Smith, Contracting Officer, (304) 625-2441 (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The Federal Bureau of Investigation (FBI) intends to negotiate on a sole-source basis with NewEra Software, Inc. No solicitation package is available. (iii) The solicitation document and incorporated provisions and clauses are those in effect through FEDERAL ACQUISITION CIRCULAR 97-04. (iv) This solicitation is not restricted to a set-aside. Standard Industrial Classification Code is 7372 and the small business size standard is $18.0 million in annual receipts. (v) A list of CONTRACT LINE ITEM NUMBERS (CLINs), items, quantities, and locations are: CLIN 0001: Standalone Environment MVS Recovery Software License, 3 Each, to be installed on an IBM 9021-982 and an Amdahl 5995-8670M in Washington, D.C. an IBM 9021-982 in Clarksburg, West Virginia; CLIN 0002: Option for Maintenance and Support Services for the three licenses from date of expiration of the warranty through September 30, 1999; CLIN 0003: Option for Maintenance and Support Services for the three licenses from October 1, 1999 through September 30, 2000; CLIN 0004: Option for Maintenance and Support Services for the three licenses from October 1, 2000 through September 30, 2001; and CLIN 0005: Option for Maintenance and Support Services for the three licenses from October 1, 2001 through September 30, 2002. (vi) The Federal Bureau of Investigation (FBI) intends to negotiate a firm-fixed-price contract on a sole-source basis with NewEra Software, Inc. for the purchase and maintenance of three (3) each Stand Alone Environment (SAE) MVS Recovery Software licenses. The SAE is a product which allows access to MVS formatted datasets for the purpose of editing, copying, or renaming without requiring an active operating system. The SAE also has the capability to listcat, altercat, Fast DASD erase, and undelete. The maintenance services shall be provided on a monthly basis after expiration of warranty and shall include such assistance as is necessary to cause the product to perform in accordance with its current published specifications; improvements, enhancements, extensions, and other changes to the product as are determined to be suitable to the uses made of the product, and updates to the product if and as required to cause it to operate under new versions or releases of the operating system(s) so long as such updates are technically feasible. (vii) Software shall be delivered within 30 days of receipt of an order to Clarksburg, West Virginia (1 license), and Washington, D. C. (2 licenses), and shall be F.O.B. Destination. (viii) FAR 52.212-1, Instruction to Offerors -- Commercial, is incorporated by reference and applies to this acquisition. ADDENDUM FAR 52.212-1 Para.
