synopsis/solicitation for commercial items prepared in accordance with
the format in FAR Subpart 12.6, as supplemented with additional
information included in this notice. This announcement constitutes the
only solicitation; bids are being requested and a written solicitation
will not be issued. The solicitation document and incorporated
provisions and clauses are those in effect through Federal Acquisition
Regulation Circular 97-01. This procurement is being advertised as a
total small business set-aside, under classification code 8299, with a
small business size standard of $5.00 Million. Any quotes received
from large business will be considered non-responsive, and will not be
considered for award. (A) Schedule: The contractor shall provide
services as and ESL instructor/test administrator/test records keeper
for inmates at the Federal Prison Camp, P.O. Box 500, Hwy 395, 6 miles
north of Kramer Junction, Boron California for the period from date of
award through 9/30/99. Please provide a price per session (session is
6 hours in length), there will be approximately 250 sessions. The
period of performance will be from date of award through 9/30/99.
Individual providing services on behalf of the contractor must provide
verification of the following: (1) Baccalaureate degree; (2) Knowledge
and experience in ESL instruction; (3) experience in test
administration; (4) proficient typist; (5) Knowledgeable in English
grammar, spelling and punctuation; working knowledge of WordPerfect
5.1/6.0 and PLATO applications software programs; (6) knowledge of
policies~ rules and regulations governing Education Testing practices.
(B) Statement of Work: (1) Administer the following test to qualifying
inmate students: PreGED, GED, college placement, college make-up exam,
college correspondence course exams, other state exams; (2) Contractor
will interpret and enter all test results in inmate education records
and make comments for periodic review records to record progress or
lack thereof. Contractor will enter all scores on 3 x 5 cards.
Contractor will also keep records to include bimonthly record audits,
tabulate education data and other material in accordance with
established guidelines/policies. Maintain and account for all Education
Department records of testing data. Update same and assist in record
keeping as required. The Contractor shall operate a system of records,
in accordance with the Privacy Act, to accomplish the Bureau of
Prison's requirements for testing and Literacy/ESL program
participation and achievement; (3) Keep current on educational
requirements and transferable courses. Assist students in defining
their educational needs and focusing on goals consistent with college
placement test scores, assist inmate students in selecting classes at
their appropriate ability level by interpreting results and making
recommendations; (4) Keep the Education Aide and Literacy Coordinator
informed as to who needs testing and the results in concert with
teachers for movement of students within the literacy and ESL Programs;
(5) Perform a weekly inventory of all tests, answer sheets, and related
materials. Monitor stock and inform COTR of all acquisition
requirements, (6) Work with teachers to schedule retests and to ensure
students are not overlooked and are tested when ready. Schedule tests
and encourage students. In conjunction with teachers, determine
students' weak areas and assist them with their programs to strengthen
weak areas; (7) Prepare and conduct follow-up for all GED testing
activity for inmates; (8) Provide feedback to students of testing
results as well as maintaining a test record file for teacher
reference. Teach literacy for students below the fourth grade level.
Assist in coordination and presentation of Computer Assisted
Instruction programs; (9) Score placement test for students enrolling
in college courses; (10) Ensure that work performed is in compliance
with BOP policies and program review guidelines; (11) Complete student
progress reviews as required, provide Literacy Coordinator with
feedback on interpretation of testing after testing sessions are
requested, record dates of participation in the ESL/Literacy program in
SENTRY transaction book to the Literacy Coordinator. Program Record and
Literacy Periodic Review Record for all limited English proficient and
GED need inmates in the institution, and will ensure that initial
assessment and achievement scores on ESL and Literacy students are
recorded per policy. The ESL/Literacy instructor shall monitor the
progress of the inmates in the ESL/Literacy program until the program
is completed; (12) The contractor shall prepare and follow-up on all
necessary class material and lesson plans, prove feedback to students
in the ESL/Literacy program as well as maintain a record file for
teachers and an education team representative; (13) Administer the
practice and official General Educational Development (GED) test,
college testing, and a variety of other tests as required to inmate
students; (14) Tabulate education data and other material in accordance
with established guidelines and policies; (15) Prepare and conduct
follow-up for all GED testing activity for inmates; (16) Order and
inventory all GED tests; (17) Provide feedback to students and maintain
a test record file for teacher reference; (18) Possess the ability and
experience to acquire and apply a practical knowledge and
understanding of program policies and other requirements relating to
the assignment; (19) Incumbent will be responsible for coordinating and
operating the ESL program; (20) Incumbent will be responsible for
providing individual instruction to non-English speaking inmates whose
reading and listening scores fall below 225 and 215, respectively, as
measured by the CASAS; (21) Compile grades and records of ESL work
assignments, (22) Incumbent will develop a curriculum that will enable
ESL students to achieve a minimum score of 225 on the 522 reading
certification test and a minimum score of 215 on the listening test
(level B and C) as measured by CASAS; (23) Incumbent will maintain
inventory and take care of all issued equipment and supplies for the
ESL program; (24) With the assistance of the Literacy Coordinator, the
incumbent will order books and material as needed to maintain the ESL
program; (25) Incumbent will prepare a progress report for each
student enrolled in ESL on a monthly basis; (I) Place of Performance:
Place of Performance will be the Federal Prison Camp, Located at HWY
395, 6 miles north of Kramer Junction, Boron, CA 93516. (Ii) Schedule:
Services to be provided every Monday, Tuesday, Wednesday, Thursday and
Friday (excluding federal holidays). Session will be from 8:00 a.m. to
2:30 p.m. Monday to Friday (which includes a 30 minute lunch break).
(Iii) Supplies: All supplies that the contractor may routinely need for
services at the institution will be provided by the Education
Department. These supplies normally include testing materials, etc.
(iv) Method of Performance: The service provided, being professional in
nature will be provided in the method as considered normal in the local
community. These services, although not directly supervised, will be
reviewed by a staff member of the Education department of the
institution. The performance of these services will also be verified by
the designated Contracting Officer Technical Representative (COTR). All
education records remain the property of the Federal Bureau of Prisons.
This contract is a nonpersonal services contract; the Government may
evaluate the quality of professional and administrative services
provided, but retains no control over the professional aspects of
services rendered (e.g., professional judgments, etc), in an amount
which is not less than the amount normally prevailing within the local
community to Boron, California, for ESL instructors. This will be a
contractual arrangement and not a personnel appointment; payment is
based on the provision of an end product or the accomplishment of a
specific result; results to be obtained will be subject to Government
supervision. (C) clauses/provisions: (I) FAR Clause 52.212-1,
"Instructions to Offeror-Commercial," is hereby included by reference.
The following are addenda to FAR Clause 52.212-1: The amount of time
the offeror agrees to hold the prices in its offer firm is changed to
60 calendar days from date specified for receipt of offers. (2)
Paragraphs (c) "multiple offer" and (h) "Multiple Awards" have been
determined by the Contracting Officer to be non-applicable to this
solicitation and are hereby removed in their entirety for the purpose
of this requirement. (3) Evaluation Factors for Award: Offerors are
advised that quotes shall be evaluated without discussion. Award will
be made to the responsible offeror whose quote is responsive to the
items of the RFQ and is most advantageous to the Government,
considering only price and price-related factors, if any, as specified
in the RFQ. (4) Business References: In order to assist the
Contracting Officer in making a responsibility determination about a
prospective contractor, in accordance with FAR subpart9.104-1 it is
required that each offeror provide information on a reasonable number
of recent and relevant contracts for the same or similar items, as well
as the offeror's primary financial institution (to include contract
number, points of contact, telephone numbers, and any other relevant
information). The following are addenda to FAR Clause 52.212-4: (1) The
following FAR Clauses are hereby incorporated by reference, pursuant to
FAR Clause 52.252-2, ~Clauses Incorporated by Reference": 52.219-6,
"Notice of Small Business Set-Aside"; 52.224-1, "Privacy Act
Notification"; 52.224-2, "Privacy Act"; 52.225-11 "Restrictions on
Certain Foreign Purchases"; 52.232-18, "Availability of Funds";
52.237-2, "Protection of Government Buildings, Equipment, and
Vegetation"; 52.225-3, "Continuity of Services", is hereby incorporated
in full test, (a) Mr. Paul Hanson, Supervisor of Education, Federal
Prison Camp, Boron, California, is hereby designated to act as
Contracting Officer's Technical Representative (COTR) under this
contract. (B) The COTR is responsible for: receiving all deliverables;
~inspecting and accepting the supplies or services provided hereunder
in accordance with the terms and conditions of this contract;
providing direction to the contractor which clarifies the contract
effort, fills in details or other wise serves to accomplish the
contractual Scope of Work; evaluating performance; and certifying all
invoices/vouchers for acceptance of supplies or services furnished for
payment prior to forwarding the original invoices to the payment
office and a conformed copy to the Contracting Officer. (C) The COTR
does not have authority to alter the contractor's obligations,
specifications, or cost of the agreement. If as a result of technical
discussions it is desirable to alter/change contractual obligations or
the Scope of Work, the Contracting Officer shall issue such changes in
writing and signed. (IV) FAR Clause 52.212-5, "Contract Terms and
Conditions Required to Implement Statutes or Executive Orders --
Commercial incorporated: Security Requirements: In accordance with
Program Statement 3000.02, contract employees entering the institution
will be subject to the following investigative procedures, prior to
performance: NCIC Check (National Crime Information Center); DOJ-99
(Name Check); FD-99 (Fingerprint Check); Law Enforcement Agency Checks;
Vouchering of Employees over past 5 years; Personal Qualifications
Statement; OPM-329-A (Authority for Release of Information); and a
Urinalysis Test (positive results will result in disallowance of an
individual to perform under this contract). Whenever driving or riding
on this institution, contractors will oblige with the Safety Seat Belt
regulations at all times. This solicitation does not constitute an
employee/employer relationship. Quotes shall be received at the
