This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is N66001-98-R-5048, and the solicitation is being issued as a request for proposal (RFP). It is the present intent of The Department of the Navy, Space and Naval Warfare Systems Center San Diego, San Diego, CA, to award a SOLE SOURCE firm-fixed price contract to Andrew Corporation, 10500 W. 153rd St., Orland Park, IL 60482, as the required supplies appear to be available from only one responsible source, and no other type of supplies will satisfy agency requirements. However, all responsible sources may submit an offer which will be considered. The provisions and clauses which apply to this solicitation are those in effect through Federal Acquisition Circular 97-04, effective date, 24 Apr 98, and the Defense Acquisition Circular 91-13, effective date, 9 Mar 98. The Standard Industrial Classification Code and Small Business Size Standard is 3229 and 750 employees. The solicitation closing date is 15 Jul 98, at 3:00 p.m., local time. The anticipated award date is 20 Jul 98. Award will be made to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, with demonstrated technical capability, past performance, and price considered in descending order of importance. Demonstrated technical capability and past performance, when combined, are significantly more important than cost or price. (Reminder: FAR 52.212-1 requires that offerors include past performance information when past performance is designated as an evaluation factor. In order to demonstrate technical capability, past performance information should include references for whom offerors have previously produced microcable in accordance with NOSC Specification 946-0004-91.) This acquisition is for the fabrication, testing, and delivery of Fiber Optic Microcable (FOMC) in accordance with NOSC Specification 946-0004-91, dated 3 Feb 92, with the following exceptions or additions: 1) The FOMC will be delivered in 20 Km lengths, and each individual length may range from minus 0% to plus 5%; 2) Corning, Inc. P/N SMF/DS-CPC6 with a thin dual coat layer of UV silicone and acrylate (silicone layer OD is 275 ums +/-15 ums, acrylate layer OD is 285 ums +/- 15 ums), in lieu of Corning, Inc. P/N SMF/DS-CPC3, is allowable for this purchase; 3) In reference to Paragraph 3.2.1.3.4, the hydrostatic pressure of the FOMC cable shall be capable of withstanding hydrostatic pressure of 6000 psi in lieu of the 9000 psi specified; 4) In reference to Paragraph 4.4, regardless of whether a test has been waived or performed during execution of this contract, the FOMC cables produced by the Contractor shall satisfy all FOMC requirements specified in Paragraph 3.2, and verified in accordance with the tests and examinations in Paragraph 4.3. In the event that subsequent Government testing of a FOMC deliverable identifies non-compliance of a requirement identified in NOSC Specification 946-0004-91, the Government will take the following steps: a) immediately notify the cognizant Government DCAS QAR representative and the cognizant Government Technical Direction Activity of the failure; b) inform the Contractor of the non-compliance; c) determine if re-performance of the test on the same cable deliverable is required in order to verify and satisfy the non-compliance; d) determine whether the defective material should be scrapped, reworked, replaced or accepted as is. If accepted as is, the request shall be documented as a waiver request (DD-1694), prepared in accordance with DoD-STD-481, and processed in accordance with the configuration control requirements established by the contract; and e) require shipment of the completed cables to cease until the Government positively determines that such cables do not contain the reported defect(s). In recognition of the Government's efforts to avoid duplicative costs, a number of the specification requirements shall be relaxed for the incumbent contractor, AndrewO Corporation, as follows: 1) In reference to Paragraph 3.3.1., the Government considers Andrew Corporation a qualified manufacturer of FOMC as described in NOSC Spec. 946-0004-91, and present SOTA raw materials used in the fabrication of "in specification" FOMC are considered acceptable; 2) In reference to Paragraph 3.3.2, adjustments to the FOMC standards of manufacture are at the discretion of Andrew Corporation; 3) In reference to Paragraph 3.3.6, the fabrication and testing of a Preproduction Sample is waived for Andrew Corporation; and 4) In reference to Paragraph 4.1.1.1.2, the Preproduction Sample Verification Tests are waived for Andrew Corporation. The Navy intends to award a firm-fixed price contract . The Contract Line Item Number (CLIN) for the FOMC will be 0001; the price proposed shall be by unit, with each unit equal to one meter. The cable is to be delivered in 16 supply spools of 20 Km per spool, for a total of 320 Km, with delivery required in a single shipment for receipt not later than 31 Aug 98. Deliverables will be CLIN 0002, and will not be separately priced. Requirements include NOSC Specification 946-0004-91, dated 3 Feb 92, and Contract Data Requirements List (CDRL) No. A001 through A007. It is impracticable to include the Specification and the CDRLs with this synopsis/solicitation.
