synopsis/solicitation for commercial items prepared in accordance with
the format in Subpart 12.6, as supplemented with additional
information included in this notice. Federal Acquisition Circular 97-04
applies to this acquisition. The National Institute of Standards (NIST)
has a requirement for a Millenia x 10W laser and intends to negotiate
with Spectra-Physics, P.O., Box 7013, 1330 Terra Bella Avenue, Mountain
View, CA 94039 on a noncompetitive basis. See Note 22. The SIC for this
procurement is 3699. This notice is not a request for competitive
proposals. The specified product, the Millenia X 10W, is the only know
solid state laser that satisfies the following essential system
requirements: i) power: 10 Watts, ii) wavelength: 532 NM, iii)
electrical requirements: 110 VAC, iv) optical noise: less than or equal
to 0.1%, v) laser shall have fiber coupled diodes, vi) laser shall have
no external water cooling, and vii) laser shall have one year warranty.
FOB is destination. Delivery is required two weeks after award of
purchase order at the following location: National Institute of
Standards and Technology, Building 301, RT 270 @ Quince Orchard Road,
Gaithersburg, MD 20899. NIST intends to solicit one source pursuant to
FAR 13.106-2(a)(5), which permits solicitation from one source if the
contracting officer determines that the circumstances of the contract
action deem only one source reasonably available. However, NIST will
consider all capability statements received within 14 days after the
posting of this combined synopsis-solicitation. Interested parties may
identify their interest and capability by submitting a written
capability statement. The capability statement must provide adequate
information describing how the they will satisfy the above
requirements. If it is determined that more than one source can satisfy
the requirements of this acquisition, NIST will solicit competitive
quotations. However, this determination is solely within the discretion
of NIST. The provision 52.212-1, Instructions to offerors -- Commercial
items, applies to this acquisition. The clause at 52.212-4, Contract
Terms and Conditions-Commercial Items, applies to this acquisition. The
clause 52.212-5, Contract Terms and Conditions required To Implement
Statues Or Executive Orders-Commercial Items, applies to this
acquisition. In compliance with the said clause, the following

Commerce Agency Level Protest Procedures Level Above the Contracting

shall submit the following: Quotation which addresses the following
contract line item number (CLIN): CLIN 0001, Millenia X 10W Laser.
Spectra Physics shall also submit a technical description and/or
product literature and two copies of the most recent published price
list and one completed copy of the provision at FAR 52.213-3, Offeror
Representations and Certifications Commercial Items, which may be
downloaded from the NIST external web page, the Internet address is

sent to National Institute of Standardsand Technology, Acquisition and

received by 3:00 p.m. Eastern time on July 20, 1998. The offer or
modifications to the offer received at the address specified for the
receipt of offers/quotes after the exact time specified for receipt of
