This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotation is being requested and a written solicitation will not be issued. This request for quotation (RFQ), number 98L005610, is for the purchase and delivery of one (1) Coho software package. The Department of Health and Human Services (HHS), Program Support Center, knows of only one source, Avue Technologies Corporation, 1142 Broadway Plaza, Suite 400, Tacoma, WA 98402. Solicitation documents, provisions and clauses herein are those in effect through Federal Acquisition Circular 97-05. The Standard Industrial Classification code is 5045 with a small business size standard of 100. The Contractor shall provide a quantity of one (1) each of the following items: 1)Intranet Shell for use on a Client Web Server -- enterprise wide license, allowing unlimited concurrent use and unrestricted distribution within HHS (not to exceed 25,000 employees); 2) Database and upgrades -- annual database expense covers one initial release and 11 subsequent database upgrades; 3) Annual maintenance -- covers software enhancements to the expert system shell and technical assistance via access to the aVue help desk; 4) Tacklebox training -- a two week certification course for two Human Resource Specialists; and 5) Installation of the Intranet shell on a single web server and testing from client systems to insure accessability. Delivery of the software is required 3 weeks from the date of issuance of a purchase order. The provision at FAR 52.212-1, Instructions to Offerors -- Commercial Items (APR 1998), and the clause at FAR 52.212-4, Contract Terms and Conditions -- Commercial Items (APR 1998), applies to this acquisition. Offeror shall submit a fully executed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items (JAN 1997) with their offer. The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders -- Commercial Items (APR 1998), applies to this acquisition as well as the following clauses cited therein: FAR 52.222-26, Equal Opportunity (APR 1984); FAR 52.222-35, Affirmative Action for Special Disabled and Vietnam Era Veterans (APR 1998); FAR 52.222-36, Affirmative Action for Handicapped Workers (JUN 1998); FAR 52.222-37, Employment Reports on Special Disabled Veterans and Veterans of the Vietnam Era (APR 1998); and FAR 52.225-3, Buy American Act -- Supplies (JAN 1994). A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government.
