commercial items prepared in accordance with the format in far subpart
12.6, as supplemented with additional information included in the
notice. This announcement constitutes the only solicitation; quotes are
being requested and a written, Request For Quotation (RFQ),
solicitation will not be issued. The RFQ and incorporated provisions
and clauses are those in effect through Federal Acquisition Circular
97-07. The RFQ number is MS-98-Q-0030 and is issued as a 100% small
business set-aside subject to the special authority for acquisition
threshold but not greater than $5,000,000.00, including options. The
Standard Industrial Classification (SIC) Code is 8741. The small
business size standard is $5 million. It is the intent of the USMS to
award a purchase order for a base year with 4 one year options. The
USMS reserves the right to award to other than the lowest cost quote
and incomplete quotes may not be considered for an award. For
evaluation, past performance is significantly more important then
price. To be considered technically acceptable, the Quoter must submit
a technical description of the items being offered in sufficient
detail for the CO to decide that the quotation meets the requirements
of the RFQ. The quote must include firm-fixed pricing for all services
offered. Services Required: The contractor will provide technical
assistance to senior USMS management in the execution of the agencies
resposibility related to the seizure, management and dispostion of
business(es)and business asset(s). This assistance will include, but
not limited to, the following actions: 1. Provide preseizure assistance
to determine the viability of pursuing forfeiture of a business entity.
2. Conduct on-sight business reviews to analyze the following: --
Ownership -- Management and administrative systems -- Operations --
facilities and equipment -- staffing -- suppliers -- customers --
competition -- strenghts and weaknesses -- Financial stregth -- assests
and liabilities -- Human resources -- Marketing and advertising --
Regulatory, environmental, taxes, license, and other compliance. 3.
Draft appropriate Court Orders 4. Assist in the selection of monitors
and trustees, to include the drafting of statements of work and billing
procedures 5. Conduct Business Appraisals 6. Serve as an expert witness
for the government 7. Provide consultation on disposition strategies 8.
Assist in the development and rewite of USMS/Department policies
governing business seizures. 9. On an as needed basis, conduct
independent reviews of program operations and identify deficiencies and
make recommendations for corrective action. 10. Develop and conduct
training session on an as needed basis. The provision at FAR 52.212-1,
Instructions to Offerors -- Commercial Items, and FAR Provision
52.212-2, Evaluation of Commercial Items, are applicable to this
acquisition. The clause at FAR 52.212-4, Contract Terms and Conditions-
Commercial Items, and the clause at FAR 52.212-5, Contract Terms and
Conditions Required to Implement Statutes or Executive
Orders-Commercial Items, apply to this acquisition. Evaluation of
Commercial Items: The Government will award to the responsible bidder
offering the best value in terms of price and past performance. For
evaluation, past performance is significantly more important then
price. To be considered technically acceptable, the Quoter must submit
a technical description of the items being offered in sufficient
detail for the CO to decide that the quotation meets the requirements
of the RFQ. NOTE: Quoters responding to this solicitation must submit
unit and extended price for all services offered, prompt payment terms,
and a completed copy of the provision at FAR 52.212-3, Offer
Representations and Certifications-Commercial Items, with their bids.
