidding Documents and filed with the Municipal Finance Officer, Mitchell City Hall, 612 North Main Street, Box 278, Mitchell, South Dakota 57301-0278 not later than 1:30 p.m. Local Time, June 19, 1998, at which time and place all Bids will be publicly opened and read aloud in the presence of Bidders and their representatives. No bids will be received after the specified hour and date, and bids which are not prepared and filed in accordance with the "Instructions to Bidders" may be rejected. All Bids must be accompanied either by a certified check, cashier's check or bank draft payable to the City of Mitchell, S.D. in the amount of 5 percent (5%) of the total sum of the Bid, drawn on a State or National Bank, or by a Bid Bond in an amount of ten percent (10%) of the total Bid issued by a Surety authorized to do business in the State of South Dakota, said Bond to be made payable to the City of Mitchell, S.D. The check or bond will be retained by the Owner as liquidated damages if the successful Bidder refuses or fails to enter into a contract, performance bond and payment bond in accordance with the Bid when notified of the award. The proposed Construction Contract, together with the Plans and Specifications for the construction work, may be seen at the office of the Mitchell Public Works Director, or at the office of Banner Associates, Inc., Consulting Engineers, 409 22nd Ave. South, P.O. Box 298, Brookings, S.D. 57006 and may be obtained at the latter by depositing the sum of Thirty Dollars ($30.00) for each set. This deposit will be refunded upon return of the Documents in good condition within ten (10) days after Bid opening. Payment for all work shall be in cash based on monthly estimates. Bids may not be withdrawn after the time fixed for opening them. The Owner reserves the right to waive irregularities and reject any and all Bids.
